CITY COUNCIL AGENDA – SEPTEMBER 1, 2026
SUBJECT: Mobilehome Rent Stabilization Policy Options
SOURCE: City Attorney
COMMENT: At the July 21, 2026 City Council meeting, Councilmember Beltran requested that the City Council consider directing staff to prepare a proposed Mobilehome Park Rent Stabilization Ordinance for future City Council consideration. In response to this request, the City Attorney's Office conducted preliminary research regarding mobilehome rent stabilization programs in California for City Council discussion and direction.

A Mobilehome Park Rent Stabilization Ordinance generally establishes regulations governing rent increases for mobilehome spaces within mobilehome parks. Unlike traditional residential tenants, mobilehome residents commonly own their manufactured home while renting the underlying space from a mobilehome park operator. Because relocating a mobilehome can be costly and technically difficult, significant increases in space rent may create particular challenges for mobilehome residents.

The California Mobilehome Residency Law (MRL), California Civil Code Section 798 et seq., establishes various requirements governing mobilehome park operations and the relationship between park owners and residents, including provisions concerning leases, park rules, utility billing, and eviction notices. The MRL does not establish a generally applicable statewide limit on mobilehome space rent increases. Subject to applicable State and federal law, local jurisdictions may consider local mobilehome rent stabilization measures.

Recent changes in State law have also modified the application of local mobilehome rent stabilization regulations, which would require further legal evaluation as part of developing any proposed local ordinance. The City Attorney's preliminary research specifically identifies the repeal of the former long-term lease exemption under Civil Code Section 798.17, effective January 1, 2025.

Mobilehome Rent Stabilization Programs
Mobilehome rent stabilization programs vary among California jurisdictions.

Item No. 19.

Local ordinances commonly establish an annual allowable increase based upon some percentage of the Consumer Price Index (CPI), a fixed percentage, or a combination of the two. The examples reviewed by staff generally establish annual increases within a defined formula rather than prohibiting rent increases altogether.

For example, the City of Fresno allows annual automatic space rent increases capped at 75% of the CPI for the preceding year and provides procedures for certain additional adjustments. The City of Selma limits annual base rent increases to the lesser of 3% or 75% of the Western Region CPI.

An important legal and administrative component of a rent stabilization program is a process through which a mobilehome park owner may request an increase beyond the otherwise allowable amount. Such procedures provide park owners with an opportunity to demonstrate that an additional increase is warranted based upon factors such as operating expenses, maintenance, capital improvements, or other applicable considerations. Administrative structures may include hearing officers, staff review, rent stabilization commissions, or City Council review.

Accordingly, development and implementation of a local ordinance would involve more than establishing an annual rent increase limitation. The City would also need to establish administrative procedures for rent adjustment applications, resident protests, hearings or appeals, administrative decisions, recordkeeping, and enforcement. These requirements could result in ongoing staffing and administrative costs.

Alternative MOU Approach
As an alternative to adopting a mandatory rent stabilization ordinance, the City Council could direct staff to explore a negotiated Memorandum of Understanding (MOU) or similar voluntary agreement among the City, participating mobilehome park owners, and potentially resident representatives.

Potential advantages of this approach include predictable rent adjustment terms and reduced administrative requirements compared with operating a formal rent stabilization program. Such agreements may also establish predetermined formulas for capital improvement costs and mechanisms for resolving disputes. An MOU approach, however, would require participation and agreement by the affected parties and would differ from a generally applicable regulatory ordinance.

Additional Evaluation and Administration
Should the City Council desire to continue evaluating mobilehome rent Item No. 19.
stabilization, additional analysis would be necessary before a final regulatory framework could be presented for consideration. Staff recommends that this work include an assessment of the City's existing mobilehome parks, including the number of parks and spaces, ownership characteristics, current space rents, and historical rent increases. Stakeholder engagement with mobilehome residents and park owners/operators would also be an important component of the process.

The City would additionally need to determine the appropriate administrative structure for any program. Depending upon the policy selected by the City Council, administration could potentially be performed by City staff or through a third-party provider specializing in rent stabilization, hearing, or arbitration services.

If directed to proceed, staff would further evaluate applicable legal requirements, potential rent adjustment methodologies, procedures for additional rent adjustments and capital improvement costs, notice and hearing requirements, exemptions, program administration and enforcement, staffing or third-party administration, program costs and potential cost-recovery mechanisms, and stakeholder input from mobilehome residents and park owners.

There is no direct fiscal impact associated with receiving this report and providing policy direction. Should the City Council direct staff to proceed with development of a Mobilehome Rent Stabilization Ordinance or negotiated MOU process, additional staff and City Attorney resources would be required to conduct stakeholder outreach, develop the proposed framework, and evaluate implementation requirements.

A formal rent stabilization program could also result in ongoing administrative costs associated with processing rent adjustment applications, conducting hearings or appeals, maintaining program records, and enforcement. Staff would evaluate these costs, including options for internal administration, thirdparty administration, and potential cost-recovery mechanisms, as part of any future proposal presented to the City Council.

RECOMMENDATION: That the City Council provide direction to staff regarding mobilehome rent stabilization, including whether to:

1. Proceed with further evaluation and development of a proposed Mobilehome Rent Stabilization Ordinance;

2. Explore a negotiated Memorandum of Understanding (MOU) or similar voluntary approach; or

3. Discontinue further research and pursuit of mobilehome rent stabilization at this time.

CITY COUNCIL AGENDA – SEPTEMBER 1, 2026
SUBJECT: Process to Fill District 3 City Council Vacancy SOURCE: City Manager's Office
COMMENT: Effective August 21, 2026, Councilmember AJ Rivas resigned from the Porterville City Council, creating a vacancy in the District 3 Council seat.

Councilmember Rivas' written resignation states that his resignation was effective immediately.

City Charter Requirements
Section 16 of the City Charter establishes the process for filling a vacancy in a legislative office. Under the current Charter, a vacancy is filled by appointment of the City Council, with the appointee serving until the next general municipal election, at which time a successor is selected by the voters for the remainder of the unexpired term. If the City Council does not fill the vacancy within 30 days after it occurs, the Charter requires the Mayor to fill the vacancy.

Because the District 3 vacancy occurred on August 21, 2026, the City Council must fill the vacancy within 30 days, or by September 20, 2026. If the City Council does not make an appointment within that period, the Charter requires the Mayor to fill the vacancy.

District Representation and Eligibility
The City Council consists of five single-member districts, with one Councilmember elected by the voters of each district. The Municipal Code requires a Councilmember representing a district to reside within that district and be a registered voter of that district.

Accordingly, any individual appointed to the vacant District 3 seat must reside within District 3 and be a registered voter of District 3.

Historical Appointment Processes
The City Council has utilized several approaches to fill prior Council vacancies.

Item No. 20.

In 2019, following the resignation of Vice Mayor Brian Ward, the City Council established an appointment process that required interested individuals to submit a Request for Appointment and resume, provided an opportunity for public comment regarding candidates, and included Council interviews before an appointment was made.

In 2022, following the resignation of District 4 Councilmember A. Monte Reyes, the City Council solicited Requests for Appointment from eligible District 4 residents and registered voters. The vacancy was advertised through the City's website and local media, and Council considered interviewing applicants before making an appointment.

Historically, the City Council has also considered other methods, including direct Council nominations, use of an ad hoc committee to develop a shortlist, public interviews, or combinations of these approaches.

Proposed Appointment Process
To provide an open and orderly process while meeting the timeframe established by the City Charter, staff recommends soliciting Requests for Appointment from eligible District 3 residents. The vacancy would be advertised through the City's website, social media, and local media.

Interested individuals would be required to submit a completed Request for Appointment and resume to the City Clerk's Office. Following the application deadline, staff would verify each applicant's District 3 residency and registered voter status before forwarding eligible applications to the City Council for consideration.

The City Council would consider the eligible applicants at a special City Council meeting on September 17, 2026. The meeting would provide an opportunity for public comment and Council interviews of the applicants before the Council considers making an appointment to the vacant District 3 seat.

The following timeline is recommended:
• September 1, 2026: City Council establishes the appointment process and authorizes solicitation of Requests for Appointment. • September 2, 2026: City begins advertising the District 3 vacancy and accepting Requests for Appointment.
• September 11, 2026, at 5:00 p.m.: Requests for Appointment and resumes due to the City Clerk's Office.
• September 17, 2026, Special City Council Meeting: City Council considers eligible applicants, conducts public interviews, receives public comment, and considers appointment to the vacant District 3 City Item No. 20.

Council seat.

The City Council may modify the proposed process or provide alternative direction, provided that any appointment is made consistent with the requirements of the City Charter and applicable law.

RECOMMENDATION: That the City Council:

1. Approve an application and interview process to fill the vacant District 3 City Council seat;

2. Authorize staff to solicit Requests for Appointment and resumes from eligible District 3 residents who are registered voters of District 3;

3. Establish September 11, 2026, at 5:00 p.m. as the deadline for submission of Requests for Appointment; and

4. Schedule a special City Council meeting for September 17, 2026, to consider eligible applicants, conduct public interviews, receive public comment, and consider appointment to the vacant District 3 City Council seat.
