RESOLUTION NO. 2024-49
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA AUTHORIZING DAVID TAUSSIG AND ASSOCIATES, INC., D/B/A DTA, AS THE ENGINEER OF RECORD FOR FISCAL YEAR 2024-25 AND ORDERING THE PREPARATION OF THE 2024-25 ENGINEER’S REPORT FOR THE CONSOLIDATED CITYWIDE STREET LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT WHEREAS, the City Council of the City of Pomona, California, desires to initiate proceedings for the Annual Assessment Levy for the Consolidated Citywide Street Lighting and Landscaping Maintenance District pursuant to the terms and provisions of the “Landscaping and Street Lighting Act of 1972,” being Division 15, Part 2 of the Streets and Highways Code of the State of California, in what is known and designated as City of Pomona’s Consolidated Citywide Street Lighting and Landscaping Maintenance District (hereinafter referred to as the “District”); and WHEREAS, through an informal bid process, David Taussig and Associates, Inc. d/b/a DTA (DTA) was selected and recommended to serve as the Engineer of Record; and WHEREAS, the City Council has declared DTA to be the City’s Engineer of Record for the Fiscal Year 2024-25 proceedings; and WHEREAS, the proceedings for the Annual Levy of Assessments shall relate to the Fiscal Year commencing July 1, 2024 and ending June 30, 2025; and WHEREAS, DTA will prepare the Engineer’s Report for the Assessments to be levied and shall consist of the following:
Plans and specifications for the improvements (and maintenance); An estimate of the costs of the improvements (and maintenance); A diagram for the Assessment Districts and any zone boundaries; and An assessment of the estimated costs of the improvements (and maintenance).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. That the above recitals are true and correct.
SECTION 2. That the proposed financial and service level alternative and maintenance work within the area proposed to be assessed shall be for certain street lighting, landscaping improvements, and maintenance work as set forth in the Annual Engineer's Report to be presented to this City Council for consideration.
SECTION 3. That pursuant to Streets and Highway Code Section 22622, DTA is hereby authorized to prepare and file with the City Clerk, an Engineer’s Report relating to said Annual Assessment and Levy (Fiscal Year 2024-25) in accordance with the provisions of Article IV, commencing with Section 22565 of Chapter 1 of the Streets and Highway Code of the State of California, for submission to the City Council.
SECTION 4. That the City Clerk shall attest and certify to the passage and Adoption of this Resolution and it shall become effective immediately upon its approval.
