CITY OF POMONA

COUNCIL REPORT
December 11, 2023
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Rene Guerrero, Public Works Director
SUBJECT: CONSIDERATION OF PREFERENTIAL PARKING DISTRICT ON HARTFORD PLACE RECOMMENDATION:

It is recommended that the City Council take one of two actions:

Schedule a public hearing for a future City Council meeting to consider the request to establish a preferential parking district on Hartford Place; or Deny the request.

EXECUTIVE SUMMARY:

A petition has been submitted to the City requesting the establishment of a preferential parking district on Hartford Place, a cul-de-sac consisting of four homes in District 1. This action provides the City Council with an opportunity to determine whether a public hearing should be scheduled to consider the establishment of a preferential parking district on Harford Place.

FISCAL IMPACT:

No fiscal impact at this time.

DISCUSSION:

The Hartford Place residents submitted a petition requesting the establishment of a preferential parking district on Hartford Place. Hartford Place, classified as a local street, is a cul-de-sac that intersects Orange Grove Avenue, just west of Lewis Street, and provides access to four (4) residential properties. Residents on Hartford Place have observed the drivers of four to five cars consistently parking on Hartford Place that gain rear access to a residential property at 927 Lewis Street. The property at 927 Lewis Street has both a single-family home and a separate Accessory Dwelling Unit (ADU) in the rear yard, and the property owner has added a rear gate for direct pedestrian access to their backyard from Hartford Place. Concurrently, residents also recently provided photos of a large commercial box truck parked on the driveway at 927 Lewis Street preventing vehicles from parking on the driveway. Code Enforcement is investigating the site for potential code violations regarding the parking of the large commercial box truck.

Engineering Staff evaluated Hartford Place for any on-street parking shortages. The four residential properties on Hartford Place appear to have adequate space to park at least two vehicles on the existing driveways and two vehicles in garages. Being a relatively short cul-de-sac, Hartford Place has approximately 8-10 on-street parking spaces. Orange Grove Avenue has available on-street parking for any overflow demands. As such, City Staff did not find an overwhelming shortage of reasonably available and convenient parking for residents on Hartford Place. Establishing a preferential parking district without proper findings may lead to an undesirable outcome and potential neighbor disputes.

State Law generally restricts local agencies from requiring parking spaces for ADUs. Further, consistent with State law, City Ordinance No. 4340, adopted in December 2023, Section 11 states no parking (onsite) is required for any ADU. For example, a homeowner with a one-car garage can convert the garage into an ADU without having to replace the displaced one-car space, or providing any new parking spaces for the ADU conversion.
