RESOLUTION NO. 2024-130
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH THE CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION FOR IMPLEMENTATION OF A LOCAL TRANSACTIONS AND USE TAX WHEREAS, On August 6, 2018, the City Council approved Ordinance No. 4253 amending the City Municipal Code and providing for a local transactions and use tax; and WHEREAS, On November 6, 2018, the voters of The City of Pomona voted to establish a 0.75% local transactions and use tax (TUT) with a 10-year sunset; and WHEREAS, during the March 5, 2024 Primary Election, the voters of The City of Pomona voted to continue the local TUT and remove the 10 year sunset; and WHEREAS, the California Department of Tax and Fee Administration (CDTFA) administers and collects the transactions and use taxes for all applicable jurisdictions within the state; and WHEREAS, the CDTFA will be responsible to administer and collect the transactions and use tax for the City; and WHEREAS, the CDTFA requires that the City enter into a “Preparatory Agreement” and an “Administration Agreement” prior to implementation of said taxes; and WHEREAS, the CDTFA requires that the City Council authorize the agreements; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. That the City Manager, or other officer or employee of the City designated in writing by the City Manager to the Department of Tax and Fee Administration (hereinafter referred to as Department), is hereby appointed to execute the “Preparatory Agreement” and “Administrative Agreement”.
SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force.
