CITY OF POMONA

COUNCIL REPORT
August 21, 2023
To: Honorable Mayor and Members of the City Council
From: James W. Makshanoff, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVAL OF AGREEMENT WITH LOS ANGELES GATEWAY REGION INTEGRATED REGIONAL WATER MANAGEMENT JOINT POWERS AUTHORITY (GWMA) RECOMMENDATION:

It is recommended that the City Council take the following actions:
1) Approve the agreement with GWMA for continued cost sharing for the installation, monitoring equipment, and monitoring pursuant to the Harbor Toxic Pollutants Total Maximum Daily Load (TMDL); and 2) Authorize the City Manager or designee, to execute the Agreement (Attachment No 1) on behalf of the city, subject to approval by the City Attorney.

EXECUTIVE SUMMARY:

Approval of this award will continue the cost sharing for the equitable protection and management of water resources with GWMA. The City has participated in this monitoring program since 2015; with agreements executed in both 2015 and 2018. This third agreement will allow for the continuation of the monitoring for an additional three years. This action will allow the City to stay in compliance with the Harbor Toxic Pollutant TMDL per the storm water permit.

FISCAL IMPACT:

Funding for this action is available within the FY 2023-24 Safe Clean Water Program Fund Budget, account number 142-8130-52299-00000. The total cost for GWMA is $142,513 for FY 2023-24, shared with 63 cities and Los Angeles County. The cost share portion for the term of the agreement for the City will budget annually and is as follows:

PREVIOUS RELATED ACTION:

The City entered in to agreement with GWMA to participate in the Joint Dominguez Channel/Harbor Toxic TMDL Monitoring Program on June 1, 2015.

DISCUSSION:

The City is mandated to meet numerous requirements under the National Pollutant Discharge Elimination System Municipal Separate Storm Sewer System Permit. Collaborating with the neighboring cities and Los Angeles County allows the City to stay in compliance while sharing the cost of the monitoring equipment and the actual monitoring needed.

The United States Environmental Protection Agency established the TMDL for Toxic Pollutants in March of 2012 to protect and improve the water quality in the Dominguez Channel and the Greater Los Angeles and Long Beach Harbor Waters.

The City began sharing these costs in 2015, and the current 2018 agreement expired on June 30, 2023. The attached agreement will allow the City to stay in compliance with the Harbor Toxic TMDL through fiscal years 2025-2026.
