ORDINANCE NO.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT HUENEME,

CALIFORNIA, AUTHORIZING THE USE OF JOB ORDER CONTRACTING (JOC) AS AN ALTERNATIVE PUBLIC WORKS PROJECT DELIVERY METHOD

AND ESTABLISHING PROCEDURES AND LIMITATIONS OF THE CITY OF PORT HUENEME MUNICIPAL CODE AND ADDING SECTION 2575 “JOB ORDER CONTRACTS”
WHEREAS, The City Council finds that the City routinely undertakes maintenance, repair, renovation, and minor construction projects that are repetitive in nature, require timely execution, and benefit from pre‑established unit pricing and streamlined procurement; and WHEREAS, Job Order Contracting (JOC) is a recognized indefinite delivery, indefinite quantity construction delivery method employing a unit price catalog and competitively bid adjustment factors, used by numerous public agencies in California to accelerate delivery and reduce administrative overhead while maintaining budgetary control and transparency; and WHEREAS, the City intends to implement JOC procedures substantially similar to those prescribed for state agencies by PCC § 10113.1 et seq. (Department of General Services) and used operationally by Caltrans, adapted to municipal needs and legal context; and WHEREAS, the City Council declares that authorizing JOC as an optional delivery method will not preclude the use of traditional delivery methods (e.g., design‑bid‑build), but will provide the City with an additional, compliant tool to efficiently deliver eligible public works projects.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT HUENEME, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1: RECITALS AND FINDINGS. The above recitals are all true and correct and incorporated herein.

SECTION 2: ADDITION TO CODE. Chapter 6, “General Administration”, Part FG, “Public Projects – Bidding and Procedures”, of the City of Port Hueneme Municipal Code is hereby amended by the addition of a new section, section 2575 – “Job Order Contracts” to read as follows.
“Section 2575. Job Order Contracts(JOC).
a) A Job Order Contract (JOC) is a construction contract for minor or recurring construction tasks, including repair, remodeling, or other repetitive work, with a firm, fixed price, and indefinite quantity awarded on a unit price basis for all necessary labor, materials, and equipment. A JOC may not be awarded for any new construction. b) JOC procurement.
i) Except as set forth in this Section, JOCs are subject to Chapter 6, part G. ii) Any advertisement for bids and specifications shall contain a maximum dollar amount of the JOC not to exceed $3,000,000.00. Any cumulative change orders to a JOC shall not result in a contract exceeding $3,000,000.00. This maximum amount shall be adjusted annually to reflect the percentage change in the California Consumer Price Index for Ventura County.
c) Issuance of Task Orders.
i) A task order is an authorization to perform construction work under a JOC. ii) Each task order shall include a detailed scope of work and time certain for completion of work. iii) The City Manager, or his/her designee, shall have authority to issue task orders not to exceed the dollar amount specified in Chapter 6, Part G section 2572. d) Authorization to enter JPA.

The City Council authorizes the City Manager, or designee, to negotiate and execute a Joint Powers Agreement (JPA) with one or more public agencies that possess statutory authority under the California Public Contract Code to utilize JOC, for the purpose of enabling the City to access and issue job orders under such JOC contracts. i) Scope of Shared Authority. Under the JPA, the City may:

(2) Issue job orders for eligible projects within the City’s jurisdiction, subject to the terms of the JPA and the partner agency’s JOC program requirements; (3) Ensure compliance with all prevailing wage, skilled and trained workforce, subcontracting, and reporting requirements.
ii) Limitations. The City shall not delegate its legislative authority or financial oversight under this section. All job orders issued under a JPA shall be subject to City budget approval and administrative controls established by the City Manager.” SECTION 3: ENVIRONMENTAL REVIEW. The Council exercises its independent judgment and finds that the proposed ordinance is not subject to California Environmental Quality Act (CEQA) pursuant to Section 16060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment), and Section 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA guidelines, California Code of Regulations, Title 14, Chapter 3, because the proposed ordinance has no potential for resulting in any significant physical change to the environment, either directly or indirectly.

SECTION 4: SEVERABILITY. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction for any reason, such decision shall not affect the validity of the remaining portions of this Ordinance.

The Council declares that it would have adopted each section, subsection, sentence, clause, phrase, or portion of this Ordinance irrespective of whether one or more sections, subsections, sentences, clauses, phrases, or portions of this Ordinance be declared invalid or unconstitutional.

SECTION 5: EFFECTIVE DATE. This Ordinance shall take effect 30 days after its final passage and adoption.

SECTION 6: CERTIFICATION. The City Clerk of the City is hereby directed to certify to the passage and adoption of this Ordinance and to cause it to be published as required by law.

SUBJECT: AUTHORIZE CITYWIDE SPRING CLEANUP EVENT
RECOMMENDATION:

It is recommended the City Council authorize staff to perform a citywide neighborhood cleanup event.

BACKGROUND/ANALYSIS:

At the February 17 Council meeting, Council approved a future agenda item related to a citywide spring community cleanup event.

This event will give residents a convenient way to dispose of bulky, unwanted items, clear out garages and side yards, and help keep neighborhoods clean and inviting. Drop off sites are proposed to be hosted at three locations, making it easy to participate close to home. This event will also include an opportunity for residents to pick up bagged mulch free of charge, which also helps the city in meeting SB1383 requirements.

Staff believes this type of event will help reduce illegal dumping, encourage responsible disposal and recycling, and build neighborhood pride through community participation.

With Earth Day being April 22nd, staff is proposing the cleanup event to be held Saturday, April 25, 2026, at the following locations:
• Parking Lot B at Hueneme Beach Park
• Bubbling Springs Park off Park Avenue
• Bolker Park Parking Lot
Hours for the event will be from 9:00 a.m. to 1:00 p.m. This will allow staff time to prepare sites prior to start time, as well as perform site cleanup at the conclusion of the event.

Staff will develop public outreach messaging detailing items that will, and will not, be acceptable. This can be shared on our social media sites and city website.

FISCAL IMPACT:

Cost of this event including staff time, disposal fees, and purchase of mulch materials are estimated to be $10,000. Sufficient funds are available in Solid Waste Operations Account No. 304-563-5233.

STRATEGIC PLAN:

Optimal Levels of Service for Residents and Businesses
• Promote operational excellence in all City functions and embody best practices as a municipality
• Establish desired service levels for all City functions • Increase communication, outreach and proactive engagement of all members of our population

SUBJECT: VENTURA ROAD BICYCLE LANE SAFETY – OVERSIZED VEHICLES RECOMMENDATION:

It is recommended that the City Council receive this informational report on the Ventura Road bicycle lanes and direct staff to prepare oversized vehicle regulations and to consider potential additional improvements in future Capital Improvement Project plans.

BACKGROUND/ANALYSIS:

This item is being brought at the request of the City Council to provide an analysis of past efforts and potential planned improvements to enhance the safety of the Bike Lanes on Ventura Road.

In 2008, the Port Hueneme Bicycle Transportation Plan was prepared as part of the Ventura Countywide Bicycle Master Plan to guide expansion of bicycle facilities, close network gaps, and improve safety.

The plan indicated that the City had 2.6 miles of Class II bikeways meeting Caltrans standards and that Ventura Road had a 1.4-mile nonconforming multi-use pathway that required upgrades.

On July 16, 2008, the City adopted the Port Hueneme Bicycle Transportation Plan. The City's Local Bicycle Plan proposed several improvements to Ventura Road, including upgrading the Southbound section to Class I standards.

On May 17, 2025, the City received public comment from a resident indicating concerns with portions of Southbound Ventura Road, particularly due to concerns that the “Share The Road” signs are not followed by drivers when bicycles are close to vehicles.

Conforming and non-conforming
Per Cal Trans standards, bike lanes for one-way traffic must be a minimum of 4 to 6 feet wide, depending on the vehicle speed of the adjacent roadway, and two-way bicycle traffic requires a minimum of 8 feet.

Ventura Road Bicycle Lane

Page 2 ends

There are four classes of bike lanes:
• Class I – Bike paths are separated from roads, either by a barrier or an open space. • Class II – Bike paths are part of the road, marked with clear white striping and labeling. They must be 4 feet minimum when roadway speed is 40 mph or less, and 6 feet minimum when roadway speed exceeds 40 mph.
• Class III – Bike paths exist as part of the road, but they are not striped. Signs often denote that the road should be shared.
• Class IV - Bike lanes are designed for the exclusive use of bicycles and include a physical separation from vehicular traffic. This separation can be achieved through concrete curbs, plastic bollards, planters, or raised medians.

Class I facilities are considered the safest option for bicycle riders because they provide a fully separated path for both pedestrians and cyclists, completely removed from the roadway. Class IV facilities are the next best option, offering a dedicated bikeway that is physically separated from vehicle traffic by a barrier or curb. Class II facilities rank third, as they are located within the roadway and rely solely on striping and signage for separation. Class III facilities are the fourth option, where cyclists share the roadway with vehicles, and the route is designated only by signage.

Figure 1 - The figure above demonstrates the differences in the class of bike lane. Safety increases as bike facilities become more separated from vehicle traffic—ranging from shared lanes (Class III) to fully protected paths (Class I).

Improvements that have occurred on Ventura Rd
Southbound Ventura Road between Channel Islands Boulevard and Pleasant Valley Road is designated as a Class III bicycle route and is signed accordingly. In alignment with the Bicycle Master Plan, portions of the Southbound sidewalk along Ventura Road have been widened to 10 feet over the years to accommodate a Class I shared-use path.

Agenda Item No. 05 Page 2 of 9 CC Agenda 03-02-2026

March 2, 2026

Page 3 ends

Although these improvements have been constructed, the original Class III bike lane designation remains in place and has not yet been removed. Bicycle riders may use the Class III bike lane; however, they are encouraged to utilize the Class I facilities when available. All routes are signed accordingly. (See figure 2 below).

Northbound Ventura Road
In 2009, the City Council approved improvements that included signing and striping the Northbound Ventura Road between Pleasant Valley Road and Channel Islands Boulevard, with an on-street bike lane (Class II). This section of roadway does not have street parking. In the mid 2010’s, the remaining portion of Northbound Ventura Road was striped as a Class II bike lane. On this section of Ventura Road, street parking is allowed on both sides between Pleasant Valley and Surfside Drive; although the section between Port Hueneme Road and Surfside Drive is time-limited.

Southbound Ventura Road
In 2011, the existing 6‑foot sidewalk along Southbound Ventura Road between Pleasant Valley Road and Park Avenue was widened to 10 feet. In 2016, the widening continued, extending approximately 1,000 feet of sidewalk from Park Avenue to Bard Road. Both projects were funded using Transportation Development Funds until those funds were fully expended.

During the preparation of this report, staff reviewed Southbound Ventura Road to address issues raised by public comments. It appears that a primary issue is the portions of Southbound Ventura Road where oversized vehicles are parked, which infringe on the bike lane (see Figure 3 below). An initial step to address this matter is to authorize staff to propose oversized vehicle regulations to help ensure a clearer bike path.

Figure 2- Picture far left shows shared path signage appropriate for Class I facilities, middle picture shows signage for cyclists to use the path in lieu of using Class III, picture on the far right shows S/B Ventura Road far right lane is signed for a Class III facility.

REVISIONS
RECOMMENDATION:

It is recommended that the City Council review its proposed revisions to the City’s Legislative Platform, which were developed pursuant to Council direction, and approve a revised document that will provide guidance and allow staff to advocate for City programs and priorities.

BACKGROUND/ANALYSIS:

The City Council reviewed the City’s Legislative Platform at the February 17, 2026 Council meeting. At that time, the Council directed staff to amend the Platform to add language pertaining to support for legislation pertaining to climate sustainability and social justice.

Consistent with the Council’s discussion at the February 17 meeting, revisions closely align with language in the County of Santa Barabra Platform. Council may review the Legislative Platform and determine whether to add, remove or modify language as desired. Attachment B includes other suggested language provided by Councilmembers subsequent to the meeting, included for Council awareness and consideration.

FISCAL IMPACT:

Approval of the City’s Legislative Platform will allow staff to streamline a process to advocate on behalf of the city and its residents. This is anticipated to reduce use of staff time for advocacy efforts. Letters of support and advocacy efforts would be accomplished at minimal cost with existing staff resources.

Introduction and Purpose
The City of Port Hueneme (“City”) maintains a Legislative Platform to facilitate the City’s quick response to County, State, and Federal legislation in a proactive manner, since legislation can often move quickly through legislative bodies, withoutsufficient time for the City Council to take formal action. The Legislative Platform further serves as a guide for the City Council to consider legislative affairs on an ad hoc basis.

The Mayor, Mayor Pro Tem, or City Manager, is authorized to sign correspondence consistent with the City’s approved positions on pending legislation and without the need for additional formal action of the City Council expressing the City’s position on pending legislation.

City staff monitors State and County legislation for potential impacts to the City. State or Federal legislation may also be brought to staff’s attention by the League of California Cities, Ventura Council of Governments, or other professional organizations for fields such as engineering, water, finance, community development, or public safety.

City positions on pending legislation on topics not included in the Legislative Platform require a vote of the City Council. If warranted, due to complexity, the City Manager may also present pending legislation to the Port Hueneme Water Agency, Housing Authority or other standing committee as appropriate to the topic, for a recommendation prior to City Council consideration.

Nothing in the Legislative Platform is intended to preclude consideration of any legislation by the City Council, regardless of whether it is included in the Legislative Platform.

City positions in support of legislation on a specified topic shall be construed as opposition to something that shall do the opposite, and the reverse is also true. For example, if the Legislative Platform supports increased funding for libraries, it also inherently opposes decreased funding for libraries.

The City may participate in the Legislative Action Day event hosted by the League of California Cities each spring. This event includes updates from the League of California Cities and its lobbyists representing cities’ interests, panel discussions of critical issues, meetings with the City’s representatives in the State Assembly and State Senate, and other networking opportunities. The City’s elected officials and City staff may also participate on the League’s Policy Committees which focus on specific policy areas. Staff Communicates on a regular basis with elected officials and their representatives to address issues that arise in the City that may best be resolved with a legislative action.

Disclaimer: Staff’s recommended positions are made without regard to companion actions that may entail increases in taxation or other revenue sources. Support or opposition to such financial considerations would be evaluated on a case-by-case basis.

Agenda Item No. 06 Page 19 of 19 CC Agenda 03-02-2026
DATE: March 2, 2026
TO: Honorable City Council
FROM: James Vega, City Manager
Charles Peretz, Deputy City Manager
SUBJECT: JOINT USE AGREEMENT BETWEEN THE CITY OF PORT HUENEME

AND OXNARD UNION HIGH SCHOOL DISTRICT
RECOMMENDATION:

It is recommended that the City Council authorize the City Manager to execute the Joint Use agreement between the City of Port Hueneme and Oxnard Union High School District.

BACKGROUND/ANALYSIS:

The City and the Oxnard Union High School District (District) have a long-standing and productive partnership that benefits the community, particularly in the area of recreation programming. In recent years, the District has allowed the City to utilize the swimming pool at Hueneme High School to operate the City’s Learn to Swim program. This program has served several hundred community members and provides essential water safety and youth recreation opportunities to community members.

Similarly, the District has periodically needed use of baseball fields at Bubbling Springs Park for its athletic programs, and the City has regularly facilitated that use. Requests to waive park permit fees for such use require City Council approval. Because the City and District have an ongoing relationship involving repeated facility use, staff is recommending approval of a formal Joint-Use Agreement covering these specific facilities. Establishing this type of agreement, which is common among many public agencies throughout the State, formalizes the existing practice, strengthens the partnership, and eliminates the need to seek Council approval each time the District requests use of the baseball field.

Key elements of the proposed Agreement include:
• No fees will be charged to either party for use of the specified facilities • Each party will remain responsible for routine maintenance and utilities for its own facilities

• Each party will provide insurance and name the other party as an additional insured.
• The initial term of the Agreement is five (5) years, with an option to renew for an additional five (5) years upon mutual agreement.

This Agreement formalizes an existing cooperative relationship, ensures appropriate risk management protections are in place, and provides for administrative efficiency.

FISCAL IMPACT:

There is no fiscal impact associated with the approval of this agreement.

STRATEGIC PLAN:

Primary Strategic Pillar(s) and Initiative(s):

Optimal Levels of Service for Residents and Businesses
• Promote operational excellence in all City functions and embody best practices as a municipality
Strategic Partnerships
• Establish a mechanism for engagement, information sharing, dialogue and ongoing cooperative decision-making with key stakeholders ATTACHMENTS:

DATE: March 2, 2026
TO: Honorable City Council
FROM: James Vega, City Manager
SUBJECT: CITY COUNCIL APPOINTMENT TO CITY/PORT STANDING

COMMITTEE AND DISCUSSION OF COMMITTEE TASKS
RECOMMENDATION:

It is recommended that the City Council appoint two representatives to the City/Port Standing Committee and provide direction regarding desired tasks.

BACKGROUND/ANALYSIS:

On January 20, 2026, the City Council made their annual appointments to various city committees. At that time, the City Council determined that a future item should be scheduled at the February 2 City Council meeting to discuss the City/Port Joint Committee appointment and goals for the committee.

Following that meeting, City staff was notified by Port of Hueneme staff that the Port was preparing a proposed amendment to the settlement agreement that would modify the Community Benefit Fund process, and would also likely modify the scope and meeting frequency of the Joint Committee. Given that development, on February 2, the City Council continued the item to allow the City to receive and review the proposed agreement modification before establishing tasks for the Committee and appointing Council representatives.

Subsequently, the City received communication from the Port. This correspondence reaffirmed the Port’s earlier statement regarding its desire to propose an amendment to the agreement but did not include additional detail regarding the proposal. Instead, the primary focus of the letter was a public records request seeking City records related to the expenditure of funds provided to the City as required by the revenue-sharing agreements. In the absence of additional information regarding the Port’s proposal, staff is recommending that Council revisit the subject item and consider the establishment of tasks for, and appointment of Council representatives to, the City/Port committee.

Potential areas the Council may wish to consider as tasks for committee representatives include, partnering with the Port to review and discuss:
• Both parties’ compliance with the Settlement Agreement Agenda Item No. 08 Page 1 of 2 CC Agenda 03-02-2026

• Consideration of potential modifications to the Settlement Agreement • Streets and infrastructure improvements (and opportunities for grant partnerships) • Port and community security considerations
