COUNCIL REPORT
September 9, 2024

From: Anita D. Gutierrez, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVE AND EXECUTE TRANSFER AGREEMENT WITH THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT’S SAFE CLEAN WATER PROGRAM-MUNICIPAL PROGRAM (MEASURE W) PER THE TERMS AND CONDITIONS RECOMMENDATION:
It is recommended that the City Council take the following actions:
Approve Agreement No. 2024MP61 (Agreement) with the Los Angeles County Flood Control District (District) for the Safe Clean Water (SCW) program - Municipal Program (Measure W); and, Authorize the City Manager to execute the Agreement (Attachment No. 1) with the District for the transfer of SCW program - Municipal Program per the terms and conditions; and, any subsequent amendments contingent on City Attorneys review.
EXECUTIVE SUMMARY:
Staff is seeking City Council approval to renew a transfer agreement with District for the SCW Program (Attachment No. 1) allowing the annual receipt of Measure W Tax funds. Funds will be used for implementation, operations and maintenance, and administration of eligible SCW Program projects and programs.

FISCAL IMPACT:
Measure W collects approximately $1.87 million annually to Pomona in tax revenues. These funds are to be used for eligible projects that improve the quality and quantity of stormwater introduced into the groundwater basins within Los Angeles County. Funds are already included in the FY 2024-25 Operating Budget revenue projections as part of the Measure W Fund (142-8130-40904-0000).
PREVIOUS RELATED ACTION:
On August 3, 2020, City Council approved entering into the prior four-year transfer agreement with District.
DISCUSSION:
Measure W was approved by Los Angeles County voters in the November 2018, which collects approximately $1.87 million annually to the City. To ensure compliance with program guidelines, the City submits to District a funding plan detailing how the funds will be spent each year for the following four years. Once both parties have signed the transfer agreement, District disburses SCW funds each year for the term of the four-year transfer agreement.
In order to receive funding for the next four years, the attached transfer agreement needs to be executed by the City and submitted to District. Once fully executed, the City typically receives its portion of Measure W funding within 45 days.
Over the past three years, annual funding has helped cover the cost of the maintenance of storm drains, installation of full capture trash devices, construction of Hamilton Park water quality improvements, design and future construction of the Pedley Spreading Grounds, various landscape improvements throughout the City, stormwater capture on the San Jose Creek Bikeway, completion of a citywide stormwater Master plan, and stormwater improvements on Holt Avenue. As has been the case in prior years, staff will continue develop stormwater projects that provide the community with the benefits as promised within the Measure W goals and objectives.
