May 20, 2024
To: Honorable Mayor and Members of the City Council
From: Anita D. Gutierrez, City Manager
Submitted By: Rene Guerrero, Public Works Director
SUBJECT: RESOLUTION TO AMEND THE FY 2023-24 CAPITAL IMPROVEMENT PROGRAM (CIP) BUDGET BY CLOSING COMPLETED PROJECTS AND REAPPROPRIATING UNEXPENDED FUNDS RECOMMENDATION:

It is recommended that the City Council adopt the following resolution:

RESOLUTION NO. 2024-71 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, TO AMEND THE FY 2023-24 CAPITAL IMPROVEMENT PROGRAM (CIP) Budget by closing completed projects, releasing $522,733 OF UNEXPENDED FUNDS, Reappropriating $263,834 of those funds, and changing the title and description of “new emergency operations center – white avenue” to “fire station 182 improvements and new emergency operations center – white avenue,” project no. 428-2590-xxxxx-71068 EXECUTIVE SUMMARY:

City Council adoption of Resolution No. 2024-71 (Attachment No. 1) will close nine (9) CIP projects (8 that are completed, and 1 that will be canceled and moved into an existing project), and enable the release of unexpended funds and reappropriation of some funds to other projects as indicated in Exhibit A. In addition, it will change the title and description of “New Emergency Operations Center – White Avenue” to “Fire Station 182 Improvements and New Emergency Operations Center – White Avenue,” Project No. 428-2590-XXXXX-71068, as depicted in Attachment No. 2.

SB1439/GOVERNMENT CODE §84308 APPLICABILITY:
☐ When this box is checked, it indicates the agenda item is subject to the Levine Act SB1439 requirements.  Councilmembers are reminded to check their campaign contributions and determine whether they have received a campaign contribution of $250 or more that would require disclosure and/or recusal from discussing or acting on this agenda item.  Campaign contributions of $250 or more made 1) by any person or entity who is identified in the agenda report as the applicant or proposer or 2) on behalf of the applicant or participant, including a parent, subsidiary or otherwise related business entity, or 3) by any person who has a financial interest in the agenda item requires a councilmember to comply with SB1439.

FISCAL IMPACT:

The closing of nine (9) CIP projects will release a total of $522,733 of unexpended funds, as indicated in Table 1 below. The availability of these funds results from the projects being completed at a cost lower than originally estimated and/or with less use of contingency than was reasonably anticipated. As depicted in the table below, a portion of the released funds ($263,834) will be re-appropriated to various projects. The remaining funding will be returned to the funding source.

On June 5, 2023, the City Council approved Resolution No. 2023-98 adopting the FY 2023-24 Capital Improvement Program (CIP) Budget, which included all CIP projects listed in Table 1 above.

DISCUSSION:

Table 1 summarizes the closed and completed (or canceled) projects, and the remaining funding to be returned to their respective funding source or reappropriated to other projects. As previously stated, the availability of these funds is a result of the projects being completed at a cost lower than originally estimated and/or with less use of contingency than was reasonably anticipated. The Gas Tax funding in “ADA Improvements of Public Facilities and Parks Citywide,” Project No. 428-2590-XXXXX-71058 will be returned to fund balance as there has not been sufficient Gas Tax funding to add to this project in recent years, and Gas Tax is used for various City operational needs.

The SoCalRen funding is a loan that has to be paid back by the City, so it is necessary and beneficial to return the remaining funding. The D5 CIP Discretionary Funding in “Phillips Ranch Greenbelt Fence Replacement,” Project No. 428-2590-XXXXX-71086 will also be returned to fund balance available for future projects.

In addition, since “Fire – New Facility,” Project No. 418-2590-XXXXX-72060 is being combined with 428-2590-XXXXX-71068, the funding from “Fire – New Facility” will also move to 428-2590-XXXXX-71068, which was previously called “New Emergency Operations Center – White Avenue.” The project title will now change to “Fire Station 182 Improvements and New Emergency Operations Center – White Avenue.” The description of this project will also be modified to: “Construct improvements to Fire Station 182 to provide four vehicle bays to allow for the parking of vehicles for Battalion Chief, Paramedics, a ladder fire truck, and an additional fire truck, as needed. This project will also provide for the construction of a new City Emergency Operations Center adjacent to Fire Station 182.” COUNCIL PRIORITIES & GOALS:

This item supports City Council Priority 5, Goal P, to improve parks facilities by adding additional recreation and playground equipment.
