RESOLUTION NO. 2025-80 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING THE FY 2025-26 CIP B UDGET BY INCREASING REVENUE ESTIMATES BY $800 AND APPROPRIATIONS BY A TOTAL OF $34,927: $800 FROM THE SOUTHERN CALIFORNIA GAS COMPANY RENT LEASE AND $34,127 FROM WATER FUND FUNDING TO THE “WATER RESOURCES BUILDING,” PROJECT NUMBER 575-8125-XXXXX-93135 Approve an amendment for $21,981 to the agreement with Dudek & Associates by increasing the contract amount from $233,370 to $255,351 for professional services rendered, and Authorize City Manager, to execute the amendment, subject to approval as to form by City Attorney, Attachment 2.

EXECUTIVE SUMMARY
Approval of the resolution will increase revenue for the Water Resources Building by $800 with funding from rent payment received by Southern California Gas Company (SoCal Gas). Approval of the additional appropriation will fund a contract amendment with Dudek & Associates to complete on site air quality testing and is expected to cost an additional $21,981, for a total contract amount of $255,351. Finally, additional funding is being requested to install improved sewer plumbing devices within the building to prevent sewer gases from backing up into the building. These devices are being replaced as there have been instances of a noticeable gas smell in the building. It is expected these devices will cost $20,150.

PREVIOUS RELATED ACTION:

On September 18, 2017, the City Council approved a settlement agreement with SoCal Gas and Southern California Edison for the clean-up of lamp black at the City’s Water Resources Department (WRD) administrative and operations yard and adopted Resolution No. 2017-18. On August 21, 2022, City Council awarded a design-build contract to Kemp Brothers for the construction of the Water Yard Building project. On October 17, 2022, City Council approved an amendment with Dudek for the design of a soil vapor barrier and the associated plans of the Water Resources Building project. On June 2, 2025, City Council adopted Resolution No. 2025-72 to approve the FY 2025-26 CIP Budget which included the Water Resources Building project in this report.

DISCUSSION:

As a result of legacy soil contamination and in an abundance of precaution, additional air and ground vapor testing has been performed for the WRD Building and was completed by Dudek. This additional testing was necessary to confirmed all engineered systems and the soil vapor barrier are performing in accordance with design parameters. To assist in the air quality sampling an amendment to the agreement was drafted adding the additional scope and associated compensation, of $21,981. Said agreement is attached herewith.

After the WRD Building was completed, it was discovered that sanitation plumbing devices used to prevent sewage smells from entering the building, are not performing at an acceptable level. To remedy this condition sewer automated P trap devices are needed and at a cost of $21,150.

As to the $800 of lease payments from SoCal Gas, these funds derive from lease payments paid to the City while SoCal Gas was onsite performing soil remediation from past operations on site, prior to the City owning the property. This item is returning Council as the payments are above what was originally approved, as the cleanup took slightly longer than anticipated.
