A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AUTHORIZING AND DIRECTING THE Los Angeles COUNTY Auditor-Controller TO INCLUDE DELINQUENT SOLID WASTE (TRASH) COLLECTION ACCOUNTS FROM ATHENS services AS A SPECIAL ASSESSMENT TO BE COLLECTED AT THE SAME TIME AND IN THE SAME MANNER AS COUNTY TAXES WHEREAS, the City Council adopted Ordinance No. 4331 providing for the collection of delinquent solid waste (trash) collection accounts in accordance with California Government Code Section 38790.01; and WHEREAS, as per Pomona Municipal Code Sections 62-722 and 62-676, the City’s franchise hauler, the designated entity for the collection of fees, shall be entitled to payment from the account holder for any trash collection services rendered; and WHEREAS, the City’s franchise hauler, shall maintain, and make available to the City, a list of Trash Collection Accounts by parcel number(s), any account holder, who as of May 1st of any given year, is delinquent; and WHEREAS, Pomona Municipal Code Section 62-724 authorizes the City to submit a list of Delinquent Trash Collection Accounts detailing amounts owed plus administrative charges to the Los Angeles County Auditor-Controller; and WHEREAS, a special assessment shall be placed on the FY 2024-25 tax rolls for every parcel with delinquent charges; and WHEREAS, the City of Pomona is requesting the County Auditor-Controller to collect the direct assessment in the same manner and times as County taxes; and WHEREAS, the City of Pomona directs the County Auditor-Controller to place the direct assessment charges onto the current tax roll.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. Adoption of Lien List of Delinquent Trash Collection Accounts. The list of delinquent trash collection fees filed in the City Clerk’s Office is here by approved.
SECTION 2. Effective Date. This Resolution shall become effective upon its adoption.
SECTION 3. Authorization. That the Director of Public Works, or his designee submit the list of Delinquent Trash Collection Account holders to the Los Angeles County Auditor-Controller for inclusion in FY 2024-25 property tax rolls.
SECTION 4. Authorization. That the Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Resolution.
