CITY OF POMONA

COUNCIL REPORT
November 20, 2023
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Michael Ellis, Chief of Police
SUBJECT: AMEND FISCAL YEAR 2023-24 OPERATING BUDGET FOR THE ASSET FORFEITURE FUND AND APPROVE THE PURCHASE OF A LENCO BEARCAT ARMORED VEHICLE IN THE AMOUNT OF $376,731 RECOMMENDATION:

It is recommended that the City Council take the following actions:

Adopt the following resolution:

RESOLUTION NO. 2023-217 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA AMENDING FISCAL YEAR (FY) 2023-24 ASSET FORFEITURE FUND BY APPROPRIATING $376,731 FROM FUND RESERVES Approve the purchase of a Lenco BearCat Armored Vehicle in the amount of $376,731 utilizing the Houston-Galveston Area Council (H-GAC) cooperative purchasing contract #AM10-23 EXECUTIVE SUMMARY:

This action will authorize the purchase of a Lenco BearCat Armored Vehicle for the Pomona Police Department replacing a 30-year-old armored vehicle that has become unreliable with constant mechanical issues typical of an older vehicle.

FISCAL IMPACT:

The adoption of Resolution No. 2023-217 will increase appropriations from the Asset Forfeiture fund in the amount of $376,731 for the purchase of a Lenco BearCat Armored Vehicle. Department of Justice fund in the amount of $304,000 (260-2090-66182-51207) and Treasury Funds in the amount of $72,731 (260-2090-66182-51209) are available within the fund’s reserve.

DISCUSSION:

The Police Department currently utilizes a 1993 Ford F700 armored vehicle when responding to incidents involving armed persons, high-risk search warrants, and other critical incidents. The 1993 Ford F700 is now 30 years old, and it has become unreliable with constant mechanical issues typical of an older vehicle. This has prompted the need for its replacement with this purchase. Having reliable armored vehicles is a key component of the police department’s ability to de-escalate situations and conclude them without the use of force. The vehicle provides bullet-resistant protection and an increased level of safety for members of the police department and the public.

The recommended action will authorize the purchase of a Lenco BearCat Armored Vehicle by utilizing H-GAC cooperative purchasing contract #AM10-23. The Purchasing Division has reviewed the procurement process conducted by H-GAC cooperative purchasing contract #AM10 – 23 and determined that the process meets the City of Pomona’s requirement for utilizing cooperative agreements. City Code Sec. 2-997- Cooperative Purchasing, authorizes the Procurement Officer to recommend a cooperative or “piggyback” purchase on an awarded contract for services or equipment, entered into by other governmental agencies.

The City adopted a revised Vehicle Replacement Policy and Procedure on April 4, 2016, establishing criteria to justify the purchase of replacement vehicles citywide. Currently, there is one (1) armored vehicle used by the Police Department that meets the required criteria for replacement as listed below:

The vehicles have reached the end of their useful life, which is eight (8) years; or Vehicle mileage reaches and/or exceeds 100,000 miles; or When vehicle maintenance costs become inefficient due to age-related factors, including parts availability, emission control, and mechanic hours.

The following table contains the proposed replacement vehicle information:

Fleet Unit No.

Vehicle Type
Criteria for Replacement
20524
1993 Ford F700 Armored Truck
The vehicles have reached the end of their useful life, which is eight (8) years; vehicle maintenance costs have become inefficient due to age-related factors, including parts availability, emission control, and mechanic hours.

The Armored Vehicle scheduled for replacement meets the City’s Vehicle Replacement Policy standards. Approval for replacing this police vehicle will benefit the community by increasing Police Department’s response to critical incidents.

COUNCIL PRIORITIES & GOALS: This item supports the 2021-2022 City Council Priority 1: Fiscal and Operational Responsibility – Goal B: Improve efficiency and effectiveness of City services to businesses and residents.
