I understand that the City of Port Hueneme is considering a short-term rental ordinance. As an owner in Surfside IV Homeowners Association, I am requesting the Surfside IV HOA be excluded in the ordinance from short-term rental approval for the following reasons.

The California Coastal Commission has approved exclusion of Short-Term Rentals based on units with common walls and Homeowners Association Governing Documents as well as eliminating Short-Term Rentals in select Homeowners Associations. For example:

City of Oxnard: No permit for a homeshare or vacation rental shall be issued for any of the following dwellings:

Those 440 units in the Planned Development Community known as The Colony at Mandalay Beach.

Those units in the Harbour Island condominiums.

City of Dana Point: Proof that the STR to which the Permit applies shall not be prohibited by any legal Homeowners Association Conditions, Covenants, and Restrictions (“CC&Rs”) or any other legal community standards/guidelines applicable to the parcel where the Dwelling to be used as an STR is located.

City of Encinitas: Signed statement by the HOA board acknowledging that the owner is permitted to use the owner's property as a short-term rental, per applicable private governing documents.

Surfside IV HOA was developed as a residential community. Our governing documents require a 30-day minimum rental and focus on the quiet enjoyment of our homes. All units have common walls and most have either common ceilings, floors, or both. As Surfside IV does not have an onsite manager to enforce rules, the burden of managing common short-term rental nuisances would fall directly on the Port Hueneme Police Department.

It is proposed that the following be included in the permit application requirement of the City of Port Hueneme Short Term Rental Ordinance:

No permit for a homeshare or vacation short term rental shall be issued for any of the 211 condominium units in the Planned Development Community known as Surfside IV Homeowners Association.
