6. Consider introduction of an ordinance adding Chapter 10 to Article V of the Port Hueneme Municipal Code Regulating Short-Term Rentals
Comments:
Section 5668 Density Cap
a) The number of short-term rental permits issued by the City shall not exceed ten percent (10%) of the City’s total housing units. Google states that the City has 8,295 housing units. Ten percent would allow 830 STRs which seems quite high for the size ofthe City. The City has 4.4 sq. miles of land area. The Naval Base and the Port of Hueneme occupy 2.6 square miles which leaves 1.8 square miles for STRs to be permitted. There is 0.2 square miles of area incorporating the housing units from Port Hueneme Road to the beach. The housing units by the beach appear to be the most desirable ones to permit STR use.
Recommendation: Limit STR use in each HOA, throughout the City, to 10% of the HOA’s units.
Section 5669 Separation Requirement
Separation Requirement: To prevent over concentration, the ordinance establishes minimum spacing between STRs: 100 horizontal feet in R-2 and R-3 zones, and 200 horizontal feet in R-1 and all other zones, measured from parcel lines.
b) Notwithstanding any language in this subsection to the contrary, the one hundred (100) foot and two hundred (200) foot separation requirements shall not apply to a dwelling unit within a multi-unit development: 1. That is subject to the Vacation Ownership and Time- share Act of 2004 (Cal. Bus. & Prof. Code, Section 11210 et seq.); and 2. That became subject to the Vacation Ownership and Time- share Act of 2004 on or before January 1, 2019.
The stated language measures the distance from parcel line to parcel line which may work well for single family homes located on flat land.
In HOA multi-unit developments, the units have definedspace which establishes the location of the unit. Units have been built over other units whereby multiple STRs can be permitted at the same vertical location ifthe limitation of 100 horizontal feet is applied.
Recommendation: Change the language to state “ To prevent over concentration, the ordinance establishes minimum spacing between STRS: 100 feet horizontal and vertical feet in R -2 and R-3 zones, and 200 horizontal feet in R-1 and all other zones, measured from ownership area or parcel lines.”
