RESOLUTION NO. 2024-179
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF POMONA AND THE POMONA POLICE OFFICERS’ ASSOCIATION WHEREAS, on January 3, 2000, Mayor and City Council adopted Ordinance No. 3901, approving the contract amendment between the Board of Administration of CalPERS and the City of Pomona to extend the 9% EPMC Converted to Pay Rate During the Final Compensation Period for all sworn employees; WHEREAS, the California Code of Regulations, Section 566.1 states in part that contract amendments with CalPERS must be contained in applicable written agreements as well as in adopted resolutions; WHEREAS, on December 11, 2023, the Mayor and City Council adopted Resolution No. 2023-242, approving the Memorandum of Understanding (MOU) between the City of Pomona and the Pomona Police Officers’ Association effective September 1, 2023 through August 31, 2027; WHEREAS, City Council has the authority to approve and ratify a contract with the City’s employee associations.
WHEREAS, Article IV Compensation and Benefits, Section W. Retirement (4 and 7) needs to be amended for conformance to regulatory language for the CalPERS 9% EPMC Converted to Pay Rate During the Final Compensation Period benefit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona, California as follows:
SECTION 1. That the amended MOU between the City of Pomona and the PPOA, attached hereto as “Exhibit A”, shall be approved, ratified, and ordered implemented.
SECTION 2. That the City Manager of the City of Pomona is hereby authorized, empowered, and directed to enter into this Agreement for and on behalf of the City of Pomona.
SECTION 3. That the City Clerk is directed to attest the execution of the Memorandum of Understanding.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution, and it shall become effective immediately upon its adoption.
