Land Acknowledgement:
The Town of Portola Valley acknowledges the colonial history of this land we dwell upon the unceded territory of the Ramaytush (rah-my-toosh) Ohlone, Tamien Nation, and Muwekma (mah-WEKmah) Ohlone, who endured a human and cultural genocide that included removal from their lands and their sacred relationship to the land. Portola Valley recognizes that we profit from the commodification of land seized from indigenous peoples and now bear the ecological consequences. We seek to understand the impact of these legacies on all beings and to find ways to make repair.

RE: Receive Notice of Intent to Update Town’s Conflict of Interest Code RECOMMENDATION:
No action is needed at this time. Amendments to the Conflict of Interest Code will be brought to the Town Council for adoption by Resolution, in November, after a 45-day review period, as required by law.
BACKGROUND
The Political Reform Act requires every State and Municipal government adopt a Conflict of Interest Code in order to require elected officials and certain designated positions to disclose potential conflicts of interests in the areas of real property, gifts, loans, business positions, stock holdings, etc.
The Fair Political Practices Commission (FPPC) is charged with the responsibility of overseeing that process and requires that all governing bodies be notified before October 1, every even year, when it has been determined that certain designated Town positions, responsible for making higher level financial decisions, should be included in the Code.
DISCUSSION
The current Conflict of Interest Code’s designated positions are listed below.

ride out through the trails in Portola Valley (including to our house!) and also the Monkey Trail and other destinations.
We plan to put a small corral back on our property so that we can bring our horses home from time to time so that we can explore more of our local trails. We moved to Portola Valley specifically because of its ties to the horse community and its trail system, and I am looking for opportunities to help preserve and support this ethos, and also give back to my community. I've been practicing law for over 25 years, so I am comfortable working with codes, policies, and politics. I look forward to meeting with you to see if I am a good fit for the committee.
Do you have any personal or financial interest that could be perceived by others as a conflict of interest relative to your service on the committee? If so, please describe.
No.
TIME COMMITMENT: Generally committees meet monthly and require a significant time commitment and participation at regular meetings. Please consider this level of commitment when evaluating your interest in serving on one of the Town's Committees.
Thank you,

RE: SMC Disposable Food Service Ware Ordinance
RECOMMENDATION
In support of our Town’s historical commitment to and prioritization of sustainability, I recommend that the Town Council join the majority of jurisdictions in SMC (16/20) that have adopted the County of San Mateo’s Disposable Food Service Ware Ordinance (No. 2021-31). My request in this memo is for the Council to direct staff to bring this ordinance forward for consideration for adoption by Nov 13, 2024.
DISCUSSION
Please see the summary of the ordinance entitled “Model Disposable Food Service Ware Ordinance Summary,” attached, which outlines:
• Vendor types impacted: food facilities and prepared food businesses • Items affected: one-time/limited use items associated with food and beverages • Items allowed: non-plastic, natural fiber-based materials • Items not allowed: plastic, either traditional (petroleum- based) or compostable (bioplastics, PLA, etc.), and polystyrene foodware (Styrofoam)
The following jurisdictions have already adopted this ordinance, and it is also in effect in unincorporated San Mateo County: Half Moon Bay (2020), South SF (2020), Burlingame (2020), Atherton (2020), Belmont (2020), Millbrae (2021), Brisbane (2021), Colma (2021), Hillsborough (2021), San Mateo (2021), Daly City (2021), San Bruno (2021), San Carlos (2021), Pacifica (2022), Foster City (2022), and Redwood City (2022).

TOWN OF PORTOLA VALLEY
If the Council agrees to direct staff to bring the ordinance forward, I recommend if passed, that enforcement would not begin until a year after adoption in order for local business to get up to speed with the majority of other businesses in San Mateo County, and for staff to have ample time to develop a plan to monitor compliance.

many years ago and I’ve also spent 12 years on the Woodside trail club board. My husband and I are empty nesters, and I now have time to volunteer. I would like to contribute my historical and practical knowledge of our town trails to this committee and hopefully help improve and preserve this wonderful town asset.
