SUBJECT: APPROVAL OF LOT MERGER LM10-2023 FOR THE PROPERTY LOCATED AT 1400 W. MCKINLEY AVENUE, POMONA, CA, ASSESSOR PARCEL NUMBER 8360-030-029, RELATED TO FUTURE UPGRADES OF AN EXISTING RESIDENTIAL PROPERTY (COUNCIL DISTRICT 1) RECOMMENDATION:

It is recommended that the City Council take the following actions:

Adopt the following resolution:

RESOLUTION NO. 2023-197 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, APPROVING LOT MERGER LM10-2023 FOR THE PROPERTY LOCATED AT 1400 W. MCKINLEY AVENUE, POMONA, CA, ASSESSOR PARCEL NUMBER 8360-030-029; and Authorize the City Engineer to sign the Lot Merger LM10-2023 on behalf of the City of Pomona.

EXECUTIVE SUMMARY:

Gary Andreasen, with Andreasen Engineering, Inc., submitted the proposed lot merger application for the adjoining real properties located at 1400 W. McKinley Avenue, and associated with Assessor Parcel Number (APN) 8360-030-029, on behalf of Thomas Joris Lee, landowner. Approval of Resolution No. 2023-197 (Attachment No. 1) will consolidate two legal lots into one parcel, eliminate the legal property line located under an existing building, and facilitate the future upgrades of the residential parcel. City Council approval of a lot merger and/or a lot line adjustment is required if the lot merger and/or lot line adjustment have not been previously considered by the Planning Commission as part of a development project.

FISCAL IMPACT:

No fiscal impact at this time.

ENVIRONMENTAL IMPACT:

Pursuant to the California Code of Regulations, Title 14, Guidelines for the Implementation of the California Environmental Quality Act (CEQA), Section 15061, the proposed lot merger is categorically exempt from the requirement for the preparation of environmental documents in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment.

DISCUSSION:

The real property addressed as 1400 W. McKinley Avenue, APN 8360-030-029, is a 31,843 square-foot residential parcel consisting of Lots 30 and 31 of Tract No. 8147, recorded in Book 121, Pages 76 and 77 of Maps, in the Los Angeles County Recorder’s Office. Having the same land use and land ownership, these two lots have been issued one APN by the Los Angeles County Office of the Assessor. The property is developed as a single-family residential unit.

Gary Andreasen with Andreasen Engineering, Inc., applicant, submitted the proposed lot merger for the adjoining real properties associated with APN 8360-030-029, on behalf of the property owner. The proposed lot merger LM10-2023 consists of the consolidation of two legal lots into one parcel, for the purpose of eliminating the legal lot line crossing under the existing residential structure and facilitate future property upgrades (Attachments No. 2 and 3).

Lot Merger LM10-2023 has been submitted to the Public Works Department Engineering Division in accordance with Section 66499.20.3 of the California Government Code (Subdivision Map Act) and Section 29-50 (b) of the 1959 Pomona City Code as currently adopted by reference under Chapter 78-1. In accordance with Pomona City Code, lot mergers requested by the owner of contiguous parcels that have not been previously considered by the Planning Commission shall be submitted to the City Council for approval.

The proposed lot merger is in conformance with the City's General Plan and the City’s Zoning Ordinance. This action will consolidate two lots into one parcel as described in Exhibit “A” and depicted in Exhibit “B” to Exhibit “1” of Attachment No. 1.

The approval and adoption of the Resolution will allow the recording of the proposed lot merger, as requested by the property owners.
