It is recommended that the City Council adopt the following resolution:
RESOLUTION NO. 2023-167 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, TO AMEND THE FY 2023-24 CAPITAL IMPROVEMENT PROGRAM (CIP) BUDGET BY RECEIVING, INCREASING REVENUE ESTIMATES, AND APPROPRIATING AN IN-LIEU PAYMENT OF $15,050 FROM MORILLO CONSTRUCTION, INC. TO “STREET PRESERVATION – LOCAL (FY 23-24),” PROJECT NO. 428-2590-XXXXX-68592 EXECUTIVE SUMMARY:
Earlier this summer, as part of the City of Pomona’s (City) CIP, the City was preparing to repave Buena Vista Avenue from Mission Boulevard to 9th Street. At the same time, there was a housing development project located at the southwest corner of Mission Boulevard and Buena Vista Avenue that was required to repave Buena Vista Avenue along their project frontage resulting from underground utility cuts per the project’s conditions of approval. So as to minimize utility and paving conflicts, City staff negotiated with the developer to complete their utility cuts prior to the City’s paving project, and the developer also agreed to pay the City an in-lieu fee in amount of $15,050, the cost of repaving the street at the utility cut locations.
FISCAL IMPACT:
The in-lieu payment of $15,050 for public improvements will be received and appropriated to “Street Preservation – Local (FY 23-24),” Project No. 428-2590-XXXXX-68592, the next local street preservation project in the same District. This project currently has a budget of $3,571,167 funded with SB-1 and Vehicle Impact Fees funds. The table below summarizes the impact of the recommended actions:

DISCUSSION:
Earlier this summer, the City was preparing to construct pavement rehabilitation improvements on Buena Vista Avenue per CIP project, “Buena Vista Avenue Rehabilitation – Mission Boulevard to 9th Street,” 428-2590-XXXXX-68576 . At the same time, there was an on-going housing development project at the southwest corner of Mission Boulevard and Buena Vista Avenue that was required to repave Buena Vista Avenue along their project frontage resulting from underground utility cuts per the project’s conditions of approval. So as to minimize utility and paving conflicts, City staff were able to coordinate with the developer to ensure all underground utility work on Buena Vista Avenue was completed prior to the City repaving the street. The developer also agreed to pay an in-lieu fee in the amount of $15,050 to the City, equating to the estimated cost of repaving the street at the utility cut locations on Buena Vista Avenue.
Since the City’s paving of Buena Vista Avenue has already been completed and is preparing for closeout, City staff recommends appropriating the in-lieu fee to the next local street preservation project in the same District. Approval of the recommended action to adopt Resolution No. 2023-167 (Attachment No. 1) will accept and appropriate the in-lieu fee to a future street repaving project.
