On March 7, 2022, Councilmember Perez requested that an ordinance prohibiting loitering, standing, and walking on center medians and dividers be placed on a future City Council agenda. On April 4, 2022, the City Council discussed a requested ordinance related to standing or panhandling on center medians and public rights-of-way. The meeting minutes reflect that the approved motion directed the then City Attorney to coordinate with the Police Department and return with information addressing public safety concerns.

With the City’s recent transition to a new City Attorney, the City Manager, Police Chief, and City Attorney reviewed outstanding items and identified this project as a priority to prepare for Council consideration. Solicitation in City medians has continued to be a concern and an ordinance is necessary to allow the City’s Police Department to address public safety concerns. Staff has prepared the proposed ordinance.

Median Solicitation Ordinance
April 20, 2026

The proposed ordinance would amend Article V, Chapter 9 of the Port Hueneme Municipal Code to establish reasonable time, place, and manner restrictions on solicitation behavior in roadway medians. The proposed regulations are intended to address public safety concerns associated with individuals engaging in solicitation activities in medians, where close proximity to moving vehicles may create hazards for both pedestrians and motorists.

As stated in the proposed ordinance, solicitation on roadway median strips, at traffic intersections, and in the public roadway may distract drivers from the safe operation of their vehicles and may contribute to traffic collisions, congestion, blockage of streets, and delays in the free flow of travel. The City has focused significant resources in recent years on addressing traffic and speed related issues, with a goal of increasing public safety on the city’s streets, and this ordinance would further those efforts. The ordinance further provides that its intent is not to interfere with constitutionally protected speech, but rather to impose content-neutral restrictions that are narrowly tailored to serve a significant governmental interest in traffic safety while preserving alternative channels of communication.

The proposed ordinance would add Section 5653, “Prohibited solicitation on medians,” to the Port Hueneme Municipal Code to make it unlawful for any person to solicit from, or when the person solicited is in, any median on any street or highway as defined by the California Vehicle Code. The proposed ordinance would also amend Section 5642 of the Municipal Code to add a definition of “median” in order to clarify the scope of the regulation. Under the proposed language, a median is defined as any area between opposing lanes of traffic, excluding turn lanes, designed to separate traffic flows on any street or highway, and may be raised, paved, or landscaped.

ORDINANCE NO. ___

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT HUENEME, CALIFORNIA, AMENDING ARTICLE V, CHAPTER 9 OF THE PORT
HUENEME MUNICIPAL CODE TO ADD SECTION 5653 AND AMEND
SECTION 5642 TO IMPLEMENT REASONABLE TIME, PLACE, AND

MANNER RESTRICTIONS ON SOLICITATION BEHAVIOR IN ROADWAY

MEDIANS
WHEREAS, soliciting on roadway median strips and at traffic intersections, and in the public roadway increases the risk of drivers becoming distracted from their primary duty to safely operate their motor vehicle and watch traffic. This may result in traffic collisions, congestion and blockage of streets, and delay the free flow of travel, all of which constitute substantial traffic safety concerns; and
WHEREAS, the Council’s intent in enacting this Ordinance is not to interfere with the exercise of First Amendment rights of individuals in the City. This Ordinance is intended solely to minimize the safety hazards of those in medians as well as the drivers and passengers in vehicles sharing the roadway; and
WHEREAS, while the restrictions of this Ordinance are content-neutral they are both narrowly tailored and necessary to achieve a compelling governmental interest, but still provide alternative avenues of communication; and
WHEREAS, the reasonable time, place and manner restrictions in this chapter avoid the unsafe and negative effects of solicitation from roadway medians and will not unreasonably restrict free speech of people engaged in solicitation generally within the City.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT HUENEME, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1: The above recitals are hereby incorporated herein as Findings of the City Council.

“Median” means any area between opposing lanes of traffic, excluding turn lanes, designed to separate traffic flows on any street or highway. Medians act as a physical barrier or visual separator to improve safety and manage traffic flow, and can be either a raised, paved, or landscaped.”
SECTION 4: This ordinance is exempt from the California Environmental Quality Act (“CEQA”) under Section 15061(b)(3) of the CEQA Guidelines, which provides that CEQA only applies to projects that have the potential for causing a significant effect on the environment.

Where, as here, it can be seen with certainty that there is no possibility that the activity in question would have a significant effect on the environment, the activity is not subject to CEQA.

Georgianna N. Alvarez, City Clerk
SUBJECT: FUTURE AGENDA ITEM REQUESTS
RECOMMENDATION:

It is recommended that the City Council receive the following future agenda item requests and provide direction on whether to schedule each item for a future meeting:

1. Request Submitted By: Councilmember Jess Lopez, attached; Item: Request to schedule a future item reviewing the City’s 2025 Parking Analysis and Improvement Efforts, specifically as it relates to the Bolker Park Area; Staff Time/Cost Estimate: Scheduling an item to review the parking study analysis previously completed and presented to Council would take minimal effort and/or staff time. Implementing specific proposals may have costs, but those would be reviewed/discussed with the City Council as part of the review.

BACKGROUND/ANALYSIS:

On October 20, 2025, the City Council approved a process to consider future agenda item requests by requiring each City Councilmember to provide a written explanation of the request one week prior to the City Council meeting. This will allow the Council to receive a clear, written explanation, and to be prepared to discuss whether or not to schedule the item, while also improving clarity for staff and transparency to the community.

Some key points to consider while determining whether to schedule items include:

The Council’s role is to set policy. Requested agenda items should focus on policy matters. Items that are administrative, operational, or outside the City’s authority should be referred to staff.

Factors for Council to consider when considering such requests include:

1. Is this under the Council’s authority?
(Is it a policy matter, not just administrative?)

2. Does this align with the City’s strategic goals or priorities?

3. Is Council action, direction, or a decision needed?

4. Is there a clear purpose or expected outcome?

5. Does it serve the public interest or affect the community broadly?

6. Do I have enough background information or context to support it?

7. Is this the right time to bring it forward?
(Or are there other pending items that should be resolved first.)

8. Does this request require significant staff time, resources, or legal review? (Is the value worth the cost?)
FISCAL IMPACT:

Estimated costs and staff resources are noted for each item above.

Following direct engagement with local residents at Bolker Park, the Council should review ongoing parking concerns to ensure future solutions align with resident needs and improve neighborhood accessibility and safety. A comprehensive parking study of the Bolker Park area was conducted in 2025 to quantify usage patterns, peak hours, and specific conflict points. Concerns raised by residents include a lack of resident parking, blocked driveways, and significant overflow parking reaching maximum levels as it migrates from adjacent apartment complexes. I am requesting staff to review the data from the completed study and present formal recommendations based on those findings, including all available options to mitigate these neighborhood impacts.

Move to authorize staff to present formal recommendations based on the 2025 Parking Study data, including all available options to address the parking overflow and accessibility concerns raised by residents
