RESOLUTION NO. 2023-167
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, TO AMEND THE FY 2023-24 CAPITAL IMPROVEMENT PROGRAM (CIP) BUDGET BY RECEIVING, INCREASING REVENUE ESTIMATES, AND APPROPRIATING AN IN-LIEU PAYMENT OF $15,050 FROM MORILLO CONSTRUCTION, INC. TO “STREET PRESERVATION – LOCAL (FY 23-24),” PROJECT NO. 428-2590-XXXXX-68592 WHEREAS, the City Council desires to amend the adopted FY 2023-24 CIP Budget by receiving, increasing revenue estimates, and appropriating an in-lieu fee in the amount of $15,050 from Morillo Construction, Inc. to “Street Preservation – Local (FY 23-24),” Project No. 428-2590-XXXXX-68592; and WHEREAS, the in-lieu fee equates to the estimated cost of repaving Buena Vista Avenue at the utility cut locations; and WHEREAS, the Pomona City Charter requires that amendments to the Adopted CIP Budget be approved by City Council by Resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. That the City Council hereby approves and accepts the negotiated in-lieu fee in the amount of $15,050 from Morillo Construction, Inc.
SECTION 2. The City Council amends the adopted FY 2023-24 CIP Budget by receiving, increasing revenue estimates, and appropriating an in-lieu fee in the amount of $15,050 to “Street Preservation – Local (FY 23-24),” Project No. 428-2590-XXXXX-68592 (428-2590-40915-68592, 428-2590-66196-68592).
SECTION 2. The City Clerk shall attest and certify to the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.
