RESOLUTION NO. 2023-214
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF POMONA A GENERAL TAX MEASURE MAINTAINING THE CURRENT RATE OF THE CITY’S TRANSACTIONS AND USE TAX AT THREE-QUARTERS PERCENT (0.75%) AND EXTENDING THE TERM OF THE TAX BY REMOVING ITS MARCH 31, 2029 SUNSET, AT THE MUNICIPAL PRIMARY ELECTION TO BE HELD ON TUESDAY, MARCH 5, 2024.

WHEREAS, pursuant to Pomona Municipal Code, Article XII of Chapter 50 (PMC Sections 50-601 through 50-615 and 50-651-653), the City currently imposes a voter-approved tax on the sale and use of tangible personal property sold at retail within the City, at a rate of three-quarters percent (0.75%) of the transaction (“Transactions and Use Tax”); and WHEREAS, pursuant to Pomona Municipal Code Section 50-614, the Transactions and Use Tax is set to expire/“sunset” on March 31, 2029, after which the City shall no longer be authorized to collect the Transactions and Use Tax; and WHEREAS, pursuant to authority provided by statute, a petition has been filed with the City Council of the City of Pomona, seeking to enact an initiative measure/ordinance which would reduce the rate of the City’s current Transactions and Use Tax from three-quarters percent (0.75%) to one-half percent (0.50%) and would also extend the term of the Tax by repealing its March 31, 2029 expiration date/sunset (the “Mendoza Initiative”); and WHEREAS, the City Clerk’s office has examined the records of voter registration and ascertained that the petition was signed by the requisite number of voters and has so certified; and WHEREAS, the City Council has not voted in favor of adoption of the Mendoza Initiative and therefore, pursuant to the California Elections Code, adopted Resolution No. 2023-211 on November 6, 2023 to place the Mendoza Initiative before the City’s voters on the March 5, 2024 Municipal Primary Election ballot; and WHEREAS, the City Council desires to place a competing measure on the March 5, 2024 Municipal Primary Election ballot that would maintain the Transactions and Use Tax at a rate of three-quarters percent (0.75%) of the transaction and which would repeal its March 31, 2029 expiration date/sunset, resulting in a rate that is different than that provided in the Mendoza Initiative; and WHEREAS, the City’s Transactions and Use Tax is a general tax, the revenue of which is placed in the City’s general fund and is used to pay for important general City services; and WHEREAS, pursuant to Proposition 218 (California Constitution, Article XIIIC, Section 2(b)) any measure proposing to impose a new general tax, or increase or extend an existing general tax must be consolidated with a “regularly scheduled general election” for members of the City Council, unless the City Council makes certain fiscal emergency findings by unanimous vote to place the measure on a special election at another date; and WHEREAS, the next regularly scheduled general election at which City Council members are to be elected is not until Tuesday, November 5, 2024; and WHEREAS, for the following reasons, the health, safety and general welfare of the citizens of the City would be endangered if the City were unable to place this Measure before its voters until November 5, 2024; and WHEREAS, the Mendoza Initiative would lower the Transactions and Use tax rate resulting in an annual revenue reduction averaging $5.8M annually in the General Fund; and WHEREAS, as outlined in the financial impact analysis report presented to the City Council on October 2, 2023 pursuant to California Elections Code Section 9212, the Mendoza Initiative would create significant and growing annual operating deficits in every year of the General Fund forecast; and WHEREAS, as outlined in the impact report, the Mendoza Initiative would deplete General Fund reserves by FY 2036-37; and WHEREAS, to avoid this financial impact, the City would have to significantly restructure and/or reduce municipal services delivered to city residents and businesses; and WHEREAS, in order to properly budget for City expenses in Fiscal Year 2024-25 and for future fiscal years, the City must know Pomona voters’ wishes sooner than the November 5, 2024 General Municipal Election; and WHEREAS, all of the circumstances described above create an emergency situation warranting the placement of this Measure on the next available election ballot date to permit the voters to decide pursuant to Proposition 218; and WHEREAS, the next available election ballot date is the City’s Municipal Primary Election to be held on Tuesday, March 5, 2024; and WHEREAS, the specific terms of the Measure are attached hereto as Exhibit “A” and by this reference made an operative part hereof, and in accordance with all applicable laws.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
