A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING THE FY 2024-25 CAPITAL IMPROVEMENT PROGRAM (CIP) BUDGET BY RECEIVING, INCREASING REVENUE ESTIMATES, AND APPROPRIATING AN IN-LIEU PAYMENT OF $675,268 FROM POMONA VALLEY HOSPITAL MEDICAL CENTER TO “GAREY AVENUE REHABILITATION - ALISO STREET TO MONTEREY AVENUE,” PROJECT NO. 428-2590-XXXXX-68573 WHEREAS, the PVHMC Specific Plan Environmental Impact Report identified mitigation measure 4.12-6 to install a traffic signal at the intersection of Garey Avenue and the I-10 EB off-ramp; and WHEREAS, the City and PVHMC recognize the benefits and savings of installing the new traffic signal at the intersection of Garey Avenue and I-10 Eastbound Off-Ramp in conjunction with the City’s CIP project (“Garey Avenue Rehabilitation – Aliso Street to Monterey Avenue”) per the Pomona Valley Hospital Specific Plan recommendation to mitigate traffic impacts; and WHEREAS, the City and PVHMC have agreed to the attached cooperative agreement (Exhibit A); and WHEREAS, the PVHMC agrees to an in-lieu payment to the City in the amount of $675,268 that includes the sum of the construction cost of the traffic signal installation, a three percent (3%) fee to the City to manage and inspect, and a twenty-five percent (25%) contingency cost; and WHEREAS, the City agrees to accept the in-lieu fee from PVHMC to construct, manage, and inspect the installation of the traffic signal at the intersection of Garey Avenue and I-10 Eastbound Off-Ramp; and WHEREAS, the City desires to amend the FY 2024-25 CIP Budget by increasing revenue estimates and appropriating $675,268 the in-lieu payment from PVHMC to “Garey Avenue Rehabilitation – Aliso Street to Monterey Avenue,” Project No. 428-2590-XXXXX-68573.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. The City Council hereby approves the cooperative agreement (Exhibit A) with PVHMC.
SECTION 2. The City Council hereby authorizes the City Manager, or designee, to execute he cooperative agreement with PVHMC and any future amendments on behalf of the City and approval as to form by the City Attorney SECTION 3. The City Council amends the FY 2024-25 CIP Budget by receiving, increasing revenue estimates and appropriating $675,268 of in-lieu payment from PVHMC (428-2590-40915-68573 and 428-2590-66196-68573) to “Garey Avenue Rehabilitation – Aliso Street to Monterey Avenue,” Project No. 428-2590-XXXXX-68573.
SECTION 4. The City Clerk shall attest and certify to the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.
