COUNCIL REPORT
July 17, 2023
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVE FIRST AGREEMENT AMENDMENT FOR THE PURCHASE AND SALE OF RECLAIM WATER AND RELATED FACILITIES WITH THE COUNTY SANITATION DISTRICT NO. 2 OF LOS ANGELES COUNTY RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve the first amendment to the agreement for the purchase and sale of reclaim water and related facilities with the County Sanitation District No. 2 of Los Angeles County (District); and, Authorize the City Manager, or designee, to sign the agreement amendment with the District, Attachment No. 1.

EXECUTIVE SUMMARY:

The City’s recycled water purchase contract with the District expired on July 1, 2023. This first amendment will extend the existing agreement term by one (1) additional year, beginning on July 2, 2023.

FISCAL IMPACT:

This agreement amendment extends the term of the existing agreement to receive recycled water from District. As all other terms remain unchanged, there is no financial impact with the recommended action.

PREVIOUS RELATED ACTION:

April 5, 2004, City Council adopted Resolution No. 2004-84 approving the agreement between the Districts and the City of Pomona for the sale of two-thirds of the recycled water discharged from District’s Pomona Water Reclamation Plant.

DISCUSSION:

On April 5, 2004, the City entered into a 20-year agreement with District for the purchase and sale of recycled water to the City of Pomona (Attachment No. 2). At the request of District, staff is seeking approval of the first amendment to allow additional time to negotiate the terms of a new agreement. The attached agreement amendment has been reviewed by the City Attorney and was approved as to form.
