7. Adjournment
The Regular Meeting of the Portola City Council adjourned at 7:15pm 1 MEETING DATE: August 27, 2025
AGENDA ITEM: 6. Grizzly Lake CSD: Potential Intertie Project & City Participation FROM: Ryan Bonk
RE: Grizzly Lake CSD: Potential Intertie Project & City Participation BACKGROUND:

During the 03/12/2025, the City Council directed staff to request a draft reimbursement agreement as well as other conditions be met prior to additional participation in the project by city staff.

Grizzly Lake CSD and their engineering consultant, GHD, have requested this agenda item in order to discuss their request for City participation in the project.

FINDINGS:

State Water Resources Control Board Timeline:
2008- GLCSD (formerly Grizzle Lake Resort Improvement District) was made aware of the compliance issues and was issued a citation for violation of the primary standard uranium for the water supplied to its customers from Well 2
2010- GLCSD sends the City of Portola a letter stating this following, "With the cost estimates provided by your staff, the calculations revealed that existing water service rates would need to increase between 95% - 100%. Crocker Mountain and Grizzly Retreat residents voted down a proposed rate increase exceeding 31% in August 2009. With this prior experience, we are confident that water rate increases between 95% - 100% will not be approved. GLRID is exploring other sources of drinking water for the Crocker Mountain and Grizzly Retreat residents, and drinking water from the Lake Davis Water Treatment Plant will not be needed at this time. As such, GLRID will not be negotiating with the City of Portola for drinking water from the Lake Davis Water Treatment Plant." 2011- Compliance Order 01-02-11(O)001 directing the District to take action to comply 2014- Compliance Order 01-02-14(O)001 issued from non-compliance with the uranium MCL 2015- GLCSD provides a Preliminary Engineering Report (PER) that includes a proposed intertie connection with the City of Portola
2017- Intertie with City abandoned by GLCSD although the Division of Drinking Water did not agree with the approach chosen by GLCSD and recommended that GLCSD proceed with the intertie with the City 2025- GLCSD contacts the City with current request
2 RECOMMENDATION:

In addition to any questions, concerns, or clarifications requested by the City Council, city staff recommends that the following items be fully and substantially addressed by Grizzly Lake CSD and/or their consultants for the City's participation in the project to be considered:

General
-Response to LAFCo Municipal Service Review (MSR) that includes actionable steps taken to address the issues
Financial Solvency and Assurances
-Without financial records and/or audits from 2020-current, how can GLCSD speak with accuracy to the current financial situation?
-When does GLCSD expect an audit to be completed?
-What percentage of accounts are currently overdue?
-How long will GLCSD financial reserves cover current operating costs? Months, quarters, years? -What is GLCSD's plan if financial reserves are expended? -What occurs if GLCSD defaults on payments for treated drinking water to the City? City of Portola - Grizzly Lake CSD Intertie

Subject Municipal Service Review and Sphere of Influence Update – GLCSD Response to Challenges

1. Introduction
The Municipal Service Review (MSR) and Sphere of Influence Update for Grizzly Lake Community Services District (GLCSD), dated August 14, 2024, is a state-required study that provides a review of the services provided by GLCSD and assesses the current state and ability to continue providing those services. The MSR included discussions on the challenges faced by GLCSD and recommendations that the GLCSD can implement to improve its function.

Under the SAFER Drinking Water Technical Assistance Program, GHD Inc. is developing an Alternatives Analysis Engineering Report to assess the feasibility of an intertie connection from the City to GLCSD – Delleker Water System to the City of Portola. The Delleker Water System has uranium and gross alpha in its supply well and has been required, as per the October 2024 Water Quality Compliance Order (No. 01-02-24R-001), to provide clean drinking water, with an emphasis on establishing a connection to the City of Portola (City).

The City is considering participating in the planning-level review of the Intertie Project and potentially providing services (treated drinking water through an intertie) in the future to GLCSD. Before the City agrees to participate in the planning of the Intertie Project, the City requests a better understanding of the current function and proposed future function of the GLCSD. The City has requested that GLCSD review the current challenges identified the in the MSR and provide a response to how each challenge has been overcome or plans on how to reduce such challenges in the future.

1.1 Purpose of this report
The purpose of this report is to address the challenges identified in the MSR such that the City can understand that GLCSD is an invested, variable, and engaged partner in the Intertie Project.

An Intertie Project would financially link the GLCSD to the City of Portola, with GLCSD needing to pay the City for the water provided by the intertie pipeline. The City would like to clearly understand and ensure that the GLCSD will be able to meet the financial requirements that the Intertie Project will require.

2. MSR Identified Challenges
This section addresses the challenges listed in the Executive Summary of the Municipal Service Review. Many challenges are addressed through the shift in Board members. As stated in the MSR, “The former District staff and accountant posed significant challenges for LAFCo, consistently disregarding multiple requests for information and records pertaining to the drafting of this MSR. However, under the new board, GLCSD has demonstrated accountability and transparency in its disclosure of information and cooperation with Plumas LAFCo, including participating in an interview and cooperating fully with the document requests.” In the MSR, three alternative governance structures were identified for GLCSD. Because of the shift in board members and actions taken to make necessary improvements, GLCSD is given the opportunity to address the City of Portola | Report 2
This document is in draft form. The contents, including any opinions, conclusions or recommendations contained in, or which may be implied from, this draft document must not be relied upon. GHD reserves the right, at any time, without notice, to modify or retract any part or all of the draft document. To the maximum extent permitted by law, GHD disclaims any responsibility or liability arising from or in connection with this draft document. challenges listed and report back to Plumas LAFCo at its October 2025 meeting where the Commission can determine if an updated governance structure is still needed.

2.1 Fluctuating Board members and numbers
As stated previously, the former board members posed significant challenges. These board members have been replaced and the new board members are active in providing the needed support for GLCSD. There was a significant amount of information lost during the transition, as the historic board members were not willing to assist in the process.

Currently, the GLCSD board has four members whose terms have not expired. There is one vacant position. To limit turn over, GLCSD plans to ensure board members serve their agreed upon length of term.

2.2 Employee turnover
Maintaining a system operator has been a challenge for GLCSD, the community is small and finding qualified staff with the correct training is a challenge not just for GLCSD but for many small rural water systems. The system currently employs two D1 water system operator, one maintenance staff, and one consultant for one day per week.

The system plans to employ the water system operator and maintenance staff full time in the future. The system has hired Cline & Associates to handle the financial aspects of the Community Services District (CSD).

2.3 Loss of Accountant
Following the resignation of the former accountant, GLCSD lost all digital records. The accountant held the records on their personal computer, and was unwilling to provide them. The new board worked to get them back, but with no luck, even if they were to legally request the documents, they are afraid the documents have been deleted at this point.

Moving forward, the current Board is working to rebuild the records. The system has hired Cline & Associates as their accountant to assist with system financials.

2.4 Mismanagement
The system has a new Board who plans to ensure correct management of the system. There is also a full-time General Manager, Bob Howell. The board plans to adopt a strategic plan for staff and the public to implement management planning practices.

2.5 Brown Act violations
The previous board voted to remove a Board member from GLCSD in a closed session without a reason disclosed. Because of the apparent lack of statutory authority to remove the member, this was a violation of the Brown Act. The system has a new Board who plans to ensure no future violations to the Brown Act.

2.6 Lack of transparency
The MSR states that GLCSD does not make available the Annual Compensation Reports nor the State Controller’s Office Financial Transaction Report on its website, which is required. GLCSD plans to complete the Special District Leadership Foundation’s Transparency Certificate of Excellence. GLCSD is working with Cline & Associates to begin uploading required reports to promote transparency. The board will ensure they meet compliance requirements for CSDs listed in Government Code Section 61110. As stated in Section 2 above, the new Board has demonstrated accountability and transparency.

2.7 Use of company property
The new Board plans to ensure company property is used only for its intended purpose of work associated with services provided by GLCSD. Prior improper use of company property has been stopped.

City of Portola | Report 3
This document is in draft form. The contents, including any opinions, conclusions or recommendations contained in, or which may be implied from, this draft document must not be relied upon. GHD reserves the right, at any time, without notice, to modify or retract any part or all of the draft document. To the maximum extent permitted by law, GHD disclaims any responsibility or liability arising from or in connection with this draft document.

2.8 Harassment from previous Board members and staff
The new Board plans to ensure there is no harassment from current Board members and staff.

2.9 Alleged poor behaviour during Board meetings
The new Board plans to ensure there is no poor behaviour during Board meetings.

2.10 Irregular meeting schedule
The new Board plans to ensure there is a regular meeting schedule of the first and third Tuesday of each month at 6:00 pm. As stated in the MSR, “Since the new Board was seated in December the District has been meeting regularly.”

2.11 Delayed annual audits
The new Board plans to ensure annual audits are submitted within an acceptable timeframe and is actively working to get up to date.

2.12 Incomplete rate study
The system has been instructed to purchase water from the City of Portola to provide to its customers. Since the amount charged by the City of Portola to GLCSD will dictate the charges GLCSD will have to charge its customers, a rate study will not be completed at this time, and rates will be reevaluated as part of the intertie project.

2.13 Lack of accountability
The new Board plans to ensure the Board takes accountability. As stated in Section 2 above, the new Board has demonstrated accountability and transparency.

2.14 Illegal removal of a Board member
The new Board plans to ensure there are no illegal removals of Board members. Further details are described in Section 2.5.

2.15 Improper execution of the Prop 218 process
GLCSD did not properly follow all guidelines set forth in Proposition 218 for the September 2022 rate increase.

Since this increase, the system has been instructed to purchase water from the City of Portola to provide to its customers. GLCSD is looking to receive technical assistance as part of the SAFER program, which will assist GLCSD with the Proposition 218 rate increase process.

2.16 Lack of approved budget
GLCSD is working to develop an approved budget and is having a Rate Study completed to reassess and better understand the finances of its system. This current rate study has been halted due to lake of financial records and the dependency on the cost of source water moving forward. See section 2.12 for more information on the Rate Study.

2.17 Late financial reporting
The late financial reporting is carry over from the old Board. The new Board plans to ensure financial reports are submitted within an acceptable timeframe and is actively working to get up to date on late reports.

2.18 Disregarded public records requests
Some Public Records Requests sent to the previous Board have not been responded to. It has been recommended that the system implement an online tracking system with a record of requests and their status.

City of Portola | Report 4
This document is in draft form. The contents, including any opinions, conclusions or recommendations contained in, or which may be implied from, this draft document must not be relied upon. GHD reserves the right, at any time, without notice, to modify or retract any part or all of the draft document. To the maximum extent permitted by law, GHD disclaims any responsibility or liability arising from or in connection with this draft document.

GLCSD plans to develop this tracking system and respond to Public Record Requests within a timely manner. As stated in Section 2, the new Board has fully cooperated with document requests from LAFCo.

2.19 Missing Annual Compensation Reports and State Controller’s Office Financial Transaction Reports from Website
The MSR states that GLCSD does not make the Annual Compensation Reports and State Controller’s Office Financial Transaction Reports available the on its website, which is required. GLCSD is working with Cline & Associates to begin uploading the required Annual Compensation Reports and the State Controller’s Office Financial Transaction Reports.

2.20 Lack of a Capital Improvement Plan
GLCSD has developed a Capital Improvement Plan.

2.21 Missing financial records for FYs 20-21, 21-22, 22-23, and the first half of FY 23-24
Following the resignation of the former accountant, GLCSD lost all digital records. The new Board plans to keep track of all new financial records.

3. Concerns of Financial Solvency
The City of Portola has expressed concerns of the Financial Solvency of GLCSD due to the financial challenges presented in this MSR. Should the City of Portola agree to provide an intertie to GLCSD, the GLCSD water system will derive a rate to charge customers through a rate study, which will calculate sufficient income for payment to the City of Portola and funds for their capital improvement reserve. 1 MEETING DATE: August 27, 2025
AGENDA ITEM: 7. Administrative Services Manager: Position Posting FROM: Ryan Bonk
