Change Order #10 is for $30,000 which will bring the total contingency amount above 25%. As a result, change order #10 requires City Council authorization to exceed 25% of the original contract. If approved the total contract amount will be $1,699,680.76.

PREVIOUS RELATED ACTION:

On July 18, 2022, City Council approved an agreement with Alta Planning and Design, Inc. in the amount of $1,336,370 for the design of the Project and appropriated $250,000 of Safe Clean Water Program (Measure W) funds to the Project.

On November 3, 2025, City Council approved the “Bike Path – San Jose Creek” project concept. The San Jose Creek bike path will create a 3.5-mile bicycle and pedestrian greenway trail featuring 15 access points, wayfinding safety signage, and landscaped areas with water storage capacity.

DISCUSSION:

The “Bike Path - San Jose Creek,” Project No. FD428 CIP Project Fund | CC2590 CIP | Project No. 58072 is a project that has been in development since 2022. The City initially received a $1.4 million Measure M Multi-Year Subregional Grant to fund design, and design is near completion. Since then, the City has been awarded an additional $11.6 million in Active Transportation Program (ATP) Cycle 6 funding for construction which will be subject to an agreement that will be presented to City Council for consideration at a future date.

The multi-modal project will result in a 3.5-mile bike and pedestrian greenway trail with up to fifteen (15) access points, wayfinding and safety signage, planted areas with water storage capacity, and near key community destinations such as schools and parks. The bike path begins at Temple Avenue near Cal Poly Pomona and ends at Murchison Avenue, near the I-10 freeway. Overall, residents and non-residents will be able enjoy this bikeway as it also provides an active transportation option to travel around Pomona utilizing the existing bike routes along Ridgeway Street, to the protected bike lanes along Valley Boulevard, along Humane Way, Ninth Street, and the future pedestrian and bike bridge over the SR-71, or along Humane Way to Orange Grove Boulevard.

Alta Planning and Design, Inc. is the City’s design contractor for the bike path. Since being awarded the design agreement by City Council in 2022, nine Change Orders have been necessary to address project needs. The project scope has been expanded to include additional design, environmental, permitting, right-of-way, and regulatory requirements. The additional scope within the current authorized change orders includes:

Design of an additional access point at Corporate Center Drive to connect existing student housing to the bike path.

Traffic control measures for geotechnical investigation.

Design of the Ridgeway Trail crossing, including traffic signal design at Corporate Center Drive.

Incorporation of new ADA requirements identified through the CEQA clearance process.

Revision of the CEQA documentation to incorporate solar lighting along the trail, including an updated lighting plan and lighting impact analysis.

Supplemental survey data to finalize landscape and civil design at the campus and Temple Avenue trailheads and to connect the trail to Cleveland Street.

Preparation of legal descriptions and documentation for right-of-way acquisitions, permanent easements, and temporary easements for properties along the trail.

Incorporation of Section 408 permitting requirements from the U.S. Army Corps of Engineers, including revisions to structural cross-sections under State Route 71 and coordination with Caltrans regarding resulting design modifications.

Due to the expansion of project scope based on community input, funding agencies, and project partners, the agreement has reached the 25% contingency allowed on Capital Improvement Projects. Therefore, Change Order #10, in the amount of $30,000, requires City Council authorization. Change Order #10 is to add to the Scope of Work for Alta to obtain the ACE permit for the construction. As part of their review, ACE is requiring National Environmental Policy Act (NEPA) environmental clearance, including Section 106 compliance.

Typically, federally funded projects are required to obtain NEPA environmental clearance, including Section 106 compliance, in accordance with Caltrans Local Assistance guidelines before requesting authorization to begin construction. However, this project is funded with State funds and therefore was not anticipated to require NEPA clearance, including Section 106, prior to receiving construction authorization from Caltrans Local Assistance. During our most recent permit review meeting with Los Angeles County Flood Control/Public Works, ACE and Caltrans, ACE indicated that the City will need to complete NEPA clearance through their agency prior to permit issuance.

The cost of the added work to be performed by Alta exceeds 25% above the original contract price of $1,336,370. The Pomona City Code Section 2-1003 (1) requires that all Change Orders for a project exceeding 25% of the contract amount be approved by the City Council prior to authorization of the change.
