CITY OF POMONA

COUNCIL REPORT
May 15, 2023
To: Honorable Mayor and Members of the City Council
From: James W. Makshanoff, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVE AMENDMENT NO. 3 TO THE PROFESSIONAL SERVICES AGREEMENT STANTEC CONSULTING SERVICES RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve Amendment No. 3 to an agreement with Stantec Consulting Services in an amount not to exceed $2,841,703 with an expiration date of June 30, 2024; and Authorize the City Manager to execute Amendment No. 3 with Stantec on behalf of the City, subject to approval to form by the City Attorney.

EXECUTIVE SUMMARY:

Staff is seeking City Council approval for Amendment No. 3 to an agreement with Stantec Consulting Services (Stantec) to continue implementing the Coordinated Integrated Monitoring Program (CIMP) on behalf of the East San Gabriel Valley Watershed Management Group (cities include Claremont, La Verne, Pomona and San Dimas). The attached agreement and all associated amendments to it have been and will continue to be funded by the cities of Claremont, La Verne, San Dimas, and Pomona, in the amounts shown in Fiscal Impact section, Table 1.

FISCAL IMPACT:

The attached agreement covers two different general tasks and multiple funding sources; ongoing monitoring necessary for Regional Board compliance, and projects related to Measure W, Safe Clean Water (SCW). Funding for the original agreement and all amendments has come from the Cities of Pomona, Claremont, La Verne, and San Dimas, and SCW. Additionally, because the agreement is a multiyear agreement, many of the tasks included in the agreement and previous amendments have been completed. The table below delineates the expenses, and what was paid in each year, and the funding source. Funding for this third amendment amounts to $660,602 for FY 2023-2024, which will be shared by the City and the three other cites listed above, and from funding from SCW, as delineated in the Table 1 on the following page. This item is included in the FY 2023-24 Operating Budget Fund No. 592-8131-52285-00000.

PREVIOUS RELATED ACTION:

On June 1, 2020, the Council approved the award of a sole source agreement with Stantec for $656,681 to provide engineering services for the implementation of the Coordinated Integrated Monitoring Program on behalf of the East San Gabriel Valley Watershed Management Group. On January 4, 2021, City Council approved Addendum No. 1 for an infiltration study, and adopted Resolution 2021-02 to amend the FY2020-21 adopted budget. To continue to complete the required Regional Boards monitoring efforts, on August 5, 2022, City Council approved Amendment No. 2 in an amount not to exceed $2,181,202 with an expiration date of June 30, 2023.

DISCUSSION:

The City must meet numerous stormwater and non-stormwater water quality monitoring requirements under its MS4 permit. In an effort to coordinate these activities and reduce costs, over the last 10 years, the City has collaborated with the cities of Claremont, La Verne, and San Dimas and has used the services of Stantec for that entire duration. Because Stantec works for all four cities and has a complete understanding of the permitting needs and knowledge of the basins and tributaries within each city, staff recommends the continued use of Stantec’s services.

At this juncture, staff is seeking approval of Amendment No. 3, to complete this year’s required Regional Board monitoring and reporting activities. The City will continue to work with our neighboring cities to cost share and share data. The attached agreement has been approved as to form by the City Attorney.
