Item No. 25.
CITY COUNCIL AGENDA – MAY 6, 2025
SUBJECT: Modification to Cargo/Shipping Container Policy SOURCE: Engineering and Project Management
COMMENT: At its meeting of April 15, 2025, the Council reviewed the current cargo/shipping container policy and directed staff to present information regarding the implementation of a new policy based on Council discussion and direction to adjust the policy to include the permitting of long-term use of cargo/shipping containers as permanent structures and expanding their allowance as permanent structures in areas previously not permitted for temporary cargo containers, such as in the Residential Zone Districts.
BACKGROUND: At its meeting of March 4, 2014, the City Council adopted Resolutions 14-2014 and 15-2014 in order to set forth provisions to accommodate various time periods for the temporary use of cargo containers associated with commercial and industrial uses, and to establish fees for processing such applications. Resolution 15-2014, in establishing fees, defined an “amnesty period” of a reduced fee amount where business owners may have previously brought to site a cargo container without permits for long-term use of three or fewer containers, in order to encourage early compliance. Resolution 15- 2014 may be rescinded completely as it only relates to cargo container fees. Resolutions 14-2014 and 08-2015 must be amended as they outline interpretation and standards relating to matters not exclusively related to cargo containers.
Per Council’s direction from its meeting of April 15, 2025, draft regulations are attached to this report, which include:
• Rescind and replace parts of Resolution 14-2014, 15-2014, and 08-2015 that reference Cargo/Shipping containers with a new resolution to have all regulations pertaining to
cargo/shipping containers in one location.
• Allowing Cargo/Shipping Containers in Industrial, Commercial, and Residential zones as permanent structures.
• Standards for setbacks, lot coverage, screening, and
architectural articulation should be applicable to cargo Item No. 25.
containers. Similar to those already in the Porterville Development Ordinance for Accessory Structures and
permitted uses in the corresponding zone districts.
• Cargo/Shipping Containers are to be located in the rear yard. • Streamline the permitting process and remove unnecessary review by the Zoning Administrator or City Council for cargo containers.
• Adoption of a local building code to permit cargo containers for storage under a standard building permit process.
ANALYSIS: As part of the proposed building permit process, staff proposes to create a local code amendment to California Building Code Section 3115. A storage-only use for a cargo container does not warrant the full application of the code requirements. Staff proposes to simplify the process, but must do so through a public hearing and submit findings to the Building Standards Commission of the State of California for concurrence and/or recordation. The City is required to hold a public hearing to adopt the 2025 California Building Code prior to the end of the year to take effect January 1, 2026. The Council can direct staff to schedule a public hearing for the proposed code amendment prior to the California Building Code adoption, or the code amendment can be scheduled for October/November 2025 to be able to be included in the public hearing process for the City's adoption of the new 2025 California Building Code to take effect January 1, 2026.
Cargo containers are currently regulated by Resolution No. 14-2014.
An update to the Porterville Development Ordinance is currently being processed. In addition to the building code amendment and resolution, the proposed cargo container regulation can be included in the Porterville Development Ordinance update, to provide ease of access to information on the utilization of cargo containers.
Staff is also seeking City Council direction on the enforcement of the current cargo container regulations. The Council can direct staff to continue to enforce the regulation or suspend enforcement of the regulation, not withstanding the enforcement of cargo containers that pose a health and safety threat to the community, until new regulations are adopted.
ENVIRONMENTAL
REVIEW:
This action is exempt from environmental review under CEQA Sections 15061(b)(3). The Environmental Coordinator made a determination, on the basis of substantial evidence, that the proposed amendments will have no real effect on the environment as they will occur on properties that are already developed or in the process of being developed.
Item No. 25.
RECOMMENDATION: That the City Council:
1. Provide staff direction on enforcement of current
Cargo/Shipping Container policy;
2. Provide staff direction on the language of attached
draft regulations amending the policy related to the
use of cargo/shipping containers as permanent
structures in Residential Zone Districts;
3. Provide a date for a public hearing to adopt a the
proposed local building code amendment and
resolution amending cargo/shipping containers as
permanent structures and to be permitted in
Residential Zone Districts and direction to amend
through ordinance and included in the
Comprehensive Development Ordinance Update;
and
4. Recommend a date for a public hearing to adopt a
Resolution amending the Building Code to address
the use of cargo containers as permanent structures.
