Approval of the attached resolutions (Attachments 1, 2, and 3) will implement similar terms and conditions of employment for unrepresented employee groups as were recently negotiated with the Pomona Mid-Management/Confidential Employee Association (PMMCEA) for the period of October 1, 2023 through September 30, 2027. Said terms and conditions are described herein. Additionally, approval of the attached resolutions (Attachment 4 and 5) will amend the Citywide salary schedule for FY 2023-24 to reflect the changes proposed herein and amend the FY 2023-24 Operating Budget to account for salary increases as a result of the modified benefits FISCAL IMPACT:

The estimated ongoing incremental annualized cost for the amended compensation plans for Executive Group A and B employees and C-2 employees combined is $400k for the first year of the agreement and $1M in total for the second, third and fourth years of the agreement. Of these amounts, $253k is from the General Fund for the first year of the agreement. A budget amendment (Attachment No. 5) is included with this action to appropriate $253k from the General Fund and $147k from the respective Non-General Funds. Future costs for this agreement will be budgeted for in the appropriate fiscal year. The Part-Time Management/Confidential (PTMC) positions will have an impact of $79k in the General Fund and $10k to Non-General Fund Departments and these increases will be covered with current fiscal year appropriations.

DISCUSSION:

Approval of this action will update the compensation plans for the unrepresented Executive Group A and B employees, Mid-Management Library Group C-2 employees, and Part-Time Management/Confidential employees. Executive Group A employees include the City Manager, City Clerk, Assistant City Managers, and Department Heads. Group B employees include Division Managers and other high-level staff positions such as the Budget Officer. Benefits for the Mayor and City Council Members are also covered by the Executive Group A and B Plan. Group C-2 Employees include “Part-time Benefited” mid-management Library Employees (PBLE), which currently includes one authorized position of Library Supervisor. Part-Time Management/Confidential Group (PTMC) includes approximately 15 part-time employees who act in a managerial or supervisory capacity such as Library Operations Manager, or employees who may be assigned to the City Manager or Human Resources Department because of their access to confidential employer-employee relations information. The terms and conditions for unrepresented employees are included in Compensation Plans and may be modified by the City Council at any time. The proposed plans implement similar terms and conditions to the applicable represented groups and are intended to cover the period of October 1, 2023 through September 30, 2027.

Executive Group A and B, Mid-Management Library C-2, and Part-Time Management/ Confidential Employees All terms described in this section will apply to the City Manager except those related to the percentage salary increase. All terms described below will apply to the City Clerk. The City Council receives the same Cafeteria Plan contributions as Executive employees, therefore the Cafeteria Plan provisions will apply to the Mayor and City Council Members.

The key terms for Part-Time Management/Confidential employees are as follows:

Salary Increase – 7% salary increase effective October 8, 2023, 4% increase effective October 1, 2024 and 2025, and 5% increase effective October 1, 2026.

The key terms for Executive Group A and B, and Mid-Management Library C-2 employees are as follows:

Salary Increase – 7% salary increase effective October 8, 2023, 4% increase effective October 1, 2024 and 2025, and 5% increase effective October 1, 2026 for non-sworn employees, including the City Clerk. The Police Chief and Deputy Police Chief are a subset of Group A-3, their salary and benefits typically mirror those of the Pomona Police Management Group.

Medical Premiums and Section 125 Cafeteria Plan Contributions – The Cafeteria Plan contribution for Single coverage will increase by $100 per month in December 2023 and by $20 in each December of this contract. The Cafeteria Plan contribution for Two-Party coverage will increase by $250 in December 2023 and by $100 in each December of this contract. The Cafeteria Plan contributions for Family coverage will increase by $350 in December 2023 and by $200 in each December of this contract. Said increases will help offset the increasing costs of medical premiums, while still reducing the employee contribution toward Two-Party or Family coverage for most plans. Effective the first paycheck in December 2024, any balance from the City’s contribution not used toward health, dental or vision premiums shall remain with the City and will not be provided to the employee as taxable cash. Should other bargaining units receive a higher increase to their Section 125 Plan, then PMMCEA shall receive the equivalent increase provided to the other bargaining unit.

Deferred Compensation – CalPERS PEPRA members shall receive a City contribution to deferred compensation of $25 per month effective January 2024, if that employee also contributes a minimum of $25 per month toward deferred compensation.

Short Term Disability – Effective January 1, 2024, the waiting period on the City’s Short Term Disability Plan shall be reduced from sixty (60) calendar days to thirty (30) calendar days.

Industrial Injury/Illness - Effective January 01, 2024, the employee will be entitled to receive full pay for up to 30 calendar days instead of 60 working days.

Bilingual Pay – Effective November 19, 2023, for Group C-2 Library employees, the bilingual pay shall increase by $25 per month. Group A and B employees are not eligible to receive bilingual pay.

Paid Parental Leave - Effective January 2024, the City shall provide Paid Parental Leave up to 80 hours per year for the birth, adoption, or foster placement of a child for employees who meet the specified criteria as outline in the MOU.

Tuition Reimbursement – Eligible employees will be reimbursed an amount not to exceed $3,500 in any one fiscal year for college or university courses, as outlined in the MOU, in conjunction with a three-year retention commitment.

Classification & Compensation (Class & Comp) Study – During the term of this Agreement (October 1, 2023 through September 30, 2027), the parties agree to meet and confer on the cities to be surveyed for the current Class & Comp Study that is underway. Additionally, the parties will meet and confer regarding the impacts of the City’s implementation of the results and recommendations from the Study.

In addition, other minor language changes are being made as follows: eliminate classification titles no longer needed; and delete obsolete language. The complete Compensation Plans are included as exhibits in Attachments 1, 2, and 3 and show all of the language changes, with new language underlined and old language shown with strikethroughs.

Citywide Salary Schedule
California Code of Regulations (“CCR”) Section 570.5 and amendments to 571(b) require a consolidated Salary Schedule be publicly available which shows all City classifications and salary ranges for purposes of determining eligible salary compensation for retirement. The consolidated salary schedule must be adopted by the City Council even though the compensation changes for each bargaining unit and unrepresented group were previously approved by the City Council. Attachment 4 includes the resolution and Citywide salary schedule that reflects the salary changes approved herein, along with salary increases approved on October 2, 2023 concurrent with this item as a result of labor negotiations.

This action includes compensation changes for key executive employees. Pursuant to State law, approval of compensation changes for key executive employees must be accompanied by a verbal report; hence this item is being placed on the Discussion calendar for consideration.
