RESOLUTION NO. 2026-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, APPROVING A 35-YEAR LICENSE AGREEMENT WITH BLUEPATH SOLAR JCC POMONA LLC TO INSTALL ELECTRICAL CONDUITS ON WEST SEVENTH STREET WHEREAS, The City of Pomona has an easement on West Seventh Street for public street, road, highway and public utilities including but not limited to sanitary sewer, domestic water and storm drain purposes and all uses incidental thereto; WHEREAS, Bluepath Solar JCC Pomona LLC does not have a Certificate of Public Convenience and Necessity for their facilities, therefore requiring a License Agreement with the easement holder, the City of Pomona, for the installation of electrical conduits in a portion of the easement area of West Seventh Street (collectively, License Area); and WHEREAS, Bluepath Solar JCC Pomona LLC initiated the request to construct and operate a solar energy system, including solar panels, electrical conduits, equipment, and other related infrastructure (collectively, the “Project”), on West Seventh Street (locations situated on opposite sides of the License Area), in connection with the Project, and desires to construct underground electrical transmission and distribution of electrical power between the sites and associated facilities, including without limitation (collectively, the License Facilities”); NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. The foregoing recitals are true and correct:
SECTION 2. The City Council hereby finds, based on the evidence submitted, that the proposed License Agreement, covering a portion of the City maintained right of way, attached hereto as Exhibit 1 is hereby approved; SECTION 3. The City Council hereby authorizes the City Manager or designee to execute the License Agreement, and any amendments thereto, on behalf of the City:
SECTION 4. The City Clerk shall attest and certify to the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.
