CITY OF POMONA

COUNCIL REPORT
February 26, 2024
To: Honorable Mayor and Members of the City Council
From: Anita D. Gutierrez, City Manager
Submitted By: Rene Guerrero, Public Works Director
SUBJECT: APPROVAL OF LOT MERGER LM9-2023 FOR THE PROPERTY LOCATED AT 1518 ARROYO AVENUE, POMONA, CA, ASSESSOR PARCEL NUMBERS 8355-021-035 & -036, RELATED TO THE FUTURE DEVELOPMENT OF A RESIDENTIAL PROPERTY (COUNCIL DISTRICT 1) RECOMMENDATION:

It is recommended that the City Council take the following actions:

Adopt the following resolution:

RESOLUTION NO. 2024-22 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, APPROVING LOT MERGER LM9-2023 FOR THE PROPERTY LOCATED AT 1518 ARROYO AVENUE, ASSESSOR PARCEL NUMBERS 8355-021-035 & -036; and Authorize the City Engineer to sign the Lot Merger LM9-2023 on behalf of the City of Pomona.

EXECUTIVE SUMMARY:

Ernesto Arellano with Arroyo Holdings, LLC, landowner, submitted the proposed lot merger application of the adjoining real properties located at 1518 Arroyo Avenue, Assessor Parcel Numbers (APNs) 8355-021-035 & -036. Adoption of Resolution No. 2024-22 (Attachment No. 1) will consolidate two legal lots into one parcel to facilitate the future development of a residential property. City Council approval of a lot merger is required if the lot merger was not previously considered by the Planning Commission as part of a development project.

FISCAL IMPACT:

No fiscal impact at this time.

ENVIRONMENTAL IMPACT:

Pursuant to the California Code of Regulations, Title 14, Guidelines for the Implementation of the California Environmental Quality Act (CEQA), Section 15061, the proposed lot merger is categorically exempt from the requirement for the preparation of environmental documents in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment.

DISCUSSION:

The real property addressed as 1518 Arroyo Avenue (APNs 8355-021-035 & -036), is an approximately 1.08-acre, two-parcel residential property, consisting of portions of Lot 29 of J.E. Packard’s Orange Grove Tract, recorded in Book 29, Page 84 of Miscellaneous Records, in the Los Angeles County Recorder’s Office. These two parcels are located on the south side of Arroyo Avenue, between Dudley Street and Cambrin Road. The parcel designated with APN 8355-021-036 has a total area of 0.21 acres, and is developed with a 1,420 square-foot single-family residence and a detached, 730 square-foot accessory dwelling unit. The parcel associated with APN 8355-021-035 has an area of 0.87 acres and is currently undeveloped (Attachment Nos. 2 and 3). Vehicular access to the parcels is available via two driveway approaches located on Arroyo Avenue.

In October 2023, a Development Plan Review (DPR) application was submitted to the Pomona Planning Division for a 15-unit residential apartment project. The design concept includes a cluster of 2- and 5-unit buildings, 2-1/2 stories in height, with 1,400 square feet of living space per unit. Each unit will have two bedrooms and two bathrooms, a loft and a 2-car garage. Guest parking and landscaping improvements will be provided on site. The DPR application is currently under review by City staff. The DPR approval is contingent on the property being at least 1-acre in size. So as part of the new project application and in anticipation of its approval by the Planning Division, the landowner submitted a lot merger application to the Public Works Engineering Division to consolidate the aforementioned two lots into one parcel totaling more than 1 acre.

Lot Merger LM9-2023 is submitted in accordance with Section 66499.20.3 of the California Government Code (Subdivision Map Act) and Section 29-50(b) of the 1959 Pomona City Code as currently adopted by reference under Chapter 78-1. In accordance with the Pomona City Code, lot mergers requested by the owner of contiguous parcels that have not been previously considered by the Planning Commission shall be submitted to the City Council for approval.

The proposed lot merger is in conformance with the City's General Plan and the City’s Zoning Ordinance. This action will merge two adjoining lots designated by APNs 8355-021-035 & -036 into one lot, as described in EXHIBIT “A” and shown on the map depicted by EXHIBIT “B” to EXHIBIT 1 of Attachment No. 1.

The approval and adoption of the Resolution will allow the recording of the proposed lot merger and will enable the landowner to obtain the DPR acceptance for the proposed multi-family development project.
