COUNCIL REPORT
August 3, 2026
To: Honorable Mayor and Members of the City Council
From: Anita Scott, City Manager
Submitted By: Michael Ellis, Chief of Police
SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE RELATED TO CITY CODE SECTION 34-221 – NUDITY AND PUBLIC INDECENCY RECOMMENDATION:

It is recommended that the City Council adopt modifications to the following ordinance:

ORDINANCE NO. 4370 – AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING CITY CODE SECTION 34-221 – NUDITY AND PUBLIC INDECENCY DISCUSSION:

This ordinance was first introduced during the July 20, 2026, City Council Meeting (Attachment No. 1). The purpose of the proposed Ordinance No. 4370 (Attachment No. 2) is to amend Chapter 34, Article V of the Pomona City Code, by amending existing Sections and adding new Sections. The proposed code amendment updates City Code Section 34-221 to provide clearer enforcement standards by clarifying the City’s existing prohibitions on nudity and public indecency and focusing on specific, objective conduct occurring in public places. The proposed code amendment would add to and clarify the conduct prohibited under City Code Section 34-221 and allow enforcement based on objective conduct expressly identified in the ordinance.

The ordinance will take effect 30 days after its adoption on August 3, 2026.
