To: Honorable Mayor and Members of the City Council
From: Anita D. Gutierrez, City Manager
Submitted By: Rene Guerrero, Public Works Director
SUBJECT: AMENDMENT TO PURCHASE ORDER WITH FIRST SERVE PRODUCTIONS, INC. FOR “PARK IMPROVEMENTS – SPORT

RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve Amendment No. 1 (Change Order No. 1) to Purchase Order (PO) No. 205413 with First Serve Productions, Inc., in the amount of $28,420, for a new total PO amount of $122,960 for additional pickleball equipment for “Park Improvements – Sport Court Resurfacing and Restriping,” Project No. 428-2590-XXXXX-71069; and Authorize the City Manager, or designee, to execute any amendments to the purchase order and related documents, on behalf of the City of Pomona (City), subject to City Attorney approval.

EXECUTIVE SUMMARY:

Approval of the recommended actions will allow staff to move unencumbered funds to PO No. 205413, executed on March 18, 2024 for “Park Improvements – Sport Court Resurfacing and Restriping,” Project No. 428-2590-XXXXX-71069 (Project), for the purchase of additional pickleball equipment (7 sets of Pickleball Posts and 7 Sets of T-Plugs) for the Project. The total amount of Amendment No. 1 exceeds 25% of the original contract amount and, therefore, requires City Council approval to execute.

PREVIOUS RELATED ACTION:

On October 16, 2023, the City Council adopted Resolution No. 2023-07 creating the Project and appropriating $95,000 of General Fund Youth Commitment Funding to the Project.

On March 18, 2024, the City Council adopted Resolution No. 2024-38, which added $30,000 of General Fund from Community Services hourly and gas and electricity savings to “Park Improvements – Sport Court Resurfacing and Restriping,” Project No. 428-2590-XXXXX-71069.

DISCUSSION:

On March 18, 2024, the City issued Purchase Order No. 205413 to First Serve Productions, Inc., in the amount of $94,540, for the resurfacing and restriping of the existing tennis courts located in Palomares Park to provide for both tennis and pickleball courts. However, subsequent to the issuance of the Purchase Order, the City received requests for additional sets of equipment (7 sets of Pickleball Posts and 7 Sets of T-Plugs) to be managed by the Community Services Department. This additional equipment request led to a 30% increase in the overall cost of the Purchase Order. As a result, the new total cost of Purchase Order No. 205413 will be $122,960, reflecting the adjusted amount due to the inclusion of the supplementary equipment.

COUNCIL PRIORITIES & GOALS:

This item supports Priority 4 Safe and Clean Community: Invest in public safety, community programming, and maintenance of properties and infrastructure to ensure residents, businesses, visitors, and employees feel safe, neighborhoods reflect the beauty of Pomona, and the community feels a sense of pride and ownership of the City.
