CITY OF POMONA

COUNCIL REPORT
July 15, 2024
To: Honorable Mayor and Members of the City Council
From: Anita Gutierrez, City Manager
Submitted By: Kirk Pelser, Economic Development Director SUBJECT: APROVAL OF RIGHT-OF-WAY SALES CONTRACTS TOTALLING $19,200 FOR CITY-OWNED PROPERTIES ASSOCIATED WITH THE STATE ROUTE 71 WIDENING PROJECT RECOMMENDATION:

It is recommended that the City Council approve Right-of-Way Contracts (Contracts) with the State of California Department of Transportation (DOT) and authorize the City Manager to execute the contracts and all related amendments, subject to approval as to form by the City Attorney.

EXECUTIVE SUMMARY:

The State of California Department of Transportation (DOT) continues to work on completion of the widening project for State Route 71 (SR-71). To accommodate the widening project, the DOT requires a few additional modest portions of various City-owned parcels. Based upon the DOT’s appraisals and offers, the City would realize $19,200 from the sale of the needed interests, which are detailed below in the Background/ Discussion section of this report.

SB1439/GOVERNMENT CODE §84308 APPLICABILITY:
☐ When this box is checked, it indicates the agenda item is subject to the Levine Act SB1439 requirements.  Councilmembers are reminded to check their campaign contributions and determine whether they have received a campaign contribution of $250 or more that would require disclosure and/or recusal from discussing or acting on this agenda item.  Campaign contributions of $250 or more made 1) by any person or entity who is identified in the agenda report as the applicant or proposer or 2) on behalf of the applicant or participant, including a parent, subsidiary or otherwise related business entity, or 3) by any person who has a financial interest in the agenda item requires a councilmember to comply with SB1439.

FISCAL IMPACT:

As stipulated in the proposed Contracts, DOT will pay the City of Pomona $19,200 as just compensation for the various property interests they need and would be deposited into the City’s General Fund.

DISCUSSION:

The State of California Department of Transportation (DOT) is moving closer to completing the construction for the current phase of the project which encompasses widening from Rio Rancho to the Mission Bridge. The project is roughly 70% complete and substantial completion is expected by July 31, 2025. To accommodate the widening, the DOT requires a few additional modest portions of various City-owned parcels. Based upon the DOT’s appraisals and offers, the City would realize $19,200 from the sale of the needed interests that are detailed below:

APN 8708-011-902 & 8708-013-903
DOT # 82082-1& 82083-1
Interests Needed: 22,099 square foot Temporary Grading Easement Appraised Value: $18,700
APN 8343-016-900
DOT # 82081-1
Interested Needed: 24 square foot Temporary Construction Easement Appraised Value: $500
ENVIRONMENTAL ANALYSIS:

Sale of the property interests to DOT is exempt from the requirements of the California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines, as it is not a “project” and has no potential to result in a direct or reasonably foreseeable indirect physical change to the environment. DOT’s actual widening project will be subject to CEQA and any applicable Federal environmental guidelines.
