CITY OF POMONA
COUNCIL REPORT
September 14, 2026
To: Honorable Mayor and Members of the City Council
From: Anita D. Scott, City Manager
Submitted By: Chris Munoz, Acting HR/Risk Management Director SUBJECT: RATIFICATION OF CONTRACT OVERRUNS FOR THE RED WING SHOES EMPLOYEE SAFETY FOOTWEAR VOUCHER PROGRAM RECOMMENDATION:
It is recommended that the City Council take the following actions:
Ratify, pursuant to Pomona City Code Section 2-984, the contract overruns incurred under the existing Red Wing Shoes Agreement; and Authorize the continued use of the existing Red Wing Shoes Agreement through its current term ending December 31, 2026, including the exercise of up to two additional one-year extension options, through December 31, 2028, in accordance with the terms and conditions of the existing agreement and subject to available budget appropriations.
Authorize the City Manager or designee to execute the extensions or amendments on behalf of the City.
EXECUTIVE SUMMARY:
The City's Employee Safety Footwear Program has exceeded the $15,000 annual not-to-exceed amount authorized under the existing agreement with Red Wing Shoes because the original estimate of funding needed for the program was insufficient to meet actual program needs. Pursuant to Pomona City Code Section 2-984, City Council ratification is required for the prior contract overruns. Staff recommends ratifying the prior expenditures and continuing the existing agreement through its current term ending December 31, 2026, with the option to exercise up to two additional one-year extensions, as provided under the existing agreement.
SB1439/GOVERNMENT CODE §84308 APPLICABILITY:
☐ When this box is checked, it indicates the agenda item is subject to the Levine Act SB1439 requirements. Councilmembers are reminded to check their campaign contributions and determine whether they have received a campaign contribution of $500 or more that would require disclosure and/or recusal from discussing or acting on this agenda item. Campaign contributions of $500 or more made 1) by any person or entity who is identified in the agenda report as the applicant or proposer or 2) on behalf of the applicant or participant, including a parent, subsidiary or otherwise related business entity, or 3) by any person who has a financial interest in the agenda item requires a councilmember to comply with SB1439.
FISCAL IMPACT:
With this action, the annual not-to-exceed amount will be administratively increased from $15,000 to $40,000 for the remainder of the current term and any authorized extensions. Funding is included in the adopted operating budgets of the participating City departments and will be charged to the applicable departmental operating accounts. Funding for future fiscal years is subject to annual City Council budget appropriations.
PREVIOUS RELATED ACTION:
There are no previous City Council actions related to the Red Wing Shoes Voucher Agreement, as the agreement was executed administratively and did not previously require City Council approval. The agreement was procured using the City's administrative purchasing procedures in effect at the time.
DISCUSSION:
The City's Employee Safety Footwear Program provides eligible employees with vouchers to purchase required safety footwear through Red Wing Shoes. The existing agreement (Attachment No. 1) has facilitated administration of the program; however, actual program utilization exceeded the agreement's $15,000 annual not-to-exceed amount, resulting in contract overruns during calendar years 2024 and 2025. A summary of expenditures under the existing agreement is provided in Attachment No. 2.
Although expenditures incurred to date in calendar year 2026 remain within the existing $15,000 annual not-to-exceed amount, additional expenditures are anticipated through the remainder of the year as participating departments continue to utilize the program.
Pursuant to Pomona City Code Section 2-984, contract expenditures exceeding the authorized not-to-exceed amount require City Council ratification. Accordingly, staff recommends that the City Council ratify the prior contract overruns and authorize an annual not-to-exceed amount of $40,000 for the remainder of the existing agreement, including any authorized extensions. The increased contract authority will better align the agreement with actual and anticipated program utilization and provide sufficient capacity to continue administering the Employee Safety Footwear Program.
