Deconcentration and Other Policies that Govern Eligibility, Selection and Admissions The Housing Choice Voucher’s waiting list local preferences for admission are as follows, with families of veterans or current members of the armed forces receiving priority in each category:
Homeless preferences: Individual applicants or applicant families that verifiably lack housing, including one whose primary residence during the night is a supervised public or private facility that provides temporary living accommodations; an individual who is a resident in transitional housing; or an individual who has a primary residence a public or private place not designed for, or ordinarily used as, a regular sleeping accommodation for human beings as confirmed by the applicant’s local homeless service organization or consortia of organizations.
Limited Preference for Non-Elderly Disabled Homeless Individuals and/or Families: The PHA has set aside Mainstream vouchers targeted for this population. Individuals and/or families that meet the Mainstream definition of Homeless as defined in the glossary under Homeless-Mainstream as confirmed by the applicant’s local homeless service organization or consortia of organizations or the PHA’s Mainstream program partners. Residency preferences for families who currently live, are employed or are enrolled in an educational program or are attending school in the City of Pomona.
Rent Determination
In the November 2016 Small Area Fair Market Rent (SAFMR) Rulemaking, HUD identified 24 metropolitan areas where the use of Small Area FMRs is required in the administration of the Housing Choice Voucher (HCV) program. HUD identified an additional 41 metropolitan areas to begin using SAFMR in 2024. The City of Pomona was identified as one of the Cities within the metropolitan areas required to implement SAFMRs. The PHA plans to implement SAFMRs in the upcoming year beginning January 1, 2025 and used to establish payment standards used to calculate rent subsidies.
Significant Amendment/Modifications
Below are the proposed significant policy changes for the HCV tenant-based rental assistance programs. These policy changes are being implemented as a result of the Housing Opportunity Through Modernization Act of 2016 (HOTMA) and the National Standards for the Physical Inspection of Real Estate (NSPIRE) and incorporated in the Administrative Plan. In addition, the term human trafficking with Violence Against Women Act (VAWA) language, in addition to other VAWA clarifications such as the implementation Guidance for VAWA 2022 published in the Federal Register on January 4, 2023 were incorporated throughout to better align with current guidelines.
Chapter 1- Overview of the Program and Plan: Added information on the Housing Opportunity through Modernization Act (HOTMA) to the Overview and History of the Program section. Revised the list of owner responsibilities to account for NSPIRE.
Chapter 3- Eligibility: Revised various areas of the chapter to account for HOTMA changes, including the Final Rule issued February 14, 2023, Notice PIH 2023-27, and other sources of HUD guidance on the topic. This includes a new section on Restriction on Assistance Based on Assets.
Chapter 5 – Briefings and Family Obligations: Revised family obligations to account for NSPIRE.
Chapter 6 – Income and Subsidy Determinations: This chapter was completely rewritten from the ground up to account for HOTMA changes, including the Final Rule issued February 14, 2023, Notice PIH 2023-27, and other sources of HUD guidance on the topic. Included also are changes regarding exceptions to utility allowances as a reasonable accommodation.
Chapter 7 – Verification: As with Chapter 6, the bulk of this chapter had to undergo a complete rewrite for HOTMA. Many of the changes were required due to updates in verification requirements outlined in Notice PIH 2023-27.
Chapter 8 – Housing Quality Standards and Rent Reasonableness Determinations: This chapter only contains a minor policy adjustment to the Inspection Results section to disallow self- certification of repairs and contains extensive rewrites to update for NSPIRE requirements.
Chapter 9 – General Leasing Policies: Additions and updates to citations for NSPIRE Chapter 10 – Moving with Continued Assistance and Portability: Removed references to Housing Quality Standards and removed duplicative/conflicting policy information regarding voucher extensions and expiration. Clarified policy regarding sending documentation to the receiving PHA.
Chapter 11 – Reexaminations - As with Chapters 6 and 7, the bulk of this chapter had to undergo a complete rewrite to account for HOTMA, including the Final Rule issued February 14, 2023, Notice PIH 2023-27, and other sources of HUD guidance on the topic. Removed references to HQS and updated for NSPIRE. Updated policy language to mirror language elsewhere in the admin plan.
Chapter 12 – Termination of Assistance and Tenancy: Revised the policy that the PHA will terminate assistance if the family has been evicted from federally assisted housing in the last five years to reduce the number of years to three. Updated Exhibit 12-1, Statement of Family Obligations, with NSPIRE language Chapter 13 – Owners: Removed references to HQS and updated for NSPIRE.
Chapter 14 – Program Integrity: Added a new subsection and accompanying policy on De Minimis Errors, plus a minor clarification to account for HOTMA changes, including the Final Rule issued February 14, 2023, Notice PIH 2023-27, and other sources of HUD guidance on the topic. Removed references to HQS and updated for NSPIRE.
Chapter 15 – Special Housing Types: Reworked Chapter 15 to include the policies by default rather than directing to the guide. Policies are now included where relevant in the event that the PHA grants use of a special housing type as needed as a reasonable accommodation. Multiple updates to account for NSPIRE’s effect on various special housing types.
Chapter 16 – Program Administration: Removed references to HQS and updated for NSPIRE.
Chapter 17 – Project- Based Vouchers: Made minor updates to account for the Federal Register notice issued March 3, 2023, on subsidy layering requirements. Added a minor clarification on asset limitation requirements to the section on Eligibility for PBV Assistance to account for HOTMA changes. Multiple updates throughout to account for NSPIRE’s effect on PBV program requirements.

The PHA is also maximizing funding eligibility by maintaining a 98% minimum lease up rate. The PHA maintains high customer satisfaction by responding to complaints within 24 hours. The PHA continues to improve its briefing procedures for program participants by providing the most updated information in compliance with HCV program regulations. The PHA continues to affirmatively further fair housing by ensuring access to assisted housing regardless of race, color, religion, national origin, sex, familial status, and disability by conducting annual workshops for participants and prospective owners within the PHA’s jurisdiction.
