SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE AMENDING THE POMONA CITY CODE TO ADD SECTION 58-296 “COMMERCIAL VEHICLE ENFORCEMENT - ADMINISTRATIVE FINES” RELATING TO TRUCK ROUTE VIOLATIONS RECOMMENDATION:
It is recommended that the City Council adopt the following ordinance:
ORDINANCE NO. 4346 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING CHAPTER 58 (“TRAFFIC AND VEHICLES”), ARTICLE V (“VEHICLE SIZE, WEIGHT AND LOAD”), DIVISION 2 (“TRUCK ROUTES”) OF THE POMONA CITY CODE TO ADD SECTION 58-296 (“COMMERCIAL VEHICLE ENFORCEMENT - ADMINISTRATIVE FINES”) DISCUSSION:
This ordinance was first introduced at the September 9, 2024, City Council Meeting (Attachment No. 2). The purpose of this Ordinance No. 4346 (Attachment No. 1) is to impose administrative fines of one thousand dollars ($1,000) for each offense to the responsible party of a large commercial vehicle operating on City roadways or highways not designated as a “Truck Route”.
The ordinance will take effect 30 days after its adoption on September 16, 2024.
During the September 9th, 2024 City Council Meeting, the City Council inquired about appropriating a yet-undetermined amount of funds towards a Pedestrian Safety Fund that would be used to make capital improvements throughout the City. This will discussed during the annual Mid-Year Budget Review that will be forthcoming in March 2025.
FISCAL IMPACT:
If adopted, the City will see an increase in annual General Fund revenues related to the enforcement of truck route violations. Staff estimates revenues to be approximately $1,000,000 per fiscal year when this program is fully implemented. Revenue estimates for FY 2024-25 have been increased to $500,000 as part of the first reading of this ordinance since this program will start within the fiscal year.
