2. Reports: Beckwourth Peak Fire Protection District / Plumas County Sheriff / Northern Sierra Air Quality
Beckwourth Peak Fire Protection District (BPFPD) - City Manager Bonk met with Chief Rosevear earlier in the day and provided updates from the meeting. BPFPD is looking to expand the South Side Fire Station by purchasing a parcel of land next to the station with plans to potentially expand the station to allow larger engines to fit in a new bay. He also reported that six fire personnel will soon complete an advanced EMT training course, which will add an enhanced level of care in the field in the City.

Plumas County Sheriff - no report.

Northern Sierra Air Quality - Pro Tem Mayor Battaglia reported a free green waste disposal event for City of Portola residents from October 17th through October 31st, 2026. She also said City residents can take as many loads of green waste as they want to the Intermountain Disposal (IMD) transfer station, as long as they bring a copy of their driver's license and a copy of their water bill to present to IMD to qualify for free disposal.

3. Staff Communications

6. Drinking Water State Revolving Fund Program Update
City Manager Bonk provided an update regarding the Drinking Water State Revolving Fund and the Wastewater Revolving Fund. He said the City submitted technical applications for both programs to the State Water Board this year. The total wastewater project is $28,871,300.00, and the drinking water project is $9,483.800.00. On 9/4/2026, the State Water Board informed the City that the drinking water project was not eligible to receive any funds this fiscal year because it determined the City did not meet the requirement of being “failing” or “at risk.” Staff anticipated this outcome and reached out to the United States Department of Agriculture, which provides grant funding and/or loans the City may be able to obtain. Discussions with the USDA are underway, and staff will continue to update council on any other funding sources. He also said staff has not received a determination from the State Water Board on the wastewater project's status. Still, he will inform the council of any determinations by the State Water Board.

7. Draft Performance Dashboard Review
City Manager Bonk presented the new interactive online Performance Dashboard, which is ready to launch on the City’s website. The dashboard is a single public web page that tracks key performance metrics for the Administration, Public Works, and Code Enforcement departments, as well as metrics for City staff and the organization. It is written in plain English for residents, not staff, and provides an overview of what the community “gets” for the money the City spends. However, it does not include everything the City does, only what is measurable and accurate. Currently, the dashboard includes 20 months of data from January 2025 to August 2026 and will be updated monthly.

Public commented.

1 MEETING DATE: October 14, 2026
AGENDA ITEM: 5. Liberty Utilities Electric Rates and the City Role FROM: Ryan Bonk
RE: Liberty Utilities Electric Rates and the City Role
BACKGROUND:

Residents have asked the City to act on Liberty Utilities (CalPeco Electric) LLC’s rates. The City is a Liberty Utilities customer and shares many of the concerns expressed by residents.

Liberty is an investor-owned utility, and the State of California, through the California Public Utilities Commission (CPUC), controls what it may charge.

The CPUC, not the City, sets Liberty Utilities’ electric rates. The City can speak up, inform residents, and take part in CPUC proceedings, but it cannot set, cap, freeze, or reduce rates.

EXECUTIVE SUMMARY:

Who sets electric rates?
The CPUC decides what Liberty may charge. Liberty cannot raise rates on its own, and the City cannot approve, deny or change them.

The process generally works in three steps:

1. Liberty asks: Every few years, Liberty files a General Rate Case with the CPUC, listing its costs and the revenue it says it needs. Liberty may also file smaller yearly requests for rate adjustments, such as the Energy Cost Adjustment Clause, which passes through what it pays for power.

2. The CPUC reviews: A CPUC judge oversees the hearings and evidence, hearing from Liberty, the CPUC's own consumer advocate (the Public Advocates Office), and customer groups that have joined the case. Members of the public can send comments and attend public forums.

3. The CPUC decides: The five Commissioners vote in a public meeting. Only then can new rates take effect.

Page 30 ends

2 In Liberty's most recent rate case (A.24-09-010), Liberty asked for a 19.1 percent increase in base revenue for 2025. The CPUC’s decision and order, issued on March 19, 2026, approved a settlement at $231.9 million, an 11.4 percent increase over the prior level. That is lower than the original request, but it is still an increase, and it is set by the State.

What the City can do
The City has a voice in the process but no vote in it. Here is what the City can do:

1. Send letters and testimony to the CPUC, Liberty, and legislators

2. Ask the CPUC and Liberty to hold a meeting in Portola

3. Take part in CPUC proceedings as a formal party
What the City cannot do

1. Set, cap, freeze, or roll back electric rates

2. Reject a rate increase by ordinance, resolution, or other action

3. Order Liberty to change its billing, shutoff or service practices

4. Tax or fine Liberty to offset customer costs

5. Go straight to court over a rate decision; review is narrow and open only to parties that first ask the CPUC for rehearing
WHAT CAN RESIDENTS DO?:

The CPUC generally listens most to residents who are specific, provide comments on the record, and use the CPUC’s process. Residents can take these steps:

1. Comment on future rate cases: Sign up free at cpuc.ca.gov/subscription. To view new Liberty filings, choose the Energy industry and Application documents, then watch for Liberty Utilities (CalPeco Electric). Liberty must also send a bill insert about rate-increase applications within 45 days of filing, or an emailed link if you use paperless billing. The notice lists the case number and where to comment.

2. Speak up while a case is open: Each open CPUC case has a Public Comment tab on its docket card. You can also speak by phone at CPUC public forums and voting meetings. See the CPUC events page.

3. Apply for bill discounts: Income-qualified households may enroll in California Alternate Rates for Energy (CARE). Liberty's rates and regulatory page lists its assistance programs and filings. Ask

Page 31 ends

3 Liberty about payment plans if a bill is behind.

4. Dispute a bill in the right order: Contact Liberty first and ask for a written response. If the problem is unresolved, file a complaint with the CPUC Consumer Affairs Branch through the CPUC website.

5. Check you are on the right rate: Ask Liberty to confirm your account is classified as a permanent residence and whether the standard, time-of-use or EV rate costs you least. Compare on Liberty’s rates page.

6. Contact State legislators: Utility rate policy, such as wildfire cost recovery, is set by the Legislature. Tell your representatives how these costs affect your household and ask what they can do.

7. Follow and join a customer group: Groups that represent customers in Liberty cases include the Public Advocates Office (the CPUC's consumer advocate) and Tahoe-area ratepayer organizations.

PLUMAS-SIERRA RURAL ELECTRIC COOPERATIVE (PSREC) FEEDBACK :
"PSREC is an electric cooperative, but also considered an “Electrical Corporation” as far as service territory is concerned. This means we can not use the power of eminent domain (aka condemnation) to take over the service territory of another electrical corporation. We could buy Liberty’s assets in our region, but only if Liberty wants to sell.

And if Liberty wants to sell, we’d be interested in buying." RECOMMENDATION:

Staff recommends the following:

1. Receive and file this report.

2. Direct staff to post a plain-language fact sheet on the City website (draft attached).

3. Authorize the Mayor to send letters to the CPUC, Liberty, and the area's State legislators (drafts attached).

4. Direct staff to ask Liberty to hold a community meeting in Portola.

Liberty Utilities, the CPUC, and what you can do
The California Public Utilities Commission (CPUC), not the City, sets Liberty’s electric rates.

The City cannot cap, freeze, or reduce them, but you have real options, and your voice counts in the CPUC process.

Who does what:

Liberty asks the CPUC for the revenue it says it needs. The CPUC reviews the request and votes in public. The City can speak up, inform residents and take part in the process, but has no vote.

What you can do:
1 Comment on future rate cases through CPUC
Sign up free at cpuc.ca.gov/subscription.
2 Speak up while a case is open
Each open CPUC case has a Public Comment tab on its docket card. You can also speak by phone at CPUC public forums and voting meetings. See the CPUC events page.
3 Apply for a bill discount
Income-qualified households can enroll in CARE. Ask Liberty about payment plans if you are behind.
4 Check you are on the right rate
Ask Liberty to confirm your account is classified as a permanent residence and whether the standard, time-of-use or EV rate costs you least. Compare on Liberty’s rates page.
5 Write your State legislators
Rate policy, such as wildfire cost recovery, is set by the Legislature. Tell your representatives how these costs affect your household and ask what they can do. Portola is in Senate District 1 and Assembly District 1.

Problem with your bill or service? File a complaint:

A complaint is for billing and service problems. To object to a future rate increase, comment on the rate case (steps 1 and 2) or ask the CPUC Public Advisor’s Office how to become a formal party. 1 Contact Liberty first: Ask for a written response and keep the dates, amounts, and names. 2 File an informal complaint with the CPUC: The CPUC Consumer Affairs Branch works with Liberty to resolve it. File online at cpuc.ca.gov/consumer-support/file-a-complaint/utility-complaint, by phone at 1-800-649-7570 (Mon–Fri, 8:30am–4:30pm; call for urgent problems such as a disconnection), or by mail to 505 Van Ness Avenue, San Francisco, CA 94102-3298. 3 File a formal complaint if that fails: Through a formal complaint the CPUC can order the utility to take corrective action. See CPUC complaint options.

Re: Liberty Utilities Rates in Portola
Dear President and Commissioners:

On behalf of the City of Portola, I write to share the concern of the City and our residents about our electric bills from Liberty Utilities (CalPeco Electric) and to ask for the Commission’s help. Portola is a small mountain community of about 2,100 people at the northern edge of Liberty’s California service territory. We are a low-income community with a median household income of $44,492, drastically below the statewide median. Residents have asked the City to act, and we understand that rates are set by this Commission, not the City.

Liberty’s most recent general rate case (A.24-09-010) sought a 19.1 percent increase in base revenue and resulted in an 11.4 percent increase, driven largely by wildfire mitigation and insurance costs, with additional increases proposed for 2026 and 2027. Liberty must also replace most of its power supply as its NV Energy agreement ends, which will affect the energy portion of our bills for years. Many residents have told the City that the combined effect is more than their household budgets can absorb.

For future rate cases, the City respectfully asks the Commission to:

1. Weigh the cumulative bill impact on customers in Liberty’s smaller, more remote communities, including Portola, when it acts on current and future Liberty requests.

2. Require Liberty to show the projected effect on a typical residential bill before approving new power supply agreements, and consider phasing to limit rate shock.

3. Hold a public forum in Portola, in person and by phone, so residents can be heard without traveling to the Tahoe Basin or elsewhere in California.

4. Ensure Liberty informs customers in our area about CARE, payment arrangements and baseline allowances, and add the City to the notice list for filings that affect rates.

The City also respectfully asks the Commission to:

1. Review outage times and response times from Liberty.

2. Explain whether there is a “minimum standard of service” expected from Liberty.

3. Inquire why Liberty has not renewed the agreement with Plumas-Sierra Rural Electric Cooperative (PSREC) for line crews during outages.

Sincerely,
Bill Powers

Re: Portola Customers- Rates, Customer Support and Communication Dear Mr. Schwarzrock:

The City of Portola has heard from many of your customers who are upset about their electric bills. As a Liberty customer itself, Portola shares many of these concerns. We know the California Public Utilities Commission sets Liberty’s rates, and we are not writing to dispute that. We are writing because these customers are our residents, and they are looking to both Liberty and the City for clear answers and for relief where it is available.

Portola sits at the far northern end of your system, and our residents can feel distant from decisions made mostly for the Tahoe Basin, where about 80 percent of Liberty’s California customers live. With the most recent rate case, pending filings such as the Energy Cost Adjustment Clause and the Mountain View Fire cost recovery application, and a coming change in power supply, customers want to understand what is driving their bills and what comes next.

The City asks Liberty to:

1. Hold a community meeting in Portola, with senior Liberty representatives who can explain the rate changes, the power supply transition and the assistance programs, and take questions. The City will help with a venue and public notice.

2. Reach out directly to Portola customers about CARE, payment arrangements and baseline allowances, and confirm that every permanent, separately metered residence is coded correctly for baseline.

3. Publish a plain-language explanation of the parts of a typical Portola bill and the expected effect of the supply transition on a typical residential customer.

4. Give the City early notice of filings that affect Portola customers, and designate a contact for City staff when residents’ concerns need escalation.

5. Pursue the lowest-cost supply options that meet California’s requirements when it selects new power suppliers.

We would welcome a response by November 16, 2026, and we are ready to work with your team on a meeting date. Thank you for your attention to our community.

Sincerely,
Bill Powers

Re: Electric Bill Increases for Liberty Utilities Customers in Portola Dear Senator Dahle:

Thank you for your past support of Portola, including your letter of support for our Gulling Street Bridge project. I am writing about a different concern that has reached the City from many residents: the rising cost of electric service from Liberty Utilities (CalPeco Electric). As a Liberty customer itself, the City shares many of the concerns expressed by our residents.

The California Public Utilities Commission sets Liberty’s rates, and the City has no authority to change them.

Liberty’s recent rate case (A.24-09-010) sought a 19.1 percent increase in base revenue and resulted in an 11.4 percent increase, driven mainly by wildfire mitigation and insurance costs, and Liberty now faces replacing most of its power supply. The costs of wildfire safety fall on a small customer base in mountain communities like ours, and residents are feeling it.

We respectfully ask for your help in three ways:

1. Raise Portola’s concerns with the Commission and ask it to consider the cumulative bill impact on Liberty’s rural customers when it acts on Liberty’s current and future requests.

2. Examine how wildfire mitigation and insurance costs are borne by small utilities and their customers, and support policies that reduce or spread that burden for rural ratepayers.

3. Support technical and financial assistance for rural communities studying local energy options.

I would also welcome you or your staff at a community meeting in Portola on this issue. Please contact City Manager Ryan Bonk at (530) 832-6800 or [email protected] to arrange the meeting.

Thank you for your service to our region.

Re: Legislative Oversight of Rates for Small Electric Utilities- Liberty Utilities in Portola Dear Assemblymember Hadwick:

Thank you for your past support of Portola, including your letter of support for our Gulling Street Bridge project. I am writing about a different concern that has reached the City from many residents: the rising cost of electric service from Liberty Utilities (CalPeco Electric).

Residents of Portola have asked the City to respond to steep increases in their electric bills from Liberty Utilities. As a Liberty customer itself, the City shares many of the concerns expressed by our residents. We have explained that the California Public Utilities Commission, not the City, sets those rates. Because the Legislature oversees the Commission and sets the policy framework for wildfire cost recovery, I am asking for your help.

Liberty’s recent rate case (A.24-09-010) sought a 19.1 percent increase in base revenue and resulted in an 11.4 percent increase, driven mainly by wildfire mitigation and insurance costs. Liberty now faces replacing most of its power supply. The costs of wildfire safety fall on a small customer base in mountain communities like ours, and residents are feeling it.

The City asks that you consider requesting that the Assembly Utilities and Energy Committee review how rate increases affect customers of the smaller multi-jurisdictional utilities, and how the cost of wildfire mitigation and insurance is allocated to them. We also ask that for future rate cases you encourage the Commission to hold public forums in Portola or eastern Plumas County, so residents can be heard closer to home.

You or your staff are welcome at a community meeting in Portola. City Manager Ryan Bonk can be reached at (530) 832-6800 or [email protected] to arrange it.

Thank you for your service to our district.

1 MEETING DATE: October 14, 2026
AGENDA ITEM: 6. Intermountain Disposal: 2027 Rate Increase FROM: Tom Valentino- Solid Waste Consultant
RE: Intermountain Disposal: 2027 Rate Increase
BACKGROUND:

Under the amended and extended franchise agreement between the City of Portola and Intermountain Disposal Inc., the company is entitled to an annual rate adjustment for changes in the cost of doing business, consistent with Section 5.3 of the agreement.

EXECUTIVE SUMMARY:

The adjustment for increases of the cost of doing business is based on U.S. Bureau of Labor Statistics and the U.S. Energy Information Administration data for consumer indices and fuel price changes over a oneyear period (August 2025 to August 2026). Specifically, the two federal agency statistics used to calculate the annual increase are:

Bureau of Labor Statistics Consumer Price Index for All West Urban Consumers, Non-Seasonally Adjusted; and
Energy Information Administration California No. 2 Diesel Retail Prices.

Staff calculated the inflation and diesel fuel increases using August 2025 and August 2026 federal data and the calculation procedure stated in section 5.3 of the franchise agreement. The combined CPI/Diesel Fuel rate increase is 6.96%. Intermountain Disposal’s accounting firm VT Accounting Associates separately calculated the CPI and Fuel increases and agreed with our calculations.

Transfer Station Fee Increases
The Plumas County Board of Supervisors approved Resolution No. 26-9158 on June 9, 2026, which increased disposal fees at Delleker Transfer Station by 5.27% (effective July 1, 2026). IMD seeks to increase refuse collection rates for the transfer station increase, consistent with section 5.5 of the franchise agreement – Pass-Through Costs.

Page 39 ends

2 To determine the percentage of the transfer station increase to pass-through to the refuse collection rates, IMD submitted to staff confidential financial information for calendar year 2025 prepared by VT Accounting Associates. Based on staff’s review of the financial data, we calculated the disposal cost a percentage of revenue is 23.83% for calendar year 2025.

To calculate the transfer station fee increase to the 2027 refuse collection rates, we multiply the transfer station increase (5.27%) by the percentage cost of refuse disposal (23.83%). The result is a 1.26% increase for trash disposal services, effective January 1, 2027.

The combined increase for most of the 2027 rates is 8.22%. The proposed 2027 refuse collection rate sheets, the federal data sheets, and Plumas County Resolution No. 26-9158 are attached.

RECOMMENDATION:

Staff recommends that the City Council review the proposed 2027 refuse collection rates and direct staff to commence the Proposition 218 process to approve the new rates.

Please note that 2027 is Rate Year 10, which is the final year of the 2017 Amended and Extended Exclusive Franchise Agreement between the City of Portola and Intermountain Disposal Inc. In Section 5.3 of the Franchise Agreement, annual rate increases are capped at 5.00%. However, because 2027 is the final year of the current franchise agreement, staff recommend that the 5.00% cap be waived by the City Council and the entire increase of 8.22% (for many of the proposed rates) be approved.

Following written notification of the proposed 2027 rates to property owners and tenants in Portola, there is a 45-day public comment period. Staff anticipates a public hearing on the 2027 rates at a city council meeting on December 9, 2026 to consider written protests to the proposed rate increase.

1 MEETING DATE: October 14, 2026
AGENDA ITEM: 7. Statewide Park Development and Community Revitalization Program: Draft Grant Projects Review
FROM: Ryan Bonk
RE: Statewide Park Development and Community Revitalization Program: Draft Grant Projects Review
BACKGROUND:

The California Department of Parks and Recreation recently opened the Statewide Park Development and Community Revitalization Program. This program provides grant funding with zero match to awardees.

The City has successfully engaged with this department in the past, most recently the Riverwalk upgrades under Prop 68, which included the vault restrooms and yoga & meditation garden. However, funds for this project were allocated to the City without a formal competitive grant process.

The deadline for submission is December 17, 2026 with awards expected in the Summer of 2027.

EXECUTIVE SUMMARY:

In preparation for this grant opportunity, Staff has developed a draft scope of work for various parks within the City. Staff has thoroughly vetted the scope of work for each location weighing a variety of factors including but not limited to:

Organizational feedback (Little League, Disc Golf Course Representatives, United States Forest Service, etc.)
Public feedback
Parks and Recreation Master Plan (community input section attached to staff report) Service and delivery enhancement for residents
Cost/Benefit analysis
Public works staffing capabilities
Obvious current needs
Ongoing operations and maintenance requirements
Recreation features and major support amenities specifically called out in grant application guide Project selection criteria as described in the grant application guide

RECOMMENDATION:

Staff recommends the following:

1. The City Council obtain any additional feedback from the public that may be in attendance in person at this meeting on the draft scope of work

2. Based on staff analysis, approve the draft scope of work as presented for each park

3. Approve staff to submit all required documents under the grant program for consideration Please note that any major additions to the scope of work will need to be fully vetted prior to inclusion. In addition, the draft scope of work outlined for each project above reflects the bestcase scenario. Staff will attempt to include as many projects and aspects as possible within the grant timeline but may need to cut scope of work in order to complete the packages before the deadline.

FISCAL IMPACT:

The fiscal impact to the staff recommendation is that in the event of an award for any project, the costs to perform the project will be funded via the General Fund until reimbursement is obtained from the state.

Staff will monitor the progress of each project, considering cash flow, to ensure that there is minimal financial exposure to the General Fund.

1 MEETING DATE: October 14, 2026
AGENDA ITEM: 9. Modify the November and December Regular Council Meeting Schedule FROM: Ryan Bonk
RE: Modify the November and December Regular Council Meeting Schedule BACKGROUND:

The Regular City Council meetings on November 11th and December 23rd fall on holidays. The City has historically cancelled Regular City Council meetings that fall on holidays.

Additionally, the November 25 Regular Meeting is scheduled for the day before Thanksgiving, which is not a City Holiday.

RECOMMENDATION:

Cancel the Regular City Council meetings on November 11th and December 23rd.

Consider cancelling the November 25th Regular Meeting due to its proximity to the Thanksgiving Holiday.

A special meeting can be held if any business is urgent before the next regular meeting date. The Council could also consider holding a special meeting on November 18th if the November 25th Regular Meeting is cancelled.
