PUBLIC NOTICING REQUIREMENTS:

In accordance with Section 2-1003 - Formal Procedure of the City’s Purchasing Ordinance, a Notice Inviting Bids for construction for “Streetlights ‐ Citywide (CDBG) (FY 22‐23 to FY 24‐25),” Project No. 428-2590-XXXXX-64777 was posted on the City’s electronic bidding platform, PlanetBids, on May 22, 2024.

PREVIOUS RELATED ACTION:

On June 3, 2024, the City Council approved the FY 2024-25 CIP Budget that included an appropriation of $192,192 of Measure R funds to the Project.

On June 3, 2024, the City Council approved the distribution of CDBG funds for FY 2024-25, including $103,347 to the Project.

On July 15, 2024, the City Council adopted Resolution No. 2024-101 and intended to re-appropriate $73,000 of available General Funds and $17,775 of Measure R Funds to “Streetlights ‐ Citywide (CDBG) (FY 22‐23 to FY 24‐25),” Project No. 428-2590-XXXXX-64777. However, the attached Resolution document did not specify the funding type and included incorrect account codes for the transfers.

ENVIRONMENTAL IMPACT:

The Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c), in that it meets the guidelines for the implementation of CEQA because the Project consists of the operation, repair, and maintenance of existing facilities.

DISCUSSION:

Resolution No. 2024-101 was previously adopted by City Council on July 15, 2024 (Agenda Item No. 2). However, the Resolution contained incorrect account coding and did not specify the type of funding being unappropriated and appropriated. The corrected Resolution (Attachment No. 1) now shows the corrected funding types and account coding to be used when transferring funds.

On May 22, 2024, the City issued an Invitation for Bids (IFB) No. 2024-31 “Streetlights ‐ Citywide (CDBG) (FY 22‐23 to FY 24‐25),” Project No. 428-2590-XXXXX-64777 via the City’s electronic bidding platform, PlanetBids. The solicitation was disseminated to 57 potential bidders, with 51 of them downloading the IFB, resulting in the City receiving ten (10) proposals. Bids were due on June 13, 2024, with all ten (10) bidders meeting the minimum qualifications and evaluated based on their pricing proposal.

The apparent low bidder, Metrocell Construction, Inc., did not complete the Information Required of Bidders as required by the bid document; therefore, Metrocell Construction, Inc. is not a responsive bidder. California Professional Engineering, Inc. submitted the second lowest responsive and responsible bid for the work in the Base Bid amount of $377,225, as shown in the table below. This bid is lower than the Engineer’s Estimate for the base bid, and is recommended for award based on available funding.
