A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AWARDING AN ADDITIONAL $800,000 OF YEAR 2021 PLHA FUNDS TO THE NATIONAL COMMUNITY RENAISSANCE OF CALIFORNIA (NATIONAL CORE) FOR THE PRISMA ARTIST LOFTS HOUSING PROJECT AND DELEGATING PLHA FUNDS AWARDED TO THE PROJECT TOTALING $1,431,000 TO THE SAN GABRIEL VALLEY REGIONAL HOUSING TRUST WHEREAS, the Department is authorized to provide up to $296 million under the SB 2 Permanent Local Housing Allocation Program Formula Component from the Building Homes and Jobs Trust Fund for assistance to Cities and Counties (as described in Health and Safety Code section 50470 et seq. (Chapter 364, Statutes of 2017 (SB 2)); WHEREAS, the State of California (the “State”), Department of Housing and Community Development (“Department”) issued a Notice of Funding Availability (“NOFA”) dated 12/29/2023 under the Permanent Local Housing Allocation (PLHA) Program; WHEREAS, on February 27, 2023, the City Council approved an award of $631,000 to the National Community Renaissance of California (National CORE) as contribution for the construction of the Prisma Artist Lofts Housing Project; WHEREAS, National CORE requested additional funding from the City of Pomona for the project, along with its TCAC application; WHEREAS, the San Gabriel Valley Regional Housing Trust is an entity to whom the City of Pomona, an eligible Local Government, may delegate a portion of its PLHA formula allocation; WHEREAS, the Department may approve funding allocations for PLHA Program, subject to the terms and conditions of the Guidelines, NOFA, Program requirements, the Standard Agreement and other contracts between the Department and PLHA grant recipients; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. The City Council hereby approves additional funding of $800,000 in 2021 Permanent Local Housing Allocation Program funds to the National Community Renaissance of California (National CORE) for the Prisma Artist Lofts Housing Project.
SECTION 2. The City of Pomona hereby authorizes the San Gabriel Valley Regional Housing Trust (SGVRHT), on behalf of the City of Pomona, to receive a portion of PLHA grant funds from the Department pursuant to the above referenced PLHA NOFA. It will represent and certify that it will use all such funds in a manner consistent and in compliance with all applicable state and federal statutes, rules, regulations and laws, including without limitation all rules and laws regarding the PLHA Program, as well as any and all contracts the City of Pomona may have with the Department.
SECTION 3. The San Gabriel Valley Regional Housing Trust, on behalf of the City of Pomona, is hereby authorized and directed to receive a portion of the City of Pomona’s 2020 and 2021 PLHA formula allocation in an amount not to exceed $631,000 and $800,000 respectively, in accordance with all applicable rules and law. These funds were approved by the Council for the Prisma Artist Lofts Housing Project. The remaining portion of all grant funds will be retained by the City of Pomona, as identified in Resolution No. 2024-45 adopted by the City Council on April 15, 2024.
SECTION 4. The City of Pomona certifies that it delegates the San Gabriel Valley Regional Housing Trust to submit an application on its behalf and administer the PLHA grant award for the formula allocation of PLHA funds, pursuant to Guidelines Section 300(c) and 300(d), and the legally binding agreement between the recipient of the PLHA funds and the City of Pomona is submitted with the PLHA application.
SECTION 5. The City Manager or her designee is authorized to execute any and all documents necessary which are related to the Program or the PLHA Grant awarded to the San Gabriel Valley Regional Housing Trust on behalf of the City of Pomona, as the Department may deem appropriate.
