SUBJECT: AWARD OF CONSTRUCTION CONTRACT TO FS CONTRACTORS, INC. IN THE AMOUNT OF $892,455 FOR “ADA CURB RAMPS AND PATH OF TRAVEL – CITYWIDE (CDBG) (FY 21-22),” CITY PROJECT NO. 428-2590-XXXXX-67934, FEDERAL PROJECT NO. CRRSAAFL-5070(043) RECOMMENDATION: It is recommended that the City Council take the following actions:
Award a construction contract to FS Contractors, Inc. for “ADA Curb Ramps and Path of Travel - Citywide (CDBG) (FY 21-22),” City Project No. 428-2590-XXXXX-67934, Federal Project No. CRRSAAFL-5070(043) to include all Base Bids (A, B, & C) in the amount of $892,455; Find that the project referenced above is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c) and that the proposed project will not have a significant effect on the environment; and Authorize the City Manager, or his designee, to execute the construction contract/agreement and related documents (permits, etc.).
EXECUTIVE SUMMARY:
This action will result in awarding a construction contract to FS Contractors, Inc. in the amount of $892,455 to provide continuous path of travel access improvements per the requirements of the Americans with Disabilities Act (ADA) for “ADA Curb Ramps and Path of Travel - Citywide (CDBG) (FY 21-22),” City Project No. 428-2590-XXXXX-67934, Federal Project No. CRRSAAFL-5070(043) (Project).
FISCAL IMPACT:
Approval of this action will award a construction contract in the amount of $892,455 to FS Contractors, Inc. The following table details the fiscal impacts associated with the recommended actions:

PUBLIC NOTICING REQUIREMENTS:
In accordance with Section 2-1003 - Formal Procedure of the City’s Purchasing Ordinance, a Notice of Inviting Bids (IFB#2023-26) to construct “ADA Curb Ramps and Path of Travel - Citywide (CDBG) (FY 21-22),” City Project No. 428-2590-XXXXX-67934, Federal Project No. CRRSAAFL-5070(043) was posted on the City’s electronic bidding platform, Planet Bids, on August 9, 2023. Bids were opened on September 7, 2023.
PREVIOUS RELATED ACTION:
On June 5, 2023, City Council adopted Resolution No. 2023-98 to approve the FY 2023-24 CIP Budget.
ENVIRONMENTAL IMPACT:
The Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c) in that the project consists of the repair of existing curb ramps, sidewalks, street intersections, and alleys.
DISCUSSION:
On August 9, 2023, Invitation for Bids (IFB) No. 2023-26 “ADA Curb Ramps and Path of Travel - Citywide (CDBG) (FY 21-22),” City Project No. 428-2590-XXXXX-67934, Federal Project No. CRRSAAFL-5070(043) was issued on the City’s electronic bidding platform. The solicitation notified 543 potential bidders, of which 40 bidders downloaded the IFB, resulting in the City receiving seven (7) proposals. All seven (7) bids were evaluated based on their pricing proposal and minimum qualifications. The lowest responsive and responsible bid for the total base bid in the amount of $892,455 was submitted by FS Contractors, Inc. (see table below). This bid is lower than the Engineer’s Estimate and is recommended for award based on available funding.

This Project will provide for ADA improvements including, but not limited to, sidewalks, street intersections, and alley approaches necessary to provide a continuous path of travel for pedestrian access. This work is recommended per the City of Pomona (City) ADA Transition Plan and will be constructed as funds allow.

This item supports the following 22-23 City Council Priorities and Goals: Goal P: Improve condition of streets, alleys, and associated sidewalks.
