FIRST AMENDMENT TO PUBLIC WORKS CONTRACT
This FIRST AMENDMENT to the Public Works Contract for construction improvements (“FIRST AMENDMENT”) is entered into on the 4th day of August, 2025 by and between the City of Pomona (the “CITY”) and Gentry Brothers, Inc., (“CONTRACTOR”), hereinafter referred to collectively as the “Parties.”
RECITALS
Whereas, on October 22, 2024, the Parties entered into a Contract for Construction Improvements with an initial Time for Completion of 100 Working Days for Base Bid Items and 120 Working Days for all Additive Alternate Items, if awarded, (the “CONTRACT”), of the CONTRACT Term.
Whereas, the Parties now wish to enter into this FIRST AMENDMENT in order to increase the CONTRACT price by $1,731,887, bringing the CONTRCT total from $8,308,748 to $10,040,634, pursuant to Section 3.1 of the CONTRACT.
Whereas, the Parties now desire to AMEND the CONTRACT Scope of Work to include items in Additive Alternate 3, pursuant to Section 15 Bid Line Items, of the CONTRACT.
AMENDMENTS
1. Incorporation of Recitals. The recitals listed above are true and correct and are hereby incorporated herein by this reference.
2. Time for Completion. The Time for Completion, Article 2 of the CONTRACT shall be extended to include a total of 220 Working Days, unless earlier terminated.
3. Contract Price . The Contract Price, Article 3.1 of the CONTRACT, is hereby amended in its entirety to read as follows:
” The City shall pay to the Contractor as full compensation for the performance of the Contract, subject to any additions or deductions as provided in the Contract Documents, and including all applicable taxes and costs, the sum of Ten Million, Forty Thousand, Six Hundred Thirty-Four Dollars and Thirty-Seven Cents ($10,040,634.37).”
4. All other terms and conditions of the AGREEMENT and any amendments thereto shall remain in full force and effect, except as otherwise stated in this Amendment.
Now, therefore, the Parties hereto have executed this FIRST AMENDMENT as of the date set forth below:
