SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE ADDING A NEW PRE-ARREST YOUTH DIVERSION POLICY TO THE POMONA CITY CODE RECOMMENDATION:
It is recommended that the City Council adopt the following ordinance:
ORDINANCE NO. 4336 – AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, ADDING A NEW DIVISION I (“PRE-ARREST YOUTH DIVERSION POLICY”) AND ARTICLE XI (“LAW ENFORCEMENT POLICY”) TO CHAPTER 2 (“ADMINISTRATION”) OF THE CITY OF POMONA CITY CODE CONCERNING ESTABLISHMENT OF A PRE-ARREST YOUTH DIVERSION POLICY BY THE POMONA POLICE DEPARTMENT DISCUSSION:
At the July 17, 2023 City Council meeting, the City Council directed staff to return with a proposed Ordinance with respect to a youth diversion policy. The Pomona Police Department has been collaborating with community leaders and organizations to develop sustainable youth diversion programs and policies. The Police Department has also collaborated with Los Angeles County entities in order to participate in existing youth diversion programs. These collaborative efforts have resulted in successfully diverting youth from the criminal justice system.
Proposed Ordinance No. 4336 was first introduced and given first reading at the August 7, 2023 Council meeting (Attachment No. 1). The purpose of proposed Ordinance No. 4336 (Attachment No. 2) is to memorialize the City’s commitment to youth diversion programs through the adoption of Ordinance No. 4336, a future Resolution, and policies.
The ordinance will take effect 30 days after its adoption on August 21, 2023.
