A motion was made by Councilmember Hernandez to amend the minutes. A point of clarification was made by Mayor Pro Tem McQueen- Legohn to identify where the amendment would be and what it would actually state. Discussion followed.

15. Community Benefit Fund — Establishment of 2025 City Review Process Recommendation: Receive a
summary of the Citizen Advisory Commission' s (CAC)
comments and recommendations regarding the proposed Community Benefit Fund ( CBF) review process and approve a revised procedure for the 2025 CBF process that includes an application process and structured CAC review.
City Manager James Vega presented the report and indicated the possibility of adding a Step 6 to come back and review to make sure that the applicants have done what they have committed to do.
Discussion followed including the following suggestions: provide direction for what level of donation should be requested, include verbiage that clearly identifies this is the City' s process, but it still needs the Port of Hueneme -Oxnard. Harbor District' s (Port) approval; for the Port to have the same process; the process include that the members who represent the City on the City -Port committee come back and report out on the results of the meeting and agendize a discussion; the application include a point of contact besides the organizational name, ask if the organization is a registered nonprofit, and if they are not a non- profit possibly who is their fiduciary agent; include helpful details on the application, such as describing what kind of details are to be provided with the application and the proposed budget; that the applications go to everyone who needs to get them or to as many people as possible and to not eliminate anyone; make sure the CAC is connected to understand what' s
going on in the City so that they know if there' s
any
requirements even outside of the application process; and to clean up language in the settlement agreement regarding shoreline protection.
In response to Council comments and suggestions City Manager James Vega indicated that this is the City' s process and the Port has not expressed that they' dbe changing their process; the challenge is two different agencies have to agree, and that' s always going to be the challenge as it' s written in the contract and we don' thave the power to change that, but the intent is to be a collaborative process; the question regarding whether the organization is a nonprofit is included on the application for additional information, but it is not a determining factor; there is a sentence in the application that tries to explain that this is a City process and not the Port' s
process, but we will try to make that clearer; to help
steer an applicant in the right direction we can include language providing an overview of how much funding is typically available in a year and that typically grants are $ 5, 000 — 10, 000; and that the settlement agreement includes very broad categories but they can be discussed and explored over the next year.
City Attorney Joan Smyth stated she' d have to look into the settlement agreement to see if it could be changed, -but mentioned the possibilities of an amendment, if both parties agree, or anew agreement.
There were no public comments.
