Gutierrez, Assistant City Manager/Development Services Director SUBJECT: SECOND READING AND ADOPTION OF AN ORDINANCE AMENDING THE POMONA MUNICIPAL CODE RELATING TO ENHANCEMENT OF ENFORCEMENT OPTIONS TO ADDRESS PUBLIC NUISANCE CONDITIONS AND ILLEGAL USES OF PROPERTY WITHOUT REQUIRED APPROVALS AND PERMITS RECOMMENDATION:
It is recommended that the City Council adopt at second reading:
ORDINANCE NO. 4341 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING SECTION 50-337 TO ARTICLE III, CHAPTER 50, ADDING SECTION 74-198 AND 74-199 TO ARTICLE III, CHAPTER 74 OF THE POMONA MUNICIPAL CODE RELATING TO ENHANCEMENT OF ENFORCEMENT OPTIONS TO ADDRESS PUBLIC NUISANCE CONDITIONS AND ILLEGAL USES OF PROPERTY WITHOUT REQUIRED APPROVALS AND PERMITS EXECUTIVE SUMMARY:
The proposed Ordinance, which amends Section 50-337 to Article III, Chapter 50, adds Section 74-198 and 74-199 to Article III, Chapter 74 of the Pomona Municipal Code, addresses a pressing need to enhance our enforcement capabilities regarding public nuisance conditions and illegal property uses within the City of Pomona. This ordinance is essential in mitigating the adverse impacts that unpermitted and illegal property uses have on public safety, welfare, and the overall quality of life in our community. The urgency of this matter is clear, as such conditions have led to violent altercations, public nuisances, and damage to both public and private property, necessitating immediate action.
FISCAL IMPACT:
No Fiscal Impact at this time
DISCUSSION:
The adoption of the Ordinance is necessitated by several key factors. The City has been inundated with complaints concerning illegal uses of property, which often result in dangerous conditions that threaten public safety. This results in calls for service related to these illegal property uses, placing additional strain on law enforcement, code enforcement and overall city resources.
Existing enforcement mechanisms have proven insufficient in addressing certain ongoing illegal uses of property. Enhanced enforcement options are imperative to discourage these activities and protect the health, safety, and welfare of our community.
By enacting this Ordinance, the City Council will empower our local authorities to more effectively address public nuisance conditions and illegal property uses, thereby enhancing the well-being of our citizens and the overall livability of Pomona. It is crucial for the City Council to consider and pass these ordinances promptly to tackle these pressing issues.
