PROCESSING FEES TO CUSTOMER
RECOMMENDATION:
It is recommended that the City Council adopt a resolution to authorize staff to impose a processing fee for cost recovery of fees incurred by customer use of credit cards, debit cards and electronic checks.
BACKGROUND/ANALYSIS:
The City of Port Hueneme accepts over-the-counter, over-the-phone and online payments via credit/debit card, and sometimes e-Check, depending on the fee type. The City uses a third-party payment processing service provider that charges a service fee for these payments and the City’s General Fund has been absorbing the service fees on behalf of the customer, subsidizing these payment methods. Most cities, including neighboring cities, implemented a pass through in recent years to ensure that all taxpayers are not subsidizing credit card fees of an individual.
California Government Code 6159 states that a “public agency may impose a fee for the use of a credit or debit card or electronic funds transfer, not to exceed the costs incurred by the agency or agent in providing for payment by credit or debit card or electronic funds transfer”. Staff proposes implementing such a fee, and will continue to evaluate each area in which the City accepts credit/debit card and electronic payments to ensure the processing fees charged continue to fall in line with actual costs incurred.
The City also offers, and will continue to offer, ‘no cost’ payment options to our customers.
Customers will have options to avoid these fees if desired. There are several payment methods available that do not incur a processing fee:
- Cash, check or money order payments made in person at City Hall - Automatic-Payments (Auto-Pay/ACH payments) linked to bank account information - Check or money order payments mailed or placed in the City Hall drop box Agenda Item No. 03 Page 1 of 7 CC Agenda 12-15-2025

December 15, 2025
FISCAL IMPACT:
Revenue collected through a processing fee for cost recovery of credit card, debit card and electronic check fees would off-set a majority of the $140,000 of fees paid by the City annually. Staff will continue to monitor fees imposed as they change to ensure the processing fee is adjusted accordingly.

SUBJECT: ADOPTION OF A DONATION ACCEPTANCE POLICY
RECOMMENDATION:
It is recommended that the City Council adopt the attached Resolution entitled, “A Resolution of the City Council of the City of Port Hueneme, California, Adopting a City Donation Acceptance Policy.”
BACKGROUND/ANALYSIS:
This item was requested by City Council on October 6, 2025. The request was to provide Council with a formal policy for reviewing and accepting donations made to the City. At the time of the request, staff noted a policy was already in progress and would be brought forward to Council when completed. In preparing the proposed policy, staff also reviewed donation acceptance policies adopted by other municipalities to incorporate common standards and best practices.
The City currently maintains Administrative Policy A-005 – Acceptance of Gifts, Gratuities, and Tickets/Passes (Attachment C), which provides guidance on gifts offered to City employees and on the distribution of tickets and passes. While A-005 provides direction for employee-level gift handling, it does not appear to establish a Citywide policy for evaluating monetary or in-kind donations offered to the City as an organization. A Donation Acceptance Policy is therefore needed to supplement A-005 and ensure consistency, transparency, and alignment with City goals when accepting donations of any type.
The proposed Donation Acceptance Policy (Attachment A):
• Establishes definitions for donations, donors, in-kind contributions, and required documentation.
• Creates clear criteria for determining whether a donation aligns with City goals and can be accepted.
• Confirms the City’s authority to decline any donation that does not meet policy standards or is not in the best interest of the City.

• Requires a Donation Acceptance Form (Attachment B) for all proposed donations to ensure consistent review and documentation.
• Requires City Council approval at the soonest available City Council meeting for donations exceeding $5,000 or for donations involving construction, installation, or improvements to City property.
• Supplements, but does not replace the current Gift Policy A-005, ensuring both policies operate together to regulate gift and donation practices at different levels of City operations.
FISCAL IMPACT:
None. This item does not require an expenditure of funds.

DATE: December 15, 2025
TO: Honorable City Council
FROM: James Vega, City Manager
Zachary Frum, Police Officer
SUBJECT: CALIFORNIA DEPARTMENT OF JUSTICE (CA-DOJ), TOBACCO GRANT
PROGRAM
RECOMMENDATION:
It is recommended that the City Council take the following action:
1. Adopt a resolution of the City Council of the city of Port Hueneme, California, authorizing the City’s participation in the Tobacco Grant program by accepting funds in the amount of $156,657; and
2. Accept the awarded CA-DOJ Tobacco Grant Program funds subject to the terms and conditions specified in the grant agreement, and authorize the City Manager or his designee, to sign the agreement and any related documents; and
3. Appropriate the FY2025-26 portion of grant revenue in the amount of $52,219 and $5,278 in expenditures with a positive revenue impact of $46,941 to the General Fund.
BACKGROUND/ANALYSIS:
In June of 2025, staff applied for the State of California Department of Justice (CA-DOJ) Tobacco Grant to cover the cost of officers assigned to Tobacco Retailer Inspections, Minor Decoy Operations, and Undercover Buy Operations.
On November 20, 2025, the Department was notified it was selected to be awarded $156,657. The grant cycle term is July 1, 2025 to June 30, 2028.
The Port Hueneme Police Department is dedicated to excellence in public safety through superior police services that foster a safe community and strengthen partnerships with residents and local retailers. The Department’s commitment to the citizens of Port Hueneme drives efforts to prevent crime, solve offenses, and maintain peace, prioritizing the safety of both the public and officers.
The Community Resources Unit, part of the Investigative Services Division, is initiating a tobacco enforcement program and is seeking funding for officers focused on tobaccoAgenda Item No. 05 Page 1 of 13 CC Agenda 12-15-2025 CA-DOJ Tobacco Grant Program

related enforcement. This includes compliance checks for tobacco retailers, enforcing the California Flavor Ban, and conducting minor decoy operations.
The primary objective is to ensure that retailers comply with regulations regarding product display, sales, and proper signage. The program plans to reduce the sale of tobacco and tobacco-related products to individuals under 21 by utilizing underage decoys to purchase these products from local retailers. Additionally, undercover officers will be deployed to investigate the sale of banned tobacco products by retailers in Port Hueneme.
Each operation will be meticulously documented with safety plans in place, and any violations will be reported to the Ventura County District Attorney's Office for prosecution.
Grant Project Summary
Traditional Tobacco use (cigarettes) has declined, e-cigarettes and new flavored tobacco products remain a concern. The California Healthy Kids Survey (2023/2024) revealed that 14% of local eleventh graders reported using vape products, and 91% felt it was “very easy” to obtain vaping products. During a recent informal walkthrough of all of our Tobacco Retailers, the vast majority of tobacco retailers sell flavored tobacco products.
To address these issues, the Tobacco Grant provides funding to law enforcement agencies for educating, preventing, and enforcing laws related to the sale of flavored tobacco products, vaping/e-cigarettes products, and all other tobacco products to minors.
The program aims to inform local businesses about the risks of selling these products to minors, the consequences of selling banned items, and to prosecute those who violate these laws.
This grant offers salary reimbursements for officers assigned to operations such as Tobacco Retailer Inspections, Minor Decoy Operations, and Undercover Buy Operations.
These operations aim to reduce underage tobacco sales and enforce related laws.
The Port Hueneme Police Department is committed to protecting residents from the illegal sale of banned tobacco products and the sale of tobacco products to minors. The Department's goal is to reduce the sale of banned tobacco products and tobacco products to minors through stronger education and enforcement efforts in Fiscal Year 2025-2026.
No City match is required, and all funds are planned for expenditure by the June 30, 2028, deadline.
FISCAL IMPACT:
The grant funds will cover all expenses required to meet the objectives of the grant.
Approval of this action would require an appropriation of revenue funds in the amount of $52,219- $46,941 to the General Fund State & Local Grant account #101-000-4701 to reimburse personnel costs and $5,278 to the Grant Fund revenue account #210-000- 4701 & expense account 210-440-5204 for the purchase of small equipment and legal services.

Re: Tobacco Grant Award Notification Fiscal Year 2025-26 (RFP: DOJ-PROP56-2025-26-1) Dear: Officer Frum
Congratulations! On behalf of the California Department of Justice (DOJ), Tobacco Grant Program, I am pleased to inform you that your agency’s grant application for the fiscal year 2025-26 grant cycle has been approved for grant funds authorized under the California Healthcare, Research and Prevention Tobacco Tax Act of 2016. The total amount of your agency’s grant award is $156,657 under Award # DOJ-PROP56-2025-26-1-040.
The Tobacco Grant Program award process is highly competitive, and for the 2025-26 grant cycle, the Department received approximately $50 million in requests. As noted in the application materials, grant funding prioritized support for local retailer enforcement including prosecution and task force collaboration. Consequently, some awards were approved with modifications to align with these funding priorities and because of limited funds. Attached is a Summary of the Award and Budget Detail outlining the funding provided along with any modifications applied.
To accept the 2025-26 grant award, please complete and return a signed copy of your Letter of Intent (see template and instructions attached) by email within 15 calendar days of the date of this letter. This letter will affirm one of the following:
1. Your agency will seek a resolution from the governing body to accept the award (if your agency has a governing body)
2. Your agency has a governing body but does not require a resolution to accept the award, OR
3. No governing body exists and therefore no resolution is required.
Please email the signed Letter of Intent as noted above to [email protected] with the subject line including the name of your agency: “FY 25-26_Letter of Intent_Port Attachment B

These documents will contain more information about the process for reimbursement and other important details. Activities for reimbursement under this grant may commence on or after the date of this letter, depending upon your selected start date.

TO: Honorable City Council
FROM: James Vega, City Manager
SUBJECT: APPOINTMENT OF CITY ATTORNEY AND APPROVAL OF LEGAL
SERVICES AGREEMENT WITH ALESHIRE & WYNDER
RECOMMENDATION:
It is recommended the City Council authorize the City Manager to execute an agreement with Aleshire & Wynder, LLP for legal services and appoint Paul Early, Esq. as the City Attorney.
BACKGROUND/ANALYSIS:
On September 15, 2025, the City Council initiated a formal Request for Proposal Process to obtain proposals to serve as the City Attorney. A Request for Proposals (RFP) was issued, requesting law firms with municipal law expertise to submit proposals to provide comprehensive legal services to the City.
The RFP outlined the City’s legal needs, which include general municipal law, land use, litigation, and other specialized areas. Firms were asked to demonstrate their qualifications, experience with public agencies, and ability to provide responsive, costeffective legal service.
Following the submission period, the City Council reviewed the proposals, conducted interviews with selected firms, and evaluated candidates based on experience, qualifications, responsiveness and ability to respond to operational needs. After a thorough review process, the Council selected Aleshire & Wynder, LLP as the most qualified firm to serve as City Attorney.
The proposed agreement with Aleshire & Wynder, LLP establishes a five-year term beginning December 16, 2025. The agreement designates Paul Early, Esq. (a Partner with the firm) as the City Attorney and outlines a comprehensive scope of services, including attendance at City Council meetings, legal advice to the City Council and staff, review of ordinances, contracts and other legal documents, representation in litigation and code enforcement matters, and monitoring of relevant legislation. Compensation is as follows: A (discounted) retainer for Mr. Early is proposed with a monthly fee of $11,500 ($287.50 per hour). Additional hours range from $285 to $325 for general services Agenda Item No. 06 Page 1 of 42 CC Agenda 12-15-2025

Reimbursable costs shall be separately itemized.
Payments shall be made by City within thirty (30) days of receipt of the statement; except for those specific items on an invoice which are contested or questioned and are returned by City with a written explanation of the question or contest, such payment for the specific items shall be made by City within thirty (30) days of receipt of a corrected invoice.

Therefore, A&W shall not contract with any other person or entity to perform, in whole or in part, the legal services required under this Agreement without the prior written approval of City. In addition, neither this Agreement, nor any interest herein, may be transferred, assigned, conveyed, hypothecated, or encumbered voluntarily, or by operation of law, whether for the benefit of Agenda Item No. 06 Page 6 of 42 CC Agenda 12-15-2025

9. INDEPENDENT CONTRACTOR
A&W shall perform all legal services required under this Agreement as an independent contractor of City, and shall remain, at all times as to City, a wholly independent contractor with only such obligations as are required under this Agreement. Neither City, nor any of its employees, shall have any control over the manner, mode, or means by which A&W, its agents or employees, render the legal services required under this Agreement, except as otherwise set forth. City shall have no voice in the selection, discharge, supervision or control of A&W employees, servants, representatives, or agents, or in fixing their number, compensation, or hours of service, except as otherwise set forth in this Agreement.

A&W shall procure and maintain, at its sole cost and expense, in a form and content satisfactory to City, during the entire term of this Agreement, including any extension thereof, the following policies of insurance. A&W shall provide City, not later than the effective date of this Agreement, certificates of insurance and an underwriter’s endorsement for each coverage mentioned below. A&W shall also provide City with new certificates of insurance if any changes in coverage or carriers is made, within 30 days of any such change:
(a) Comprehensive General Liability Insurance. Insurance written on a per occurrence basis to protect A&W and the City against liability or claims of liability which may arise out of this order in the amount of two million ($2,000,000) per occurrence and subject to an annual aggregate of four million ($4,000,000). There shall be no endorsement or modification of the CGL limiting the scope of coverage for either insured vs. insured claims or contractual liability. All defense costs shall be outside the limits of the policy.
(b) Workers’ Compensation Insurance. For all of A&W’s employees who will provide services under this Agreement and to the extent required by applicable State or federal law, A&W shall keep in full force and affect a Workers’ Compensation policy.
That policy shall provide a minimum of one million ($1,000,000) of employers’ liability coverage, and A&W shall provide an endorsement that the insurer waives the right of subrogation against the City and its respective elected officials, City Council, council members, officers, employees, agents and representatives. In the event a claim under the provisions of the California Workers’ Compensation Act is filed against the City by a Agenda Item No. 06 Page 7 of 42 CC Agenda 12-15-2025

(c) Automobile Insurance. A&W shall also procure and shall maintain during the term of this Agreement vehicle liability insurance in an amount not less than $1,000,000 for injuries, including accidental death, to any one person, and subject to the same minimum for each person, in an amount not less than $1,000,000 for each accident, and property damage insurance in an amount of not less than $1,000,000. Said policy shall include coverage for owner, non-owner, leased and hired cars. (d) Professional Liability and Errors and Omissions Insurance. For all of A&W’s employees who will provide services under this Agreement, A&W shall keep in full force and effect Professional Liability coverage for professional liability with a limit of two Million ($2,000,000) per claim and five Million ($5,000,000) annual aggregate. A&W shall ensure both that: (1) the policy effective date is on or before the date of commencement of the services under the Agreement; and (2) the policy will be maintained in force for a period of time defined above, there will be no changes or endorsements to the policy that increase the City’s exposure to loss.
Except for the policy of professional liability insurance, all of the above policies of insurance shall be primary insurance and shall name City, its City Council, council members, officers, employers and agents as additionally insured. For all policies, the insurer shall waive all rights of subrogation and contribution it may have against the City, its City Council, council members, officers, employees and agents and their respective insurers. Except for the policy of professional liability insurance, all of said policies of insurance shall provide that said insurance may not be amended or canceled without providing thirty (30) days prior written notice by registered mail to the City. In the event any of said policies of insurance are cancelled, the attorney shall, prior to the cancellation date, submit new evidence of insurance in conformance with this Section to the City. A&W is solely responsible for the payment of or costs associated with any premiums, deductibles or self-insurance retentions. A&W’s insurance coverage shall not limit A&W’s potential liabilities for obligations arising under or related to this Agreement. A&W will ensure insurance is placed with insurers with a current A.M. Best’s rating of no less than A:VII, unless otherwise acceptable to the City.
11. INDEMNIFICATION
To the fullest extent permitted by law, A&W agrees to indemnify City, its City Council, Council members, Commissioners, officers, employees and agents and their successors and assigns (“indemnified parties”) against, and will hold and save each of them harmless from, any and all actions, suits, claims, damages to persons or property, losses, costs, penalties, obligations, errors, omissions or liabilities (herein “claims or liabilities”) that may be asserted or claimed by any person, firm or entity arising out of or in connection with the work, operations, activities, or omissions of A&W, its officers, agents, representatives, employees, sub-consultants, contractors, invitees, or anyone for whom A&W is liable, provided for herein or arising from the acts or omissions of A&W hereunder, or arising from A&W’s performance of or failure to perform any term, provision, covenant or condition of this Agreement, except to the extent such claims or liabilities arise from the sole negligence or willful misconduct of City, its officers, or employees.
Agenda Item No. 06 Page 8 of 42 CC Agenda 12-15-2025
7 09999.0014 2069504.1 12/2/2025

In the event of any claim or demand made against any indemnified parties, City may, at its sole discretion, reserve, retain or apply any monies due to A&W under this Agreement for the purpose of resolving such claims; provided however, that City may release such funds if A&W provides City with reasonable assurances of protection of the City’s interest.
The City shall, in its sole discretion determine whether such assurances are reasonable. A&W agrees that its duty to defend the indemnified parties arises upon an allegation of liability based upon the acts, omissions, or performance of services under this Agreement by A&W, its officers, agents, representatives, employees, sub-consultants, contractors, invitees, or anyone for whom A&W is liable and that an adjudication of A&W’s liability is not a condition precedent to A&W’s duty to defend. The provisions of this section will survive the termination or expiration of this Agreement.

SUBJECT: UPDATED AGREEMENT WITH THE PORT HUENEME LITTLE LEAGUE
REGARDING BUBBLING SPRINGS PARK BALLFIELDS AND RELATED
ITEMS
RECOMMENDATION:
It is recommended the City Council authorize the City Manager to execute a renewal agreement with the Port Hueneme Little League (PHLL) which will continue their nonexclusive but priority-based usage of the ball fields at Bubbling Springs Park through the 2026 calendar year.
BACKGROUND/ANALYSIS:
The Port Hueneme Little League (PHLL) is a non-profit organization under Section 501(c)(3) of the Federal Internal Revenue Code, dedicated to providing baseball programming for children in Port Hueneme and South Oxnard. Since 1959, PHLL has operated at Bubbling Springs Park, offering a valuable program that promotes children's mental and physical health while teaching important lessons in sportsmanship and teamwork. For these reasons, staff is recommending that the City Council approve renewal of the park use agreement with PHLL which continues to grant priority field access, authorizes the group to operate the snack bar, and provides for use of the community room and storage area.
The recommendation to renew the use agreement with PHLL for the ball fields and associated park amenities is based on the league’s long-standing relationship with the City, history of park use, service to the community and investments in the park. PHLL is responsible for utility costs associated with the operation of the concession stand.
Because there are not separate electricity and water meters for that building, the City is in the process of separating those utility costs from those that support general park operations. PHLL has been informed that it will begin paying for utility costs in 2026.
Agenda Item No. 07 Page 1 of 17 CC Agenda 12-15-2025
PHLL Renewal Park Use Agreement
December 15, 2025
The proposed agreement provides for an initial one-year term, subject to annual review, and authorizes up to four subsequent one-year extensions by the City Manager if PHLL demonstrates compliance with terms of the agreement. Key elements of the agreement, remain unchanged from the agreement which was approved by the City Council earlier this calendar year, and include the following:
- PHLL shall have priority access to the park ballfields (but will not have exclusive use); reserving fields for a specific number of hours each season before any other field request is considered (as noted below a change in the number of hours is proposed)
- City shall be responsible for regular park maintenance and associated utilities, and shall maintain fields consistent with existing park maintenance standards - PHLL shall be responsible for performing tasks related to field preparation, e.g. dragging infield dirt and chalking baselines
- PHLL shall be the primary user of the community room during the January – June period; room may be reserved by other groups during this time, if available - PHLL shall serve as the operator of the concession stand and retain responsibility for utility and other operational costs associated with its operations; PHLL will seek to operate the snack bar for non-PHLL activities upon request by the City - PHLL shall pay an annual fee of $3,750 to the City
During the fall season, PHLL experienced a significant rise in youth participation (an increase of approximately 100 players) which they expect to continue into the upcoming spring enrollment. As a result, the proposed renewal agreement adjusts PHLL’s priority field-use hours: increasing spring season weekday use from 18 to 20 hours per week, and fall weekday hours from 12 to 15 per week. This expansion reflects the need for additional practice and game time to accommodate the growing number of teams.
PHLL has been a cooperative community partner throughout its transition from operating as an exclusive-use entity to functioning under a priority-based system. Overall, operations have proceeded smoothly, with only one incident reported. We communicated with PHLL regarding the matter, and the concerns have since been resolved. PHLL has remained receptive to feedback and consistently engages with the City as needs arise.
They also demonstrated flexibility by offering to modify their schedule to accommodate the Oxnard Union High School District when Del Sol High School’s baseball team will need a temporary host site during facility upgrades this spring.
FISCAL IMPACT:
The renewal agreement between the City and PHLL would continue the requirement that PHLL pay the City $3,750 annually. These funds are received as general fund revenue and are used to support park maintenance operations. Additionally, PHLL will be responsible for paying the cost of utilities associated with its use of the concession stand.

14.Rights and Remedies
Except with respect to rights and remedies expressly declared to be exclusive in this Agreement, the rights and remedies of the Parties are cumulative and the exercise by a Party of one or more of such rights or remedies shall not preclude the exercise by it, at the same or different times, of any other rights or remedies for the same default or any other default by the other Party.

17. Agreement Termination
City may at any time, with or without cause, terminate this Agreement by providing PHLL written notification of such. PHLL agrees, by execution of this Agreement, to waive any and all claims for damages that might otherwise arise from any such termination. Any assignment or subletting without such consent shall be void, and shall, at the option of the City, terminate this Agreement.
