CITY OF POMONA
COUNCIL REPORT
September 14, 2026
To: Honorable Mayor and Members of the City Council
From: Anita D. Scott, City Manager
Submitted By: Meg McWade, Public Works Director
SUBJECT: APPROVE AN AMENDED AND RESTATED AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES WITH RKA CONSULTING GROUP, INC. FOR “POMONA MULTI-NEIGHBORHOOD PEDESTRIAN AND BICYCLE IMPROVEMENTS,” PROJECT NO. 67930 RECOMMENDATION:
It is recommended that the City Council take the following actions:
Approve an Amended and Restated Agreement for professional consulting services with RKA Consulting Group, Inc. through December 31, 2028, to provide professional consultant services for “Pomona Multi-Neighborhood Pedestrian and Bicycle Improvements” FD428 CIP Project Fund | CC2590 CIP | Project No. 67930; and Authorize the City Manager to execute the Amended and Restated Agreement and related documents, and any additional amendments thereto, subject to approval as to form by the City Attorney.
EXECUTIVE SUMMARY:
Approval of the proposed actions will maintain continuity of the design services required for “Pomona Multi-Neighborhood Pedestrian and Bicycle Improvements” FD428 CIP Project Fund | CC2590 CIP | Project No. 67930. Amending and restating the Agreement with RKA Consulting Group will provide uninterrupted consultant support, helping maintain project momentum and timely delivery of planned improvements.
SB1439/GOVERNMENT CODE §84308 APPLICABILITY:
☒ When this box is checked, it indicates the agenda item is subject to the Levine Act SB1439 requirements. Council members are reminded to check their campaign contributions and determine whether they have received a campaign contribution of $500 or more that would require disclosure and/or recusal from discussing or acting on this agenda item. Campaign contributions of $500 or more made 1) by any person or entity who is identified in the agenda report as the applicant or proposer or 2) on behalf of the applicant or participant, including a parent, subsidiary or otherwise related business entity, or 3) by any person who has a financial interest in the agenda item requires a councilmember to comply with SB1439.
FISCAL IMPACT:
Approval of the Amended and Restated Agreement will result in effectively increasing the existing agreement contract amount of $1,374,805 by $343,700; however, the total revised agreement amount will not exceed 25% of the original contract value, consistent with City procurement requirements.
The total contract cost shown in the restated agreement must reflect the full financial obligation for the entire restated term. This includes the original contract amount, all previously approved increases through amendments, and any additional compensation incorporated as part of the restatement.
The increase beyond the original agreement reflects the expanded scope and extended duration of design support needed to keep the project on schedule and to ensure consistency with prior design work already completed by RKA Consulting Group, Inc. (RKA). Restating the Agreement avoids higher cost, delays, and duplication of efforts that would occur if a new consultant were procured mid-project. Sufficient funding is available within the Project’s approved budget allocations.

PREVIOUS RELATED ACTION:
On August 6, 2018, the City Council authorized the submittal of an Active Transportation Program (ATP) application to Caltrans requesting up to $10 million for the implementation of bicycle infrastructure and pedestrian-crossing enhancements.
On March 16, 2020, the City Council approved Resolution No 2020-39 approving the Agency-State Program Supplemental Agreement No. T01 with Caltrans for the ATP Cycle 4 Grant and amended the FY 2019-20 Capital Improvement Program (CIP) budget for Federal and State funded Project Number ATPL-5070 (035) by increasing revenue estimates and appropriating $220,000 of ATP Cycle 4 Grant funds to “Pomona Multi-Neighborhood Pedestrian and Bicycle Improvements,” Project No. 428-2590-XXXX-67930.
On Dec 5, 2022, the City Council approved Resolution No. 2022-203 to approve a revised supplemental agreement with California Department of Transportation (Caltrans for the ATP Cycle 4 Grant and amended the FY 2022-23 CIP Budget by decreasing revenue estimates and unappropriating $117,843 of unusable remaining ATP Cycle 4 (T01/PES/PA&ED) Grant funds and increased revenue estimates and appropriated $515,000 of ATP Cycle 4 (T01REV1/PE/RW) Grant funds and awarded RKA, professional consulting services in the amount not to exceed $1,374,805.
DISCUSSION:
The Pomona Multi-Neighborhood Pedestrian and Bicycle Improvements Project is funded through the State’s ATP and is being implemented in coordination with Caltrans. The City Council previously authorized the ATP grant application, approved the required Program Supplemental Agreements with Caltrans, appropriated grant funding, and authorized the professional consulting services agreement necessary to advance the project through the preliminary engineering and design phases.
Since execution of the original agreement, the project has undergone several administrative modifications, funding adjustments, and scope refinements to reflect evolving Caltrans requirements and project needs. As these changes accumulated, Staff evaluated the most effective method for incorporating the previously approved revisions into the governing agreement.
In consultation with the City Attorney, Staff determined that preparing an Amended and Restated Agreement, rather than processing additional amendments, is the most appropriate and efficient approach. The Amended and Restated Agreement consolidates all previously approved modifications, funding adjustments, and scope revisions into a single, comprehensive document. This approach provides a clear and accurate contractual record, extending the timeframe from December 2025 when the term expired. In the long run, the Amended and Restated Agreement improves administrative efficiency and reduces the potential for inconsistencies that can result from multiple sequential amendments.
The Amended and Restated Agreement will support the extended duration of design services required to keep the project on schedule and ensure continuity with work previously completed by RKA. Because the consultant has developed the project’s design from its inception, continuing with the existing consultant avoids unnecessary delays, duplication of efforts, and the additional costs associated with procuring and transitioning to a new consultant. The revised agreement remains within the City’s procurement authority, as the Amended and Restated Agreement value does not exceed 25% of the original agreement amount.
Pomona’s Procurement Ordinance (Ordinance No. 4276, Section 2-984) limits contract terms to five years unless specifically approved by the City Council. This request is also being made under the provisions of Section 2-995 of the Procurement Ordinance, which allows for special procurement in cases of extenuating circumstances. The extenuating circumstances supporting this request include the regional significance of the Pomona Multi-Neighborhood Pedestrian and Bicycle Improvements Project and the continuity required for delivery of a multi-phase infrastructure project of this scale.
The Amended and Restated Agreement does not change the overall purpose or objectives of the project. Instead, it incorporates prior City Council actions into one unified agreement that reflects the current project scope, funding, and administrative requirements.
Approval of the Amended and Restated Agreement will ensure the agreement accurately reflects the project’s current status while supporting continued compliance with Caltrans, ATP Program requirements, and facilitating the successful delivery of the Pomona Multi-Neighborhood Pedestrian and Bicycle Improvements Project.
