SUBJECT: TRANSACTION AND USE TAX CITIZENS OVERSIGHT COMMITTEE - MEASURE “U” ANNUAL REPORT
RECOMMENDATION:
That the City Council receive a presentation from and file the Report provided by the Transactions and Use Tax Citizens Oversight Committee.
BACKGROUND/ANALYSIS:
The Transaction and Use Tax Oversight Committee (Oversight Committee) was created to provide oversight of the Measure U revenue and expenditures of funds. The Oversight Committee plays an important role in ensuring appropriate use of revenues from this tax. Although the Oversight Committee had met in previous years, the meetings were not consistent and there were outstanding questions that required more detailed review and analysis which resulted in the Committee not approving or filing an annual report in prior years. In the last calendar year, the Oversight Committee met quarterly and worked closely with City Manager and Finance Director to obtain more detailed information on Measure U expenditures and activities. The city provided comprehensive reports detailing revenues and expenditures from the inception of the Measure U tax through fiscal year 2022-23. This information allowed the Oversight Committee to review the information and allocate $1.7 million that had not been appropriated in prior years to the Bubbling Springs Park Project.
This report is the first Oversight Committee is presenting to the City Council and includes a summary on the revenue and expenditure history of Measure U taxes.
In addition, for the first time, at the March 27, 2024 quarterly meeting, the committee reviewed, provided feedback and recommended Measure U expenditures proactively for the Fiscal Year 2024-25 Measure U budget. The Measure U proposed budget will be included with the City’s General Fund Budget proposal to Council, which is scheduled to be presented to Council in June.

COMMITTEE MEMBER REPORT TO CITY COUNCIL
BACKGROUND
In November of 2018, the voters in Port Hueneme adopted Ordinance # 750, AKA Measure U, which authorized the City of Port Hueneme to collect a one cent tax on purchases made by residents of Port Hueneme. This tax is collected when transactions occur within city limits or in other jurisdictions.
Residents cannot avoid paying this tax if they purchase items outside city limits.
State law requires a simple majority to enact a tax when the funds collected are deposited into the general fund and a higher percentage when the proceeds are deposited into a fund dedicated for specific purposes. The Council was unsure if the higher threshold could be met and chose to use the lower threshold. As it turned out the measure was quite popular. It passed by a large percentage and would have allowed the proceeds to be placed in a dedicated fund.
Measure U was promoted with the understanding that that the funds collected would be used for specific purposes, which included public safety, parks and recreation, graffiti removal, sidewalk repair, etc. However, none of the promises were binding. Funds deposited in the general fund can be spent on anything the Council so chooses.
To ensure transparency Measure U required the Council to appoint a Citizen Oversight Committee tasked with reviewing expenditures to ensure funds collected were used for the intended purposes. The Committee was required to meet quarterly and present a report to the Council on its findings and recommendations annually. To be clear, the Council is not required to follow the recommendations.
However, Council members are accountable to the voters and misuse of the Measure U funds would be problematic for council members seeking reelection.
SCOPE OF DUTIES
The Committee’s scope and duties are as follows:
• Review revenue and expenditure reports prepared by staff as they relate to the receipt and use of Transaction and Use Tax revenue
• Review the independent audit report and prepare a report of its findings for the Council • Receive and consider reports from the City Manager and Finance Director on the operation impact City-wide.
• Review economic trends.
• Provide an annual report to the Council on the revenue and expenditure history for the prior biennial budget period, including how expenditures align with priorities set by the City Manager under the authority of and in keeping with annually established goals of the Council.
• Review staff recommendations to the Council on future use of funds (based on revenue and expenditure reports and economic trends)

Agenda Item No. 06 Page 3 of 11 CC Agenda 04-15-2024
HISTORY
Transaction taxes began being collected in June of 2019. The Council appointed five members to the Citizens Oversight Committee mid-2019. The first meeting occurred in January 2020. The meeting was organizational in nature, no data was presented to the committee. Over the next three years city staff refused to schedule quarterly meetings or present the committee with any meaningful data. Multiple requests to schedule quarterly meetings and provide data were ignored.
This was extremely frustrating. The only legal option available for the Committee members to discuss issues related to Measure U is to do so during open meetings with a formal agenda listing the items to be discussed. Given that the committee had no input on the agenda and that there were only two meetings held between January 2020 and March 2023 there was no way for the Committee to address much of anything. Additionally, the data provided to the Committee was completely inadequate. In short, city staff refused to comply with the legal mandates of Measure U and there was little if anything committee members could do about it.
In 2023 Tony Stewart was appointed as the interim city manager. He responded to a request and immediately scheduled meetings and provided the Committee with the data available at that time. His actions were critical in getting the process back on track. The first meeting was held on March 30, 2023.
It must be noted that four of the five original members of the committee had resigned at some point in the previous four years. Four new members were appointed, and the committee was able to function for the first time in three years.
ACTIONS
The committee immediately requested a detailed accounting of how Measure U funds had been spent.
James Vega, the new city manager promptly directed Lupe Acero to perform a forensic accounting going back to 2019. This provided the transparency the committee needed to accomplish its mandate. The committee would like to thank Mr. Vega and Ms. Acero for their help in this matter. As it turned out the proceeds from Measure U were co-mingled with other funds. In December of 2023 the process was complete. The Committee was given an accounting of funds collected and a detailed description of how these funds were allocated.
We learned that 10.3 million dollars had been collected. 8.7 million had been spent. The remaining 1.7 million was commingled with the general fund. The Committee asked James Vega to create a separate account and place 1.7 million dollars into it so the Measure U funds would no longer be commingled with the general fund. These figures are accurate throughout the 2022-2023 fiscal year. Staff predicts that Measure U taxes collected will be approximately 3.6 million dollars for the 2024-2025 fiscal year.
In the fall of 2023, it became obvious that the Bubbling Springs Park Renovation Project would need additional funding to complete the project. The Committee determined that the park renovation fell within the guidelines listed in Measure U. The committee unanimously voted to ask the council to use the 1.7-million-dollar surplus to help fund the renovation.
The Oversight Committee is proud of the work we have done over the last year and proud to be of service to our community. We have developed a collaborative relationship with City staff, that is leading to good results for the city and our community. We look forward to working to continue this next year and into the future, and we now have completed our look back at prior years.
Agenda Item No. 06 Page 4 of 11 CC Agenda 04-15-2024
Looking ahead, the oversight committee is scheduled to meet quarterly in calendar year 2024. The committee is working with staff to get and review detailed information earlier and provide feedback on proposed Measure U projects proactively rather than reactively. At the next committee meeting, scheduled to take place in March 2024, staff will provide the committee the proposed Measure U budget for FY 2024-25 for discussion and feedback. This will include the forecasted revenues and proposed projects. The intent is to allow the committee to review, discuss and provide recommendations on the budget prior to presentation to Council.

DATE: April 15, 2024
TO: Honorable City Council
FROM: James Vega, City Manager
Charles Peretz, Deputy City Manager
SUBJECT: JOINT CITY/PORT COMMITTEE DIRECTION INCLUDING
CONSIDERATION OF COMMUNITY BENEFIT FUND ALLOCATIONS
AND FUTURE PRIORITY TOPICS
RECOMMENDATION:
It is recommended that the City Council:
1. Create a list of projects and programs recommended for funding from the Community Benefit Fund; and
2. Provide members of the Joint City/Port Committee with direction regarding future priority topics including the Council’s identified partnership goals.
BACKGROUND/ANALYSIS:
Pursuant to the 2015 agreement, the Oxnard Harbor District (Port) annually contributes $100,000 to the Community Benefit Fund (CBF), when its gross operating revenues exceed $13M. Both of these amounts are subject to increase annually by the Consumer Price Index. To facilitate the identification of mutually agreeable CBF allocations, the agreement calls for the establishment of a joint City/Port committee which includes the Mayor, Mayor Pro Tem, City Manager, Port President, Vice President and CEO.
The agreement lays out the following four categories for CBF projects:
1. Shoreline Protection Monitoring beach profiles, scrutinizing biannual sand replenishment operations and constructing associated improvements to protect the NCEL (owned by the District) and Hueneme Beach Park (owned by the City).
2. Community Development Implementing joint initiatives that foster the community’s economic, social and environmental well-being including, but not limited to, public infrastructure improvements, sponsorship of special events, support of civic organizations, and similar activities.
Agenda Item No. 07 Page 1 of 5 CC Agenda 04-15-2024
Community Benefit Fund Allocations
April 15, 2024
3. Opportunistic Endeavors Pursing opportunities that foster the shared mission and interest of the City and District not otherwise described above including, but not limited to, economic development grants, environmental mitigation, enterprise zone establishment, joint trade missions and similar activities.
4. Other Projects Agreed To By The Parties Any project or projects as may be agreed to in any year by the District’s Board of Harbor Commissioners and the City Council.
CBF Projects must be determined within 180 days from July 1st per settlement agreement.
Projects nominated by the City Council will be vetted by the City-Port Standing Committee. The list of allocations recommended by this committee will return to the City Council and Board of Harbor Commissioners for final approval.
In order to assist the Council with its review and consideration of CBF allocations, a list of projects and programs that have received CBF appropriations since FY 20-21 is attached.
The establishment of the joint committee between the City and Port also provides an opportunity for the two agencies to collaborate on additional items of shared interest. On March 18, 2024, the Council identified the following important topics of interest to both organizations.
1. Streets and Infrastructure Projects and Funding Opportunities
2. Traffic Improvements and efforts
3. Security of the Port and of the Community
4. Clean Technology that Helps Improve Our Environment and Mitigate Impacts This agenda item provides the City Council with the opportunity to provide direction to the committee members regarding these and any other items appropriate for discussion with the Port.
STRATEGIC PLAN:
Primary Strategic Pillars and Initiatives:
Optimal Levels of Service for Residents and Businesses

TO: Honorable City Council
FROM: James Vega, City Manager
SUBJECT: DREDGING PROJECT UPDATE
RECOMMENDATION:
It is recommended that the City Council receive a report on the City’s dredging project and authorize staff to collaborate with key partners such as the Port, Harbor, Army Corps of Engineers, United States Navy, BEACON, and others to advocate for the project.
BACKGROUND/ANALYSIS:
At the April 2, 2024, City Council meeting, the City Council requested an item at a future meeting to provide an update on the dredging project that impacts Hueneme Beach. Staff has reached out to various agencies and, at the time of writing this agenda item, has meetings scheduled to receive an update from these agencies. Any updates will be provided at the April 15 City Council meeting.
The following is background information related to the history of the dredging project and budgeting process: Congressionally authorized dredging to re-nourish Hueneme Beach started in the 1960’s in order to remedy the negative impacts on regional sand transport and Hueneme Beach resulting from the construction of Naval Base Ventura Harbor, at a minimum rate of at least 1.1 million cubic yards yearly. For the first two decades, biennial dredging re-nourished Hueneme Beach. For nearly four decades, however, the rate of sand bypassing from Channel Islands Harbor significantly decreased. Reportedly the average dredging volume was 1.2 million cubic yards biennially, or approximately 600,000 cubic yards annually between 1996 and 2016. During this time, the City of Port Hueneme saw major beach loss and threats of undermining public access and public infrastructure.
The goal of the County of Ventura is to dredge a minimum of 2.2 million cubic yards biannually. Over the past three dredging cycles, the total sand has been 2.4 million (2023); 1.9 million (2021); and 1.6 million (2019) cubic yards.
According to recent communication with County officials, while the 2025 dredging cycle project has not gone out to bid yet, County staff estimate that to reach the minimum of
2.2 million cubic yards this year it will take $18 to $23 million. There is not full funding Agenda Item No. 08 Page 1 of 3 CC Agenda 04-15-2024

dedicated to the 2.2 million cubic yards currently in the upcoming Fiscal Year 2025 Budget. Historically, each dredging cycle project is half funded in the first Fiscal Year and half funded in the second Fiscal Year. It is important to note that the budget process is in progress, and recent conversations with various parties indicates there are still opportunities for agencies to advocate for funding. The City has had initial discussions with other key stakeholders, and believes that a coalition of stakeholders, including the Port, U.S. Navy, County/Harbor officials, BEACON, and others would be interested in advocating for the priority of this project.
Currently, Fiscal Year 2025 funding totals $8.5 million for the project, of which $8.1 million is to do the actual dredging and $400,000 is for mitigation. The 2025 funding shows only $4.2 million for the project but the money is not for dredging, it is for mitigation. County officials are concerned that if additional funds are not assigned to the project in FY 2025, dredging totals will be limited to less than 1 million cubic yards of dredging. The last time that the dredging numbers got this low 2010-11 and 2012-13, there was a major loss of beach area in the City of Port Hueneme.
Since 2019, the City of Port Hueneme has partnered with the County of Ventura, BEACON, the Navy, and other partners to organize a yearly meeting focused on sand supply and local re-nourishment efforts. In this time, the local community has been successful in lobbying for increases in federal funding to support increased sand bypassing. This success is being challenged again this funding cycle. It is important that the City collaborate with local stakeholders and partners to educate and lobby federal officials to ensure adequate project funding is provided to meet local, regional, statewide, and federal priorities for national security and national defense, local economic development, and sustainable coastal management.
Staff recommends that the Council direct staff at this time to work proactively with these partners to advocate for this project.
FISCAL IMPACT:
Advocating for the dredging project is anticipated to require 20-40 hours of staff time. No additional fiscal impact is anticipated at this time. Updates will be provided as information becomes available.

Re: Support of the Fiscal Year 2025 Community Project Funding/Congressionally Directed Spending for U.S. Army Corps of Engineers Work at Channel Islands Harbor Dear Senator Padilla,
I am writing on behalf of the City of Port Hueneme in support of fiscal year 2025 Community Project Funding/Congressionally Directed Spending for U.S. Army Corps of Engineers work at Channel Islands Harbor.
This project is necessary to meet the needs of the County, Naval Base Ventura County, the Port of Hueneme, and the City of Port Hueneme to protect downcoast Federal and municipal infrastructure and operations through the dredging of the Channel Islands Harbor sand trap. The project also protects the entrance to Channel Islands Harbor, which is a Harbor of Refuge as well as the location of the Coast Guard Search and Rescue station.
The Army Corps regularly dredges the Harbor under legislation that authorized the small craft harbor and sand trap to be built in the early 1960s. The Harbor was designed to trap sand to prevent loss to the submarine canyon off of Port Hueneme and to provide dredged material for beach replenishment for downcoast beaches. The replenishment provides vital shore protection for downcoast facilities, including the Naval installations at Port Hueneme and Point Mugu, the Port of Hueneme, the City of Port Hueneme and Silver Strand beach.
Thank you for your consideration.
Sincerely,
Misty Perez
Mayor
