SUBJECT: TREASURER’S QUARTERLY INVESTMENT REPORT
RECOMMENDATION:

It is recommended the City Council receive and file the September 30, 2024 Treasurer’s Reports as presented.

BACKGROUND/ANALYSIS:

The information provided in the attached September 30, 2024 Treasurer Report has been verified to be in conformity with the City of Port Hueneme updated Investment Policy approved by the City Council on September 18, 2023.

The City's cash management system is designed to accurately monitor and forecast expenditures and revenues, thus enabling the City to invest funds to the fullest extent possible. The City attempts to obtain the highest yield obtainable as long as investments meet the criteria established for safety and liquidity. The basic premise underlying the City’s investment philosophy is, and will continue to be, to ensure that money is always safe and available when needed.

The Treasurer Report includes the Investment accounts and the pooled cash accounts.

For the quarter ended September 30, 2024, the total quarterly investment earnings were $1,140,027. The City started the investment with Chandler Management in October 2023; this investment has provided solid returns with an average return of 4.79% or $577,987 in the reporting quarter.

The pooled cash account with Wells Fargo is the funding source for all of the city’s operating and capital investment projects. The decrease in the balance of the General Pool Account from $26.7M to $17.5M or $(9.0) M is mostly due to various large disbursements as follows:
- $4.1 M disbursements related to Bubbling Springs Park Project. ** - $3.5M disbursement to CALPERS for the Unfunded Accrued Liability (UAL) payment.
- $645k for the Pension Obligation Bond due in July

SUBJECT: AMENDMENT TO FISCAL YEAR 2024-25 POSITION AUTHORIZATION

SCHEDULE TO REMOVE THE RETIRED ANNUITANT POSITION AND

RESTORE THE POLICE SUPPORT SERVICES MANAGER POSITION
RECOMMENDATION:

It is recommended that City Council approve an amendment to the City’s Fiscal Year 2024-2025 Position Authorization Schedule to restore the full-time Police Support Services Manager position and remove one retired annuitant position to ensure compliance with CalPERS regulations.

BACKGROUND/ANALYSIS:

The City has had a vacant Police Support Services Manager position for several years.

While the position was vacant, the City utilized a retired annuitant to provide additional support in the Police Department Administration. However, CalPERS regulations make clear that a retired annuitant may only serve for a limited period of time. At this time, it is necessary to remove the retired annuitant position and restore the vacant Police Support Services Manager position. There is an operational need for this position, as it has been a critical position for the Police Department.

Staff recommends that City Council approve an amendment to the City’s Full-Time Employee Count to remove the retired annuitant and restore the Police Support Services Manager position, so that the position may be filled to provide the needed support and for the City to better comply with CalPERS regulations.

To ensure a smooth transition, the Retired Annuitant will work alongside the Police Support Services Manager for one month, facilitating a proper handoff of responsibilities and ensuring continuity in operations. This can be done with existing budget approval.

SUBJECT: ADOPT A RESOLUTION GRANTING CONDITIONAL PERMIT NO. PHCU24-1 TO ALLOW THE INSTALLATION OF A 45-FOOT-TALL STEALTH

WIRELESS COMMUNICATION TOWER TO BE LOCATED WITHIN A

LANDSCAPE COMMON SPACE CORRIDOR ABUTTING THE
RESIDENTIAL UNIT LOCATED AT 193 W. GARDEN GREEN AND FIND

THE PROJECT EXEMPT FROM CEQA
RECOMMENDATION:

It is recommended the City Council:

1. Open the public hearing to take testimonial and documentary evidence; and

2. Close the public hearing and consider the evidence; and

3. Adopt a Resolution approving Conditional Use Permit No. PHCU-24-1 (Hueneme Bay Wi-Fi Tower); and

4. Find the project (Conditional Use Permit No. PHCU-24-1) to be categorically exempt from CEQA; and

5. Take such additional, related, action that may be desirable.

BACKGROUND/ANALYSIS:

Mr. Michael Taylor, representing WiFi Harbor, LLC. (“Applicant”), is requesting approval to install a proposed wireless telecommunications facility, consisting of a 45-foot height pole and ancillary electrical equipment within a residential landscape common space corridor abutting the residential unit located at 193 W. Garden Green.

Pursuant to Municipal Code Section 10422(I), a Conditional Use Permit is required for new public utility facilities erected within the Limited Multifamily Zone R-2 zone. The project site is zoned R-2 (Limited Multifamily) and is located in a Planned Development (PD) Overlay.

The project site is located within the Carefree Living Association of Hueneme Bay residential community surrounded to the north by Triton Street, with single-family homes Agenda Item No. 06 Page 1 of 45 CC Agenda 11-04-2024

and Hueneme Bay multi-family residential dwellings, to the east by Hueneme Bay multifamily dwellings, to the south by Triton Street, with multi-family dwellings, and to the west by the Sandpiper II multi-family residential community.

To provide an alternative internet broadband service to the residents of Carefree Living Association of Hueneme Bay, the applicant is proposing to install a new wireless telecommunications antenna on top of a utility pole within a residential landscape common space corridor abutting the residential unit located at 193 W. Garden Green. A new equipment cabinet will also be installed within the exterior wall of the residential unit located at 193 W. Garden Green.

On July 11, 2024, the Carefree Living Association of Hueneme Bay unanimously approved the project (a letter from the HOA is included within Attachment B). On July 19, 2024, the applicant entered into a lease agreement with the Carefree Living Association of Hueneme Bay for the installation of the tower, associated equipment, and energy charges for using the HOA common area. The applicant shall adhere to all Federal Communications Commission (FCC) regulations pertaining to antenna installations, including emissions standards, as well as all regulations set forth by the California Public Utilities Commission (CPUC) regarding operating requirements.

The wireless communications facility consists of a 45-foot utility pole equipped with one Wi-Fi broadcasting antenna mounted to face southeast. To comply with the stealth requirements of Municipal Code Section 10203(K) - Architectural Features for Antenna the utility pole will be powder-painted light grey to match surrounding utility/ lighting poles and feature a decorative light grey Raycap wireless communication concealment topper.

Lastly, the facility will operate by underground fiber optics and electric conduit terminating at the new equipment cabinet which will be painted to match the multi-family residential building.

Accompanying this report are exhibits depicting the site plan, antenna details, and elevations (Attachment B).

California Environmental Quality Act (CEQA)
With regard to environmental review, staff recommends the Council find the project exempt from CEQA. This exclusion is set forth in CEQA Guidelines (14 California Code of regulations §§ 15000, et seq.) § 15303, which states: “Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures.” As discussed above, the applicant proposes installing a wireless communication tower within a developed residential community which allows the installation of public utility facilities. Therefore, the project will not have a substantial impact on the environment and is thus, exempt from CEQA.

FISCAL IMPACT:

There will be no fiscal impact associated with this application.

Updates to Zoning Ordinance
November 4, 2024

Page 2 ends

BACKGROUND/ANALYSIS:

This is the first of a series of proposed amendments to Article X of the Port Hueneme Municipal Code – the “Zoning Ordinance”.

Over the past several years, the state of California has continued to pass revised and new legislation related to the production of new housing units for a variety of household types and different income levels. In 2024 alone, the Governor signed over 20 new housing-related laws into effect. Some of these require that each jurisdictions’ zoning ordinances be updated accordingly.

In addition, the Council approved a comprehensive update to the City’s General Plan, including a new Housing Element, in October 2021 (with the Housing Element being approved by the state’s Department of Housing and Community Development (“HCD”) in October 2022). The Housing Element contains 21 programs to facilitate maintenance and preservation of existing housing units, and for the creation of new ones. To date, 13 of these programs have either been completed or are ongoing and two others will be completed within the next six months by staff. However, the remaining require amendments to the Zoning Ordinance and changes to the zoning of certain properties identified in the General Plan Land Use Map, all of which will require City Council approval.

Due to the number of proposed Zoning Ordinance Amendments, staff anticipates bringing these items to the City Council for review and action over the course of several meetings throughout the rest of 2024. The items being presented this evening are generally “cleanup” items to bring the City into compliance with recent state law with regard to these items.

The items requiring more substantial review and public input will be scheduled for the upcoming City Council meetings.

Port Hueneme Municipal Code Section 10006 requires that any change that may affect the land uses of properties situated in the Coastal Zone constitute amendment to the City’s Local Coastal Program (LCP). Therefore, since the some of the amendments to be acted upon by the city Council would affect properties in the City’s Coastal Zone, the City’s LCP will also require amendment. Staff anticipates completing the LCP amendment in Spring 2025, and will bring it back to the City Council for review at that time.

Further, with the recent City Council approval of the City’s first Economic Development Plan, and to clean up portions of the Zoning Ordinance to benefit the community in general, staff will also be bringing several other types of recommended Zoning Ordinance Amendments to the City Council for consideration. The items being included tonight pertain to increasing the time a business may have a temporary banner installed and increasing the number of garage sales allowed per household.

Finally, included within all of the recently passed housing-related legislation, the state also passed Assembly Bill (AB) 2904, which increases the public noticing period for Agenda Item No. 07 Page 2 of 29 CC Agenda 11-04-2024

ordinances that could affect the permitted use of real property from 10 days to 20 days.

Consequently, the Zoning Ordinance will require amendment to address this new law.

The proposed revisions are discussed in further detail, below.

Housing-Related Amendments
Employee Housing and Supportive Housing
Employee Housing - The Employee Housing Act of 2015 can be found in Sections 17000- 17062.5 of the Health and Safety Code and requires developments providing housing for six or fewer employees be treated as a single-family residence and be allowed by right.

Supportive Housing - Assembly Bill 2162 was passed in 2018 and contains standards for the development of supportive housing, including requiring that this type of housing be a use by right where multi-family dwellings are permitted, subject to meeting certain criteria.

All five of the City’s residential zones already permit supportive housing developments for six or fewer residents by right and allow supportive housing developments for seven or more residents, subject to a Conditional Use Permit (CUP). However, AB 2162 does not differentiate between the numbers of residents in a supportive housing development when requiring the use be allowed by right.

Therefore, to ensure the Municipal Code is up to date regarding employee and supportive housing, and to ensure future applications for supportive housing developments are designed and processed per state law, staff recommends the following amendments be made to the various residential zones’ land use tables (note: the tables for the R-4, Mixed Use Residential Zone, are not provided, since a comprehensive overhaul of these standards will be presented to the City Council at their November 18 meeting).

R-1 – Single-Family Zone:

F. Supportive housing as defined and allowed per Government Code Section 65650 et. seq., and as it may be amended from time to time;
Approval of these amendments will provide compliance with Housing Element Program

16. Affordable Housing
The majority of the laws put into effect by the state pertain to making it easier to develop housing units that are affordable to lower-income households. To ensure compliance with this legislation, the following amendments are recommended:

Density Bonus
The City Council approved a comprehensively updated Density Bonus Ordinance in May 2024. Since that time, one minor change to the state’s density bonus laws was approved, to specify the definition of “senior housing development” also includes “residential care facility”. Although the City’s new Density Bonus Ordinance makes reference to the state’s regulations, since the remainder of the housing-related amendments are being processed at this time, staff also recommends PHMC Section 10803(E)(1)(a) be amended to clarify the latest state law as follows:
10803(E)(1)(a):

E. Specific Requirements.

1. Senior Citizen Housing Requirements.
a. Senior citizen housing development projects, which shall include a shared housing building development and a residential care facility for the elderly, as defined in Section 1569.2 of the Health and Safety Code, shall have a minimum of thirty-five (35) units and shall meet the requirements described in Sections 51.3 and 51.12 of the California Civil Code or any successor statute or regulation.

Inclusionary Housing
Currently, PHMC Section 10804, the City’s Inclusionary Housing Ordinance, requires all coastal development involving the construction or conversion of ten (10) or more residential dwellings to provide at least 25 percent of the units for low- and moderateincome households, or pay an in-lieu fee, which will then be used to fund other affordable housing projects in the City (for example, in-lieu fees were provided to Habitat for Agenda Item No. 07 Page 5 of 29 CC Agenda 11-04-2024

Humanity to assist fund their 5-unit project on San Pedro Street). Housing Element Program 9 calls for the inclusionary housing program to apply throughout the entire City of Port Hueneme. Therefore, to ensure compliance with this Housing Element Program, it is recommended Section 10804(A) of the Inclusionary Housing Ordinance be amended as follows:

A. Applicability. The inclusionary housing provisions of this section shall apply to all coastal development involving the construction or conversion of ten (10) or more residential dwellings. All such projects shall be subject to the development review requirements of Chapter 3.

Miscellaneous Amendments
Public Hearing Noticing
Until recently, the standard public noticing period for most public hearings involving zoning-related matters has been a minimum of 10 calendar days. This is stated in PHMC Sections 10352(F)(1) and 10353(D). However, Assembly Bill (AB) 2904, which took effect in September 2024 now requires a 20-day public noticing period for ordinances and amendments which will affect the permitted uses of real property. Therefore, to ensure compliance with this recently passed state legislation, staff recommends PHMC Sections 10352(F)(1) and 10353(D) be revised as follows:

Section 10352(F)(1)

1. Notice. Notice of the hearing shall contain a statement setting forth a description of the property under consideration, the nature of the project, and the time and place at which a public hearing or hearings on the matter will be held and shall be given in the manner specified below not less than ten (10) days prior to the date of the first of such hearings which may be conducted on the project, and for projects which include an ordinance or amendment that will affect the permitted uses on real property, shall be not less than twenty (20) days prior to the date of the first of such hearings which may be conducted on the project:

Section 10353(D):

Staff Review. The Development Review Committee shall be convened within twenty-one (21) days of the date of filing pursuant to Section 10353(C) for the purpose of rendering a decision on the project. A notice indicating the time and place at which the Development Review Committee will consider the matter shall be given in the manner prescribed in Section 10352(F)(1)(b) no later than ten (10) days prior to the date of the meeting of the Development Review Committee, and for projects which include an ordinance or amendment that will affect the permitted uses on real property, shall be not less than twenty (20) days prior to the date of the meeting of the Development Review Committee.

Garage Sales
Currently, the City allows a resident/household to conduct one, two-day garage sale per year. Staff has received several requests to allow at least one additional garage sale per Agenda Item No. 07 Page 6 of 29 CC Agenda 11-04-2024

Page 7 ends

family per year. This should not be a concern for Code Compliance reasons and therefore, staff recommends PHMC Section 10277 be revised as follows:
10277 - License or permit required.

Any person wishing to conduct a home occupation as defined in Section 10276 must obtain a business license pursuant to Article V of this code. Any person wishing to conduct a up to two garage sales per year shall be limited to a maximum of two days per yearevent and shall first obtain a Ministerial Permit pursuant to Section 10354.

Temporary Signs
The City currently allows one banner per business for no more than 21 days per year.

Staff surveyed the temporary sign regulations for the other cities in Ventura County, which are noted in the table below:

City Temporary Sign Standards
Port Hueneme 1 sign/business for up to 21 days per year Camarillo 4x/year, 30 days per event, 30 days between each event, 36 sq. ft. max. sign size
Fillmore 4x/year, 21 days per event
Ojai 4x/year, 30 days per event, 24 sq. ft. max. sign size Oxnard 30 days per year
Santa Paula 60 days per year
Simi Valley 8x/year, 16 days per event, 50 sq. ft. max. sign size Thousand Oaks 4x/year, 10 days per event, 60 sq. ft. max. sign size Ventura 90 days/year, not to exceed 30 consecutive days/event Port Hueneme’s temporary sign standards are more restrictive than all of the other cities in Ventura County. With the recent approval of the City’s first Economic Development Plan, the City has started to take steps to attract new businesses and jobs while maintaining and assisting existing businesses in the City.

One way in which the City could help assist and support its businesses is through an extension of low-cost but visible advertising for the businesses by allowing banners to be installed for periods longer than 21 days per year. At the same time, it is important to ensure the temporary banner regulations will not result in sign clutter, which would reduce the aesthetic value of the City’s business centers and areas.

Therefore, it is recommended that the City’s Temporary Sign standard be amended to allow each business to install one temporary sign (ground-mounted or mounted on the building) once per quarter for up to 30 days per quarter (120 days per year total). Thus, Port Hueneme Municipal Code Section 10303(E)(1)(b) would be amended as follows:

E. Design Standards. General requirements and limitations for all signs regardless of their location are as follows:

1. General Restrictions.
b. Banners, pendants, flags, captive balloons, or signs which change color or appear to change color, or where the intensity of light changes or appears to change are permitted only for the purpose of a grand opening, under new management or other special event; provided, however, that the use of such signing shall not exceed a period of twenty-one (21) days per year for all events inclusivefor each business located in a commercial, mixed use residential or industrial zone for a period not to exceed 30 days per quarter each year, subject to one freestanding sign being located adjacent to the subject business’ main entry or being attached to the subject business structure, and subject to obtaining a Temporary Sign Permit from the Community and Economic Development
Department.

California Environmental Quality Act (CEQA)
Pursuant to the California Environmental Quality Act ("CEQA"), these Ordinances are exempt pursuant to Title 14 California Code of Regulations Section 15061(b)(3), which exempts projects where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. These Ordinances by themselves will not result in new development. Any new development will be required to be vetted through project-specific CEQA analysis.

FISCAL IMPACT:

The revised Code Amendments will not have a fiscal impact on the General Fund.

The applicant, the City of Port Hueneme, is proposing amend the following sections of the Port Hueneme Municipal Code, Article X: 10277, 10303(E)(1)(b), 10352(F)(1), 10353(D), 10401(E) and (G), 10402(A), 10421(F) and (H), 10422(A), 10441(F) and (H), 10442(B), 10471(D) and (F), 10803(E)(1)(a), and 10804, pertaining to garage sales standards, temporary signs, public hearing noticing, and affordable housing-related items as required by the state of California, respectively (Case No. PHZ-24-2).

Agenda Item No. 07 Page 29 of 29 CC Agenda 11-04-2024
DATE: November 4, 2024
TO: Honorable City Council
FROM: James Vega, City Manager
Charles Peretz, Deputy City Manager
SUBJECT: CITY COUNCIL REPRESENTATION ON REACH (RECREATION,

EDUCATION, ACTIVITIES AND CULTURE IN HUENEME) BOARD OF

DIRECTORS
RECOMMENDATION:

It is recommended that the City Council authorize REACH to eliminate the City Council appointed position to the REACH board of directors.

BACKGROUND/ANALYSIS:

In 2015, the City Council approved a variety of actions necessary to create REACH (Recreation, Education, Activities and Culture in Hueneme), a non-profit corporation serving the Port Hueneme community. The non-profit was borne from efforts to initiate and expand community events, activities and programs. The organization’s bylaws were created with the intent that the Board of Directors would be comprised of representatives from specific agencies or boards.

Since its inception, the bylaws have been amended and the composition of the board has been changed several times. In 2018, the bylaws were amended to remove the requirement that the nine-person board include a representative from the Oxnard Harbor District, Chamber of Commerce and (defunct) Recreation and Fine Arts Commission representative. Earlier this year, the bylaws were further amended to remove the requirement that one of the board positions be reserved for the City Manager or his/her designee. As such, the current board composition consists of eight residents of, or individuals employed within, the City of Port Hueneme, and one member of the City Council.

The REACH board has recently considered amending the bylaws to remove the requirement to have one of the board seats filled by a representative of the City Council.

As a non-profit entity, REACH is an autonomous organization. Maintaining a requirement to have representation from the City Council has the potential to create confusion and, in the past, this has led some people to question whether REACH falls Agenda Item No. 08 Page 1 of 2 CC Agenda 11-04-2024
REACH Composition
November 4, 2024

Page 2 ends

under the City’s purview. Further, the organization has undergone recent changes and the non-profit board has found it essential to reconstitute itself as a working body.

REACH has concluded that its interests are best served by having persons most interested in the mission of REACH serve on its board.

The City Council is being asked to consider REACH’s proposal to amend its bylaws to remove the requirement to have a City Council representative on the board before the board takes formal action. It should be noted that such an amendment would not preclude an interested City Councilmember from serving on the board in their individual capacity. Presently, City Councilmember Martinez is the Council’s designated representative on the REACH board. Councilmember Martinez is not running for reelection and will not be on the City Council after the December 4, 2024 meeting. As such, if the City Council feels strongly that the City’s best interests are served by having a Council representative on the REACH board, it should take action to appoint a new representative.

Agenda Item No. 08 Page 2 of 2 CC Agenda 11-04-2024
DATE: November 4, 2025
TO: Honorable City Council
FROM: James Vega, City Manager
SUBJECT: 2025 CITY COUNCIL MEETING SCHEDULE
RECOMMENDATION:

It is recommended that City Council approve the proposed 2025 City Council meeting schedule.

BACKGROUND/ANALYSIS:

The City Council meets regularly at 6:30 p.m. on the first and third Monday of every month. A regular meeting schedule facilitates public participation in City Council meetings by providing a consistent and predictable schedule of meetings, at times which are convenient for the public to attend. This consistency contributes to the public trust, allows for full compliance with the Brown Act to meet noticing deadlines, and helps ensure transparency in city governance.

In general, the proposed 2025 City Council Meeting schedule follows the regular first and third Monday meeting schedule. However, there are some meeting dates where the first or third Monday is impacted by a holiday, and the meeting is recommended to be scheduled for the following Tuesday or canceled.

One change proposed by the City Manager is to modify the summer recess schedule. A summer recess allows Councilmembers and staff the opportunity to have a break from meetings in order to focus on other projects, or have a scheduled break; which helps to avoid absences at other times throughout the year.

Rather than following the past practice, which was to go “dark” in the month of August, this year, staff is proposing that the City go “dark” the first meeting in July and the first meeting in August. This still provides a break but reduces the maximum amount of time between meetings, which is intended to reduce the likelihood of a need for a special, unplanned meeting. The first meeting in July is also around Independence Day in which many people travel or take vacations and the first meeting in August is a time where families are taking final vacations before heading back to school. More importantly, it will Agenda Item No. 09 Page 1 of 7 CC Agenda 11-04-2024
2025 City Council Meeting Schedule
November 4, 2025

Page 2 ends

allow the City to conduct business and engage with the public more regularly instead of having to wait for a prolonged period of time.

The regular meetings that would not fall on first or third Monday are included below:

Meeting Date Proposed Revised Date Recommendation
Monday, January 6, 2025 None Cancel due to holiday
Monday, January 20, 2025 Tuesday, January 21, 2025 Reschedule due to holiday Monday, February 17, 2025 Tuesday, February 18, 2025 Reschedule due to holiday Monday, July 7, 2025 Summer Recess 1 of 2 Summer Recess 1 of 2 Monday, August 4, 2025 Summer Recess 2 of 2 Summer Recess 2 of 2 Monday, September 1, 2025 Tuesday, September 2, 2025 Reschedule due to holiday Due to the holidays, staff recommends canceling the Monday, January 6, 2025, City Council meeting. This follows past common practice of canceling the first meeting of the year, given the likelihood that many Port Hueneme residents and business owners will be either out of town or otherwise engaged for the holidays, and it is unlikely to expect full public participation.

Staff also recommends Council approve the continued practice of scheduling Tuesday meetings for those dates which fall directly on a holiday. This year holidays that fall on a Monday, and are being proposed as rescheduled Tuesday meetings, are:
• Martin Luther King Day (1/20/2025)
• Presidents’ Day (2/17/2025)
• Labor Day (9/1/2025)
Finally, as stated previously, staff recommends going “dark” the first week of July (Monday, July 7, 2025) and the first week of August (Monday, August 4, 2025) to allow for a summer recess; which helps to avoid absences at other times throughout the year.

The City of Port Hueneme benefits from having all five Council Members present at each meeting, and prioritizes a meeting schedule that allows for full public participation to assure a transparent government process. Canceling or rescheduling any City Council meeting throughout the year does not have to delay a Council decision, as all issues that would otherwise have been addressed will be heard at other regular meetings, or at a special meeting called for the Council, in the event that time-sensitive items need to be addressed. Additionally, Council typically holds a number of special meetings, study sessions, and workshops throughout the year; thus, the public has ample opportunities to address the Council on items not on the agenda and the Council has plenty of opportunities to request items without unreasonable delays by any rescheduled meetings or cancellations.

The recommended schedule reflects the City’s dedication to meeting transparency and upholds the Council’s priority to ensure maximum public participation. Upon approval of Agenda Item No. 09 Page 2 of 7 CC Agenda 11-04-2024

Alternatively, the City Council could decide to modify any proposed meeting dates or choose to continue with the current practice of identifying the month of August as the Summer Recess. Staff recommends adopting the proposed meeting schedule as described above.
