(c) EXPENSES. Includes, without limitation, all attorneys’ fees, costs, any other expenses reasonably incurred in the defense of any claims or proceedings against an Agent by reason of his or her position or relationship as Agent and all attorneys’ fees, costs, and other expenses reasonably incurred in establishing a right to indemnification under this Article.
Section 5.2 SUCCESSFUL DEFENSE BY AGENT. To the extent that an Agent has been successful on the merits in the defense of any proceeding referred to in this Article, or in the defense of any claim, issue, or matter therein, the Agent shall be indemnified against expenses actually and reasonably incurred by the Agent in connection with the claim.
Section 5.3 SETTLEMENT OR UNSUCCESSFUL DEFENSE BY AGENT. If an Agent either settles any proceeding referred to in this Article, or in the defense of a claim, issue, or matter therein, or sustains a judgment rendered against him or her, then the provisions of Sections 5.4 through 5.5 shall determine whether the Agent is entitled to indemnification.
Section 5.4 ACTIONS BROUGHT BY PERSONS OTHER THAN THE
CORPORATION. This Section applies to any proceeding other than an action “by or on behalf of the Corporation” as defined in Section 5.5. Such proceedings that are not brought by or on behalf of the Corporation are referred to in this Section as “Third Party proceedings.” (a) SCOPE OF INDEMNIFICATION IN THIRD PARTY PROCEEDINGS.
Subject to the required findings to be made pursuant to this Section, the Corporation shall indemnify any person who is or was a party, or is threatened to be made a party, to any Third Party proceeding, by reason of the fact that such person is or was an Agent, for all expenses, judgments, fines, settlements, and other amounts actually and reasonably incurred in connection with the proceeding.
(b) REQUIRED STANDARD OF CONDUCT FOR INDEMNIFICATION IN THIRD PARTY PROCEEDINGS. Any indemnification granted to an Agent pursuant to this Section, is conditioned on the following. The Board must determine, in the manner provided in Section 5.6, that the Agent seeking reimbursement acted in good faith, in a manner he or she reasonably believed to be in the best interest of the Corporation, and, in the case of a criminal proceeding, he or she must have had no reasonable cause to believe that his or her conduct was unlawful. The termination of any proceeding by judgment, order, settlement, conviction, or on a plea of nolo contendere, or its equivalent shall not, of itself, create a presumption that the person did not act in good faith or in a manner he or she reasonably believed to be in the best interest of the Corporation or that he or she had reasonable cause to believe that his or her conduct was unlawful.
Section 5.5 ACTIONS BROUGHT BY OR ON BEHALF OF THE
CORPORATION. This Section applies to any proceeding brought (i) by or in the right of the Corporation, or (ii) by an Officer, Director, or person granted relator status by the Attorney Agenda Item No. 06 Page 12 of 17 HHI Agenda 04-02-2024
General, or by the Attorney General, on the ground that the defendant Director was or is engaging in self-dealing within the meaning of California Corporations Code section 5233, or (iii) by the Attorney General or person granted relator status by the Attorney General for any breach of duty relating to assets held in charitable trust. Such proceedings are referred to in this Section as “by or on behalf of the Corporation.”
(a) SCOPE OF INDEMNIFICATION IN PROCEEDING BY OR ON
BEHALF OF THE CORPORATION. Subject to the required findings to made, and exclusions stated, pursuant to this Section, the Corporation may indemnify any person who was or is a party, or is threatened to be made a party, to any proceeding by or on behalf of the Corporation, by reason of the fact that such person is or was an Agent, for all expenses actually and reasonably incurred in connection with the defense or settlement of such proceeding. (b) REQUIRED STANDARD OF CONDUCT FOR INDEMNIFICATION IN PROCEEDING BY OR ON BEHALF OF THE CORPORATION. Any indemnification granted to an Agent pursuant to this Section is conditioned on the following. The Board must determine, in the manner provided in Section 5.6, that the Agent seeking reimbursement acted in good faith, in a manner he or she reasonably believed to be in the best interest of the Corporation and with such care, including reasonable inquiry, as an ordinarily prudent person in a like position would use under similar circumstances.
(c) CLAIMS SETTLED OUT OF COURT. If any Agent settles or otherwise disposes of a threatened or pending action brought by or on behalf of the Corporation, with or without court approval, the Agent shall receive no indemnification for amounts paid pursuant to the terms of the settlement or other disposition. Also, in cases settled or otherwise disposed of without court approval, the Agent shall receive no indemnification for expenses reasonably incurred in defending against the proceeding, unless the proceeding is settled with the approval of the Attorney General.
(d) CLAIMS AND SUITS AWARDED AGAINST AGENT. If any Agent is adjudged to be liable to the Corporation in the performance of the Agent’s duty to the Corporation, the Agent shall receive no indemnification for amounts paid pursuant to the judgment, and any indemnification of such agent for expenses actually and reasonably incurred in connection with the defense of that action shall be made only if both of the following conditions are met (i) the determination of good faith required in this Section must be made in the manner provided in Section 5.6, and (ii) upon application, the court in which the proceeding was brought must determine that, in view of all of the circumstances of the case, the Agent is fairly and reasonably entitled to indemnity for the expenses incurred. If the Agent is found to be so entitled, the court shall determine the appropriate amount of expenses to be reimbursed.
Section 5.6 DETERMINATION OF AGENT’S GOOD FAITH CONDUCT. The indemnification granted to an Agent in Sections 5.4 and 5.5 is conditioned on the findings required by those Sections being made by (i) the Board of Directors by a majority vote of a quorum Agenda Item No. 06 Page 13 of 17 HHI Agenda 04-02-2024
consisting of Directors who are not parties to the proceeding, or (ii) the court in which the proceeding is or was pending. Such determination may be made on application brought by the Corporation, the Agent, the attorney, or other person rendering a defense to the Agent, whether or not the application by the Agent, attorney, or other person is opposed by the Corporation.
Section 5.7 LIMITATIONS. No indemnification or advance shall be made pursuant to this Article, except as provided by Sections 5.4-5.6 above, in any circumstances when it appears (i) that the indemnification or advance would be inconsistent with a provision of the Articles of Incorporation or of these Bylaws, State law, or an agreement in effect at the time of the accrual of the alleged cause of action asserted in the proceeding in which the expenses were incurred or other amounts were paid, which prohibits or otherwise limits indemnification; or (ii) that the indemnification would be inconsistent with any condition expressly imposed by a court in approving a settlement.
Section 5.8 ADVANCE OF EXPENSES. Expenses incurred in defending any proceeding may be advanced by this Corporation before a final disposition of the proceeding on receipt of an undertaking by or on behalf of the Agent to repay the amount of the advance unless it is determined ultimately that the Agent is entitled to be indemnified as authorized in this Article.
Section 5.9 CONTRACTUAL RIGHTS OF NON-DIRECTORS/OFFICERS.
Nothing contained within this Article shall affect any right to indemnification to which persons other than Directors and Officers of the Corporation, or any of its subsidiaries, may be entitled by contract or otherwise.
Section 5.10 INSURANCE. The Board of Directors may adopt a resolution authorizing the purchase and maintenance of insurance on behalf of any Agent of the Corporation against any liability other than for violating provisions against self-dealing asserted against or incurred by the Agent in such a capacity or arising out of the Agent’s status as such, whether or not this Corporation would have the power to indemnify the Agent against that liability under the provisions of this Article.

SUBJECT: ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PORT HUENEME, CALIFORNIA, DECLARING THAT PARKING
SHALL BE ALLOWED ALONG SAN PEDRO STREET EXCEPT THAT THE
PARKING OF VEHICLES IN EXCESS OF SIX FEET IN HEIGHT SHALL
BE PROHIBITED ALONG SAN PEDRO STREET
RECOMMENDATION:
It is recommended that City Council adopt a Resolution entitled, “A Resolution of the City Council of the City of Port Hueneme, California, declaring that parking shall be allowed along San Pedro Street except that the parking of vehicles in excess of six feet in height shall be prohibited along San Pedro Street”.
BACKGROUND/ANALYSIS:
At the March 4, 2024 City Council meeting, the Council approved the removal of the parking restriction on the westside of San Pedro Street between Pleasant Valley Road and Clara Street and authorized staff to consult with Naval Base Ventura County regarding oversized vehicle parking concerns.
Since the meeting, City staff have engaged Navy representatives to review the implementation of this change. During its evaluation of parking design options, the City determined that the street lacks the necessary width to accommodate diagonal parking without eliminating a traffic lane. Consequently, the City has determined that parallel parking, which will result in approximately 40 new parking spaces, is the most viable design option. This option does not necessitate the removal of a traffic lane and has garnered the Navy’s support.
As indicated during the March 4 meeting, the City acknowledges the Navy’s concerns regarding the parking of oversized vehicles along its fence line and is supportive of prohibiting such activity. Pursuant to Vehicle Code 22507, a local agency may prohibit the parking of oversized vehicles, defined as those exceeding six feet in height, through a resolution. In order to implement such prohibition, staff is requesting the City Council’s Agenda Item No. 09 Page 1 of 5 CC Agenda 04-02-2024

adoption of the attached resolution. Enforceability of such resolution is subject to the installation of signs which provide notice of this restriction.
FISCAL IMPACT:
The costs associated with the production and installation of signs necessary to enforce the restriction on oversized vehicle parking is approximately $550. Sufficient funds are contained within account 101-551-5524.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT HUENEME,
CALIFORNIA, DECLARING THAT PARKING SHALL BE ALLOWED ALONG

WHEREAS, Port Hueneme Municipal Code section 3244(f) empowers the City Council to declare locations throughout the City as no parking zones pursuant to resolution; and WHEREAS, the City has discussed allowing parking along San Pedro Street with the Command at Naval Base Ventura County (“NBVC”), which is amenable to parking of private vehicles subject to certain restrictions deemed necessary for security of the military installation; and
WHEREAS, the City Council wishes to rescind a historic policy declaring San Pedro Street a no parking zone and to allow parking along the length of said street subject to height restrictions; and

WHEREAS, the City wishes to alleviate the considerable parking issues affecting local governments statewide and provide its residents with adequate parking while being sensitive to its partnership with the U.S. Navy and NBVC.

SECTION 1: the above recitals are true and correct and incorporated herein by this reference.
SECTION 2: The current policy prohibiting parking on or along San Pedro Street is hereby rescinded.

SECTION 4: This Resolution shall take effect immediately upon its passage.
SECTION 5: Enforcement of this Resolution shall not occur until such time as signs or other applicable markings giving adequate notice of such restrictions have been installed consistent with Vehicle Code section 22507, subdivision (a).

SUBJECT: CITIZENS ADVISORY COMMISSION APPOINTMENT
RECOMMENDATION:
Confirm and approve Mayor Perez’ appointment of Mark Savalla to the Citizens Advisory Commission to an unexpired term ending January 31, 2025.
BACKGROUND/ANALYSIS:
Volunteer Advisory Boards are an integral part of local government that offer a way to engage residents in the democratic process and enhance community involvement. The primary purpose is to provide judicious advice from a resident perspective and bring together community views that might not otherwise be heard.
On January 13, 2024, the City received a notice of resignation, effective immediately, from Cynthia Sanchez, for her position on the Citizen Advisory Commission thus creating a vacancy. Notice was provided as legally required.
Members are appointed by the City Council, with each Council Member appointing one member, and appointments are subject to approval by the majority of the Council. Mayor Perez is the nominating member for this unscheduled vacancy position.
The appointee is required to take an Oath of Office, file a Statement of Economic Interest (Form 700), complete a 2-hour Ethics Training, and if applicable, a Brown Act Training.
FISCAL IMPACT:
None. This item does not require an expenditure of funds.

SUBJECT: VENTURA COUNTY ORGANIZED RETAIL THEFT TASK FORCE RECOMMENDATION:
It is recommended that the City Council authorize staff to execute the attached Memorandum of Understanding (MOU) with the Ventura County Sheriff’s Office to join the Ventura County Organized Retail Theft Task Force, and take the steps needed to implement the MOU.
BACKGROUND/ANALYSIS:
In December of 2023, Ventura County was named the safest large county in all of California. Ventura County law enforcement officials attributed the designation to the collaborative working relationship amongst local law enforcement agencies.
This partnership has provided another opportunity in the form of the Ventura County Organized Retail Theft Task Force (VCORTTF). Retail theft has become a crisis in many areas across the state and country, and was estimated to cost over $110 billion across the country last year. Ventura County law enforcement agencies are proactively proposing development of a joint task force to address this issue.
VCORTTF was created through funding provided by the State of California Organized Retail Theft Prevention Grant Program. The grant is administered through the California Board of State and Community Corrections (BSCC) and has a service period beginning October 1, 2023 and ending December 31, 2026. The grant provides funding for salary and benefits for personnel assigned to the grant activity and for other project related expenses, as necessary. The grant will also provide equipment to participating agencies.
The VCSO will provide each participating agency head with a subgrantee agreement outlining grant funding and agency requirements.

Participating agencies include:
o Ventura County Sheriff’s Office
o Simi Valley Police Department
o Oxnard Police Department
o Ventura Police Department
o Santa Paula Police Department
o California State University, Channel Islands Police Department o Ventura County Community College Police Department
The City of Port Hueneme has an opportunity to participate in an important role in VCORTTF, via the attached Memorandum of Understanding (Attachment A), which is intended to affirm the commitment to working together toward the mutual goal of the investigation, arrest, and prosecution of persons and criminal organizations who are engaged in organized retail theft, vehicle/vehicle parts theft, and cargo theft within the communities of Ventura County.
Each participating agency would maintain control, responsibility, liability, and authority over their designated officer. Any participating agency could withdraw from the MOU with 30 days’ notice.
This MOU is recommended because it provides several opportunities for additional resources that would benefit Port Hueneme and ultimately, the County’s public safety.
FISCAL IMPACT:
The grant provides funding for salary and benefits for personnel assigned to the grant activity and for other project related expenses, as necessary, for the period of October 1, 2023 through December 31, 2026. The VCSO will provide each participating agency head with a subgrantee agreement outlining grant funding and agency requirements. Staff estimates a start date of April 15, 2024.
Award of this grant will result in additional revenue and will require an appropriation of $55,819.00 in FY 2023/24 to the General Fund Grant Revenue Account No. 101-000- 4701, Project No. GR2402.

Investigators may possess undercover documents supporting covert identities used to enhance operations and investigations. The procurement, utilization, and control of these documents shall be the responsibility of the investigator's employing agency.
Investigators who do not meet acceptable standards of performance or who refuse to comply with policies and procedures may be removed from VCORTTF by the Narcotics Captain. The Narcotics Captain shall discuss the issue with the investigator's employing agency.
If the employing agency does not agree with the action, the contested issue shall be forwarded to the collective department heads for final resolution. Resolution of operational problems at the lowest level is desirable and is in the best overall interest of the unit.
Funding
VCORTTF was created through funding provided by the State of California Organized Retail Theft Prevention Grant Program. The grant is administered through the California Board of State and Community Corrections (BSCC) and has a service period beginning October 1, 2023 and ending December 31, 2026.
The grant provides funding for salary and benefits for personnel assigned to the grant activity and for other project related expenses, as necessary. The VCSO will provide each participating agency head with a subgrantee agreement outlining grant funding and agency requirements.
Vehicles
The VCSO will provide each participating agency’s investigator with an unmarked vehicle for use in task force related operations. This vehicle shall be equipped with a police radio and capable of being operated as an emergency vehicle. Insurance, registration, fuel, and maintenance costs for the vehicle will be the responsibility of the VCSO. A license agreement is attached and incorporated into this MOU as Exhibit A. The Parties shall review and sign Exhibit A in addition to this MOU.

3 Equipment and Facilities
Office space, including basic office supplies, desktop computer, telephone service will be provided by VCORTTF. Costs of additional equipment such as cellular telephones shall be the responsibility of each participating agency.
Each agency shall provide its investigator with the necessary safety equipment required to make them operationally effective to include, entry vest, ballistic helmet, less lethal force options, and any tactical equipment approved and/ or issued by the agency.
Additional equipment for VCORTTF may be purchased under the grant by the Ventura Sheriff’s Office to enable investigators to fulfill the mission safely. Any equipment purchased or issued by the Ventura County Sheriff’s Office will remain property of VCSO and must be surrendered upon agency or member reassignment.
Policy
Each agency member shall abide by their own department policy while working as part of VCORTTF. Investigations, including covert operations, confidential informants, search warrants, and tactical operations will adhere to the Sheriff’s Investigation Manual. Each participating member will be provided access to this manual.
Civilians' complaints, use of force investigations, and/or internal affairs matters involving VCORTTF personnel shall be investigated by the involved employee's parent agency. VCORTTF personnel shall cooperate with all personnel investigations. Furthermore, the Narcotics Captain shall be kept informed of the status of any investigation involving a VCORTTF member. Nothing in this paragraph is meant to limit agency personnel from investigating criminal activities of government employees.
Training
Personnel assigned to VCORTTF shall abide by the training plan from their assigned agency to include annual updates as required by P.O.S.T or state mandate. It is highly encouraged all VCORTTF investigators receive training in basic investigations, confidential informant management, and mobile surveillance.
Sergeants assigned to VCORTTF will evaluate each assigned investigators’ experience and training to determine capabilities. Newer investigators may be assigned to a Detective Training Officer and receive detective training. If required, the length and type of detective training will be determined by VCORTTF Sergeants. All investigators will participate in monthly Narcotics Bureau training to include officer safety, building entry, tactical movement, officer rescue, case law, and narcotics related training.
It is the intention of VCORTTF management to participate in regional, state, or national training conferences to provide investigators with the most current information on trends and enforcement efforts. The Narcotics Captain will coordinate training conferences with the managers from VCORTTF participating agencies.
Agenda Item No. 11 Page 7 of 14 CC Agenda 04-02-2024
4 Use of Buy Funds
Buy funds for operations will be provided by VCSO. The Narcotics Captain issues funds to each sergeant and bi-annually audits the expenditures. Records, receipts, and ledgers are maintained by the Narcotics Captain for a term as prescribed in the Sheriff’s Policy Manual and are kept confidential.
Deconfliction
It is both the policy and practice of the VCSO to utilize the Western States Information Network (“WSIN”) for investigative deconfliction. Each member of VCORTTF will be given access to WSIN and be required to store investigative targets and informants, and to deconflict investigative operations.
Media Releases
All media releases and statements will be written by case agents for review and approval by VCORTTF Sergeants. Once approved, the Narcotics Captain will review the media release and send it to each agency for review at least two (2) hours before being released to the media. Media Releases will follow VCSO protocol for distribution and follow up.
Media releases will be published on a VCORTTF letterhead that incorporates each participating agency insignia and include language about VCORTTF and agency participation.
Press conferences on VCORTTF cases will be planned by the Narcotics Captain. Each agency will be afforded the opportunity to participate. The Narcotics Captain will determine the lead presenter and each agency’s level of participation in the press conference.
VCORTTF participants may coordinate regular public education releases via social media with department representatives or PIOs.
Liability & Indemnity
Each participating agency shall have full financial responsibility for their respective investigators, including vehicle traffic collisions, worker’s compensation, and civil liability for acts or omissions of the other.
To the extent permitted by law, each individual VCORTTF partner agency shall defend, indemnify, and save harmless all other VCORTTF partner agencies and their appointees, officers, and employees from and against any and all claims, suits, or actions for “injury” (as defined by Government Code section 810.8) arising out of the individual VCORTTF partner agency’s performance under this agreement, but only in proportion to and to the extent that the claim, suit or action for injury is caused by the negligent or intentional acts or omissions of the individual VCORTTF partner agency, or the individual VCORTTF partner agency’s appointees, officers, or employees, during the course and scope of this agreement.
Neither termination of this agreement nor completion of the acts to be performed under this agreement shall release any party from its obligation to indemnify as to any claims or cause of Agenda Item No. 11 Page 8 of 14 CC Agenda 04-02-2024
5 action asserted so long as the event(s) upon which such claim or cause of action is predicated shall have occurred after the effective date of this agreement and prior to the effective date of termination or completion.
Claims and Litigation Handling
Any claim against any participating agency that is the result of VCORTTF operation shall be processed as follows in order to assure appropriate claims and litigation reporting and handling:
a) Each participating agency shall be given immediate notice of any claim filed against VCORTTF. Copies of said claim shall be immediately forwarded to the participating entity (Attention: Risk Manager).
b) Each participating agency retains the right to investigate, adjust and settle their portion of any case independent of the remaining parties.
c) Each participating agency shall retain separate defense counsel to represent each of them as each deems appropriate in its absolute discretion.
Statistics and Communication
The Narcotics Captain will maintain statistics for VCORTTF according to the Ventura County Sheriff’ Narcotics Bureau standards. VCORTTF Sergeants will complete a monthly memorandum detailing the activities of the teams. The Narcotics Captain will review the statistics and memorandum on, or about, the tenth day of the following month and share with VCORTTF participating agencies. Any specific statistics required by VCORTTF participating agencies not compiled by the Sheriff’s Narcotics Bureau will be the responsibility of the individual agency investigators. The Narcotics Captain will report task force activities to the BSCC as directed.
Dispute Resolution
The participating agencies agree to attempt to resolve any disputes regarding jurisdiction, case assignments, workload, etc., at the supervisory level first before referring the matter to management personnel for resolution. Should a dispute rise above the supervisory level, the Sheriff’s Narcotics Captain will schedule a meeting to discuss the issue and work with participating agencies to resolve the dispute.

DATE: April 2, 2024
TO: Honorable City Council
FROM: James Vega, City Manager
Charles Peretz, Deputy City Manager
SUBJECT: PLANNING AND MANAGEMENT OF 2024 HUENEME BEACH FESTIVAL RECOMMENDATION:
It is recommended that the City Council:
1. Cancel the Request for Proposals for Hueneme Beach Festival Event Planning and Management Services and award no contract
2. Approve the use of an employee committee to plan and manage the 2024 Hueneme Beach Festival
3. Authorize a donation of $25,000 to the Port Hueneme Police Explorers to provide services associated with the execution of the 2024 Festival
4. Authorize the City to consider and/or accept in-kind donations in lieu of vendor fees for local non-profit organizations.
BACKGROUND/ANALYSIS:
At the December 18, 2023 meeting, the City Council received a summary of the 2023 Hueneme Beach Festival (HBF) and provided direction regarding the development of the 2024 event. The Council approved the staff recommendation to evaluate the potential of using internal resources to plan and manage the event while also issuing a Request for Proposals (RFP) as a contingency plan.
Planning community events requires the careful consideration of various factors to ensure such events are tailored to meet the preferences and interests of community members.
Feedback from the Community, Citizen Advisory Commission, and from the City Council indicated that a focus of this coming year should be on ensuring the event has local representation and Port Hueneme community involvement. The City’s internal resources include staff members who possess experience with event planning and management, along with a strong familiarity with the community. Although the vendors who responded to the RFP demonstrated valuable experience in organizing other events, staff is recommending cancellation of the Request for Proposals and the utilization of an employee committee to plan and coordinate a locally focused and community-centric 2024 HBF.

2024 HBF Management
April 2, 2024
The staff committee, which would consist of employees from multiple City departments, would be led by the City’s Property and Evidence Supervisor, Frank Montelongo, who has extensive experience managing and executing events associated with the Police Explorer program. The event objectives endorsed by the City Council on December 18, 2023 will serve as the guiding principles for planning efforts. The Police Explorers program, dedicated to guiding young community members in honing law enforcement abilities including crowd control and other large event management, would participate in event planning and execution. Involvement in the HBF presents a valuable educational and development opportunity for participants, offering them the chance to gain valuable skills and experience. The City Council is being asked to approve a donation of $25,000 to the Police Explorers program which will support future programming.
The December 18, 2023 Council action approved the list of event objectives recommended by the CAC and highlighted the use of the beach and sand for event activities, reducing the HBF to one-day event and minimizing event costs. The following list includes all approved event objectives:
• Engage Non-Profit Partners and Enhance Involvement of Community Groups • Increase Utilization of Hueneme Beach with Beach-Based Activities • Overall Focus on Port Hueneme Community
• Account for Financial Impact and Seek to Make Event Self-Sustaining • Avoid Conflicts with VC Fair & VC Pride Events
• Reduce to a 1-Day Event
• Retain Cannabis Presence at Event
• Incorporate Sports Activities, e.g. Basketball, Surf, Volleyball and/or Triathlon • Incorporate Navy, Chumash, and Community Group Activities • Regional Draw to Maximize Attendance
• Youth involvement
• Include Resources Serving the Community, e.g. Ventura County Agencies • Increase Event Sponsorships
Preliminary planning has considered these objectives in the development of a conceptual outline for the event. Although the objectives envisioned reducing the festival to a oneday event, it appears that such change would not yield significant savings to event expenses and would likely have a substantive impact on event sponsorships. As such, the conceptual plan includes hosting a two-day event on September 7 and 8, 2024. These dates were chosen in an effort to avoid conflicts with other scheduled events in Ventura County. Additionally, a modified footprint which will mitigate impacts on city streets and enhance the utilization of Hueneme Beach is being considered. That adjustment seeks to reduce impacts to regular traffic patterns and facilitate hosting athletic competitions and environmental education programs on the beach. To ensure robust youth participation, targeted outreach efforts will be directed towards schools and various youth organizations. Engaging the younger demographic not only enriches the event experience but also fosters a sense of community involvement and empowerment among the next generation.

2024 HBF Management
April 2, 2024
Attachment A includes a preliminary budget for the 2024 event. The preliminary budget differs from last year’s budget in a few key ways. First, it envisions free parking for the event, thus omitting last year’s parking revenue of $9,126 and associated $5,000 expense. It is anticipated that having free parking (and no admission fee) will boost attendance of community members. Secondly, costs associated with event management, sponsorships and marketing, totaling more than $84,000, are excluded. These tasks will be managed by the committee organizing the event, with support from the Police Explorers. Lastly, the budget proposes a $35,000 contribution from the City. That amount, along with the $25,000 donation to the Port Hueneme Police Explorers program, present the total anticipated City cost. The Port Hueneme Police Explorers is a local 501(c)3 organization serving youth in our community. The donation supports the Port Hueneme program and other Explorer posts that they may call upon to provide additional assistance. This represents a decrease from costs incurred by the City in connection with last year’s event. In addition to the initial $25,000 contribution, the City paid event expenses totaling $45,954. It is important to note that because this is the first time the City will be managing the event, these are estimates and a final report will be provided following the event.
If the City Council decides that an external vendor is most appropriate for handling event planning and management services for the 2024 HBF, the following details are offered to aid in the decision-making process. Three proposals were submitted following the RFP, and each underwent evaluation by a committee comprised of Deputy City Manager Charles Peretz, and Recreation and Community Services Manager Anna Hanley. The chart below outlines the average scores given by the committee members.
Vendor Name Composite Score
SoundSkilz 88.5
4K More Creative 75
Production Rockstars 74
Given the recommendation to use an employee committee with support from Police Explorers, staff recommends cancelling the RFP and awarding no contract. Such action is allowed under the terms of the RFP.
FISCAL IMPACT:
Approval of the staff recommendation would authorize the expenditure of $35,000 for event expenses and $25,000 to be donated to the Port Hueneme Police Explorers.
Sufficient funding for these costs is available in 101-112-5234.

TO: Honorable City Council
FROM: James Vega, City Manager
Fred Camarillo, Public Works Director
SUBJECT: AUTHORIZE PURCHASES EXEMPT FROM FORMAL CONTRACT
PROCEDURE FOR EMERGENCY REPAIR OF CITY SEWER MAIN
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize purchases exempt from formal contract procedures for the emergency repair of a City sewer force main.
2. Authorize the City Manager to immediately proceed with performing the necessary preparations and repairs without compliance with the City’s normal purchasing ordinance. Staff has determined that the work to be performed is not a public project as defined by Public Contract Code section 20161, subdivision (c), which excludes maintenance and repair from said definition.
3. Determine the purchase of goods, materials, and services are exempt from the City’s formal contract procedure pursuant to Port Hueneme Municipal Code section 2564, subdivisions (b) & (c) as follows:
2564 Exemptions from formal contract procedure.
(b) The City Council may authorize purchase of supplies, equipment, and services without complying with this Chapter when in the opinion of the City Council, compliance with the procedures is not in the best interest of the City.
(c) The City Manager may authorize emergency purchases of supplies, equipment, or services. For the purpose of this Chapter, emergency purchases are those procurements required to prevent the immediate interruption or cessation of necessary City services or to safeguard life, property, or the public health and welfare.
BACKGROUND/ANALYSIS:
On March 13, 2024, staff responded to a report of a sinkhole developing on Ventura Road, at the intersection of Ventura Road and Pearl Street. After staff delineated the work area with proper traffic control, investigative excavation work was started to determine the Agenda Item No. 13 Page 1 of 6 CC Agenda 04-02-2024

cause of the developing sink hole. When excavation began, the roadway underneath the point of work quickly deteriorated and a portion of the roadway collapsed.
After further excavation was performed, it was discovered that a section of sewer main was observed to be cracked and a hole on the top of the pipe was present. Staff assessed the situation and called a pipeline contractor to assist in making the necessary repairs.
Staff also began developing a plan that included: notifying other utility companies, acquiring repair pipe, repair fittings, pumping trucks, and making notifications to the public, Port, and Naval Base Ventura County (NBVC).
The line in question was determined to be an 18-inch Asbestos Cement Pipe that services flow from NBVC, as well as the area from Pleasant Valley Road to Bryce Canyon to the north between J Street and Ventura Road. Construction drawings showed the pipe to be approximately 60 years old. Pipe of this material is expected to have a life expectancy of approximately 65 to 75 years, however various factors play a part of the ultimate service life of any individual pipe.
Due to the age and size of the pipe, obtaining proper repair fittings proved to be very challenging. During the course of the repair, it became apparent the overall condition of the intact original pipeline appeared to be in a similarly distressed state. Based on that assessment, staff procured additional pipe and fittings in the event another occurrence takes place. The pipeline is vital in conveying wastewater from the above referenced areas of both the city and NBVC, to the Regional Wastewater Treatment Plant.
Based on the observed condition of the section that was repaired and the importance of this section to the city, it is staff’s recommendation to immediately plan and begin permanent repair of the approximately 4,500 linear feet of pipe to prevent further potential pipe failures. Because time is of the essence to minimize any future potential failures, staff has already begun developing in-house plans of a temporary above ground bypass to convey the wastewater while alternative repair technologies are being evaluated. Staff has also scheduled a professional bypass service to visit and assess field conditions to best determine a final layout. Placement of the temporary bypass and subsequent pipe repairs will necessarily cause minor to intermediate inconvenience during the duration of the repairs, which are expected to last from two to three months, including temporarily adjusting the traffic lanes and closing some of the left turn pockets along Ventura Road between Pleasant Valley and Surfside Drive. However, staff believes the temporary bypass and repair options being considered will ultimately provide the least disruptive environment to the public, while continuing to provide essential service without interruption. Staff will provide notice to area residents and businesses at least 72 hours prior to work beginning.

FISCAL IMPACT:
The estimate for this project is in the range of $2,000,000 to $2,500,000, although exact costs will be developed as plans are finalized.
Approval of this action would require an appropriation in the Wastewater fund of $2,500,000 for this project in fiscal year 2023-24, in Account No. 303-562-5700, Project WW2407. The estimated Wastewater Fund Balance after this appropriation is estimated at $4,123,214.
