Re: Sole Source Confirmation and Proprietary Intellectual Property Statement – LifeArk Modular System Dear Mr. Montano,
This letter serves as formal confirmation that LifeArk is the sole designer and manufacturer of the LifeArk Modular System proposed for purchase by the City of Pomona.
The LifeArk Modular System is a proprietary system developed exclusively by LifeArk through significant investment in research, engineering, structural design, manufacturing methodology, and integrated systems development. The system incorporates proprietary architectural configurations, structural engineering specifications, fabrication processes, assembly sequencing, connection details, and integrated modular components that are unique to LifeArk.
All intellectual property associated with the LifeArk Modular System—including but not limited to design documents, technical drawings, specifications, structural calculations, fabrication techniques, assembly processes, system architecture, and related know-how—is owned exclusively by LifeArk and is protected under applicable intellectual property laws.
No other company manufactures, produces, or distributes the LifeArk Modular System. Due to its proprietary design, engineering integration, and fabrication methodology, the system cannot be replicated or substituted by another manufacturer without infringing upon LifeArk’s intellectual property or materially altering the system’s core specifications and performance characteristics.
Accordingly, LifeArk is the sole source provider of this modular system.
LifeArk respectfully provides this confirmation to support the City’s review and recommendation for sole-source procurement consideration by the City Council. Should the City require any additional documentation or clarification in support of this determination, please let me know.
