RESOLUTION NO. 2023-128
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT LLA2-2022 FOR THE PROPERTIES LOCATED AT 21-31 AND 55-65 RANCHO CAMINO DRIVE, POMONA, CA, ASSESSOR PARCEL NUMBERS 8708-001-042 TO -053 AND -055 WHEREAS, the City of Pomona Public Works Department has received a request for Lot Line Adjustment LLA2-2022 for the real properties associated with Assessor Parcel Numbers 8708-001-042 to -053 and -055, located at 21-31 and 55-65 Rancho Camino Drive, Pomona, CA; and WHEREAS, Kevin Hadley with Incledon Consulting Group, applicant, has submitted all required documents for review by the City Engineer, pursuant to California Government Code Section 66412 (d), et seq; and WHEREAS, pursuant to Chapter 78 of the Pomona City Code, Section 29-45 (b), unless a project related to the subject lot line adjustment has been previously considered by the Planning Commission, final approval of the lot line adjustment shall be made by the City Council, subject to findings of the City Engineer, set forth in Section 29-45 (b)(1), (b)(2), (b)(3) and (b)(4); WHEREAS, the City Engineer has reviewed and determined that the completed application for the proposed lot line adjustment is compliant with the Subdivision Map Act and applicable City Codes; and WHEREAS, the Planning Division has reviewed and determined that the completed application for the proposed lot line adjustment is compliant with the City’s General Plan and Zoning Code; and WHEREAS, pursuant to Article 19 Categorical Exemptions, Section 15305 of the Guidelines for Implementation of the California Environmental Quality Act (CEQA), the project is exempt from further CEQA review and documentation. Section 15305 pertains to Class 5 projects, consisting of “minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. The foregoing recitals are true and correct.
SECTION 2. The City Council hereby finds, based on the evidence submitted, that the Notice of Lot Line Adjustment LLA2-2022 attached hereto as EXHIBIT 1 is hereby approved as depicted by legal description and map marked as EXHIBIT “A” and EXHIBIT “B” attached hereto and by reference made a part thereof.
SECTION 3. The City Council hereby authorizes the City Engineer to sign the Notice of Lot Line Adjustment on behalf of the City of Pomona.
SECTION 4. The City Clerk shall attest and certify to the passage and adoption of this Resolution and it shall become effective immediately upon its approval.
